Dear Mr. & Mrs. Leholm:
The City of Eagan actively manages its right-of-ways and, by ordinance, regulates
the installation and maintenance of trees, shrubs and landscaping within or
affecting these areas. The ordinances aze intended to protect and promote the
safety and welfaze of the general public.
Please be on notice that your property located at 3910 Princeton Trail has been
found to be in violation of the City ordinances pertaining to the installation and
maintenance of trees, shrubbery or landscaping within the street right-of-way.
Eagan City Code, Section 7.08, provides, in part:
Subd 1.D.3 Any trees, shrubs ar landscaping planted or installed widhin a street
rlght-of-way shall be at least ten (10) feet frorra the back of the curb or riventy
(20) feet from the edge of the road surface where no curb or gutter exists.
Subd. I.D.4 Trees, shrubs and landscaping shall not be planted or maintained
on pubdic or private property in such a manner as to obscure or impede the
visual sight dines required to ensure the safe and efficient circulation of vehicles
and pedestrians on streets, iniersections, trails, and sidewalks. Trees, shrubs or
dcmdscaping shall not be planted qs to block the visibiltty of any regulatory,
warning or street identification sign or block the illumination of streetlights...

Specifically, the spruce tree in front of your property is located in the City right-
of-way. This azea is typically reserved for public utilities, snow storage, safety
setbacks and sight cleazances. In order to insure that the public needs aze
protected, the City of Eagan has adopted a City Code (see excerpts above) that
regulates the uses permitted within this public right-of-way. At a minimum, the
tree branches must be removed to a distance of 10 feet behind the curb in this
area. Tota1 removal of the tree would be an option but is strictly your choice; the
City is not requiring the tree be removed at this time.
A copy of the City's "sight clearance" standazd plate is included for your
