The plans and specifications for trunk storm sewer outlets in several
areas including Pro,ject #381 - Borchert Ingersol Pond, Project tt382 - Hurley
Lake and Pro,ject p383 - Schwanz Lake were presented for approval. It was
noted the majority of the required easements have been acquired and that it is
expected that remaining easements will be acquired by Novemebr 1. Upon motion
by Egan, seconded Thomas, it was resolved that the plans and specifications
for Contract !{83-17 be approved and the Clerk be authori2ed to advertise for
bids to be opened at 10:30 a.m, on Thursday, October 27,?1983 at the City
Hall. All voted yes.
HEIISY'FRANZ - SENIOR CITIZEN DEFERMENT APPLICATION
The application of Henry Franz for Senior Citizen Deferment under Pro,ject
#297 was presented to the Council: It was noted that the Council had approved
the deferment at its Sune 7, 1983 meeting, but would not be relieved of the
1983 installment already eertified on his 1983 property tax statement. Dale
Nathan,.. Attorney, appeared for the applicant and noted that the payment will
be over 20% of the gross income of Mr. Franz. He also suggested that the cost
Por reimbursement would not be substantial and suggested that Mr. Franz bear
the administrative cost. He suggested Mr. Franz pay the reimbursement cost
but not be required to pay the second installment. Egan moved, Wachter
? seconded the motion to authorize the refund of the 1983 installment, subject
; to payment oP the reasonable administrative costs. All voted yes.

A letter from Rod Hardy of Sienaa Corporation discussirg side yard set-
backs that relate to Northview Meadows Addition was presented to the Council.
There were concerns of the building department relating to distances between
residential units. There was no actian on the letter dated September 29, 1983
from Mr. Hardy, but general agreement concerning its contents.

that the Council approve the 16 foot setback variance for Lot 7, Block 1, Twin
View Manor 2nd Addition, upon submission oF written concurrence by a11

Richards Court in Tagan, Minnesota. Apparently Mr, Swanson owns a
lot next to the Grandpres upon which rngelby Construction is building
a home for Mr. Swanson.
The Grandpres are quite concerned about erosion and storm u+ater
draina9e onto their property from Mr. Swanson's lot. A drainage
swale on the Gr.andpre property has filled up with sand irom t.he
construction, an(9 a manhole cover for the water main between the two
properti.es has been cover.ec3 with approximateJ.y four feet of fi.ll.
Storm water from tlie recent ra.in is a concern as well. Unless
changes are made, the Grandpre property could be subject to basement
flooding as well. as damage from erosion. Ther.e is already damage to
the Grandpres' sod.
The Grandpres have hrought these concerns to Mr. Swanson, and he
ri.ghtfully has poiirt ed out that it is the builder's responsibility.
ftowever, it i.s Mr. Swanson's responsibil.ity, as owner of the
property, to ensure that the builder prevents any damage to the
Grandpr.e property, The only way to cor.rect these problems will be
for the bui.ldPr to install a retaining wall to hold back erosion and
restore the drainarye swale on the Granclpre property, and to replace
any damayed sod. Tt is essential that this be done as soon as
possible. If this is not done before the closing on the property, it
may be @ifficult for Mr. Swanson to have the builder to correct the
problem.
This letter is being sent in the hopes that the problem will be
cor.rected in the very near future. If it is not corrected, the
Grandpces reserve the right to bri_ng any appropriate claims for
damage to their property. We urge hir. Engelby and Mr. Swanson to
