Fire Department Response Time Excellent
The City of Eagan has xecendy experienced more than its shaze of txagedy, but the spirit of the community
remains strong. I am concemed, however, by a few statements expxessed regarding the xesponse time of the
Eagan Fiue Department to the Royal Oaks Apartment fue.
Let me begin by saying that I am exrtemely proud of the pexformance of our volunteet Fixe Deparanent, not
only at this incident, but each and every day. These 100 individuals aze out neighbois; they live in oux
community and choose to serve Eagan in a very nnportant xole-pzotecting lives and the pzoperty of our
citizens. Second only in size to Blooxnington's volunieer fotce, our depaxtment is highly qualified, well ttained
and well equipped.
The avexage response time foz an emergency in Eagan is within thzee to four minutes and is genetally an Eagan
Police Officei. The avexage xesponse time for the first fixe supptession vehicle to arrive on scene is within eight
to ten minutes. 11us compazes favorably with other similatly sized communities. According to the police
dispatch log, Eagan Fire trucks were at the scene within eight minutes of the uutia19-1-1 call on October 19.
The Eagan dispatch system automatically logs all calls into an electxonic database. As each police or fue unit
arrives on scene, they also xeport their arrival to dispatch.
On Thutsday, October 19, at 2:11 p.m. the Eagan dispatch centex xeceived a call to 9-1-1 sepotting a structutal
fire at 3517 Fedeial Dxive. At 2:14 the first Police Officet arrived on scene. The officer began assessing the
situauon to detemune the extent of the fire and if evacuadon had occurxed. The officer established a safety
perimeter and determaied hydrant locarions. This information is then zeported to the dispatch centex so it
could he telayed to ficefightexs in-ioute. Upon axrival, other officers entered the builcling to alert tesidents.
By 2:16 p.m. the first fuefighter atrived and began an evaluation of the building itself. At 2:19 p.m. the first fire
trucks artived. 45 firefightets, five fire engines and aerial trucks were on site. The first priority was a physical
seazch of the upper units of the apartment building to ensute safe evacuation of all tesidents, a necessary first
step befoxe fre suppression can begin. This takes time, but the protection of human life takes pxionty over the
ptotection of a structure.
The Fixe Department's good response, extensive ttaining and exceprional equipment, prevented the fire from
spreading to adjacent struchues ox causing gtass fixes. Although wind gusts exceeding 30-40 miles per hou;,
wozked to accelerate the hlaze, it was successfully contained and suppxessed.
A Ciry's Insuxance Service Office (ISO) xating is based pxixnarily on factors telated to the operation of the Fue
Depatttnent including the quality and training of the department's petsonnel, tesponse times, equipment and
certain design aspects of the City that unpact fire supptession. Eagan's ISO rating has been upgraded from a
class five to a class tluee in a recent evaluation. This is an excellent xating.
I shaxe this information with you to clarify some unportant public information about the October 19 fire and
especially to eaptess to the zesidents of Eagan my pxide in the exceptional level of service provided daily by ouc
volunteei firefightets. As with all City seroices, we strive fox excellence in all opeiations to provide the quality
public services and safety Eagan residents expect and deserve.

A letter was received by the City from Mr. Robert Barbour, 1461 Richards Court, on Friday, January 7. The
City Administrator rypically reviews correspondence addressed to the City Council to detemvne if a staff
response is required; however, due to the late mail distribution on Friday, there wasn't an oppoituniry for the mail
to be reviewed and included in the packets. The letter was included in the Mayor and City Council inboxes to be
included with the mail received durhng the week of January 10-14 for distribution on Friday, the 10.
On Wednesday, 7anuary 12, the Ciry received a follow-up letter from Mr. Bazbour that makes reference to the
letter written on January 5 and received by the City last Friday.
I brouglrt the letters to the attcntion of Chief Therkelseq who informed me that Mr. Bazbour had filed a police
report regazding the incident on January 8. Chief Therkelsen contacted Mr. Barbour on the moming of
Thursday, January 13, and explained that to date, these letters had not been received by the Ciry Council and
there was no further motive or suspects regazding the egging of his house. I spoke with Mr. Barbour later in the
moming and had a very nice conversation and explaived why the City Council had not received the
correspondence. I told him that the letters would be distributed to the Council in their packets on January 14. I
had a very pleasarn conversation with Mr. Bar6our, who expressed a tremendous amount of pride in the eiglrt
years he has lived in Eagan. We also had a good discussion regarding the trash hauling issue he addressed at the
January 4 City Council meeting.

