We have information in our files that indicates the keeping of horses on the property dntes back to at
least 1981. It is my understanding that horses hnve been continually kept on the property since that time,
and nt that time the property wns zoned Agriculture. The same person that owns the parcel with the
horses (Mike Niesius) also owns the Justman Freight trucking property south of it. In 2000, he owned a
combined approx, 5.5 to 6 acres, the southerly portion of which contained the trucking operation and the
northerly portion contained the horses. The two parcels containing the trucking operation were rezoned
from Ag to commercial (GB, General Business) in 1977. The R-1 zoning on the northerly parcel was
established in 1984. In 2000, nll of the pnrcels were unplatted. The northerly parcel that contains the
house and horses wns platted in 2003, and thot's when the house was built.
In response to an inquiry from Mr. Neisius in 2000 about constructing a new horse barn on the property, we
sent Mr. Neisius a letter in August of 2000 explaining thnt the keeping of horses on the.property wns n
non-conforming use, not permitted in R-1 zoning. That letter stated thnt while the horses could remain on
the property, a new horse barn would be considered an expansion of the existing non-conforming use and
the zoning would not permit thnt.
Please let me know if you need additionnl research on this. Thank you.

We've received a complaint about the residents at 660 Red Pine Lane having horses. As far as I can tell the
property isn't zoned agricultural, so horses wouldn't be allowed. However, I'm assuming that some older
properties may have been grandfathered in at some point, as I've noticed quite a few properties that have horses
but appear to be less than 5 acres. Do you having any info on this?
