Eagan, a Minnesota municipal corporation, organized under the laws of the State of
Minnesota, hereinafter referred to as "City".
WITNESSETH:

That the Landowner, in consideration of the sum of One Dollar ($1.00) and other
good and valuabie consideration, the receipt and sufficiency of which is hereby
acknowledged, does hereby grant and convey unto the City, its successors and assigns,
forever, a 6.0o foot permanent sidewalk and trail easement over, under and across the
following described property to wit:
That part of OUTLOT A, ELEMENTARY SCHOOL NO. 18, according to the
recorded plat thereof, Dakota County, Minnesota. Said Easement is described as
follows:
Beginning at the southwest corner of said Outlot A; thence northeasterly,
along the southeasterly line thereof, as distance of 44.32 feet; thence
northwesterly, at right angles to said southeasterly line, a distance of
6.0o feet; thence southwesterly, along a line parallel with said
southeasterly line, a distance of 40.91 feet to the west line of said
Outlot A; thence southerly, along said west line, a distance of 6.9o feet
to the point of beginning.
The grant of the foregoing permanent easement for sidewalk and trail purposes
includes the right of the City, its contractors, agents and servants to construct,
reconstruct, inspect, repair and maintain a sidewalk and/or trail and erect and maintain
signs in conjunction with the public's use of said sidewalk and/or trail and any signs
erected in conjunction with the use of the sidewalk and/or trail.
And the Landowner, for itself, and its successors and assigns, does covenant with
the City, its successors and assigns, that it is the fee owner of the lands and premises
aforesaid and has good right to grant and convey the easements herein to the City.
And the Landowner, for itself, and its successors and assigns, does covenant with

THIS EASEMENT, made and entered into this 4th day of October , 1996,
by and between WILLIAM C. LOOMIS and MARLYNE M. LOOMIS, husband and wife,
hereinafter referred to as "Landowners" and the CITY OF EAGAN, a municipal corporation
organized under the laws of the State of Minnesota, hereinafter referred to as the "City".
WITNESSETH:
That Landowners, in consideration of the sum of Eighteen Thousand Two Hundred
Sixty-six and 83/100 ($18,266.83) Dollars and other good and valuable consideration, the
receipt and sufficient of which is hereby acknowledged, do hereby grant and convey unto ;he
City, its successors and assigns, a permanent easement for ponding purposes over, across and
under the following described premises, situated within Dakota County, Minnesota, to wit:

which lies northwesterly of a line described as beginning at the Southwest corner

includes the right of the City, its contractors, agents and servants to enter upon the premises at
all reasonable times to construct, reconstruct, inspect, repair and maintain pipes, conduits and
mains; and the further right to remove trees, brush, undergrowth and other obstructions. After
completion of such construction, maintenance, repair or removal, the City sha11 restore the
premises to the condition in which it was found prior to the commencement of such actions,
save only for the necessary removal of trees, brush, undergrowth and other obstructions.