My interest in the public hearing on a uash hauling issue prompted me to attend the January 4 meeting of tUe
Eagan City Council but the repon from the Community Activity Center Task Force proved a more revealing
ex-posure of how our city government really wo. ks. The .rs:: force chair presented a though!ful rea p ef the
issue which illustraterl a signi8cant effoR to identify the several areas of the community which will benefit
fram the proposed center. The suggested incremental approach to the proyect and ongoing ideatification attd
accommodation of future needs seemed most thoughtfut. This presentation was followed by a representative
of the EAA (Eagao Athletic Association) who proceeded to address only the athletic facilities of the project
and seemed to threaten an F.AA boycott of the entire projecx unless EAA was guatanteed controt of a
significant portion ofthe atMletic facility in any planned community center. EAA seems to demand a sGce of
the pork before the pig is fiurowed. Councilperson Masin challenged this demand as prematwe. There was
no presentation by any of several other groups which could beneSt from facilities other than athtetic in a
community ceutec Was this lack of participation by otha than tha EAA planned ot accidemat? I have the
uneasy feeling that tttis community center project is driven by aad primarily for the benefit of the EAA and
others who will benefit from the atliletic facilities of the center. The presertation mentioned several
gynmasiumsl
A rush to a bond issue referendum to support the community center project was the primary concem of the
mayot and council majority. Again we witness a"Pig in a poke" issue similar to a past parka referendum.
The mayor and counal are again aslong for a blank check from the citizens without sufficieM exposure of
the uue agenda, which could be merely a grandiose complex of several gymnasiums. Mayor Awada
commented that a bond issue referendutn authorizing several miliion dollars for the project may be in etccess
of the acwal expenditures for the project and that the council would spend only the amoum noeded. How
naive of our mayor to suggest that any goveming body can resist spending all the money available. It
appears that a public hearing to further explore the needs and desires of goups ot6er than the EAA will not
be held and we will be required to vote on a referendum to fund a project which may benefit a few and be
funded by all.
A clear nced at this time is to proceed with land acquisition and negotiations with neighbors of the proposed
site. Suita6le sites are kw and fast disappearing, land is becoming more expensive by the day.
Councilperson Bakken proposed a preliminary non-binding outline of project features for preseMation of the
seferendum which could suggest much and guarantee nothirg. I wholeheartedly support this cammuu+ity
center project and endorse the need for indoor atliletic facilities. I also urge t6e city fathers to address the
diverse needs of the communiry rather than make it a just a temple for jocks. Perhaps they could find a way
to have an initial bond referendum fund only the site acquisition and a detailed meaningful preliminary
architectural siudy and proposal which could then be subject for review and modification after publication of
the study and pubGc hearings.

Dear Mayor Awada and Council Members:
I am not sure if this should be addressed to anyone in paRicular so I will again share my thoughts with all of
you. On January 5, I wrote a letter to the editor of our local papers describing my concero regarding the
way you folks govern our clty. I extended to all of you the courtesy of an advance copy of the letter wtuch
as of this writing has not yet been published. You five people appear to be the only ones w6o were able to
disseminate my opinion expressed in ttiat letter to parties unknown whose reaction would precipitate the
vandalism at my home on the evening of January 8, 2000.
I regud the rather juvenile message I received lest evening as more than coincideace. 17te vandalism
immediately followed your receipt of my letter to the editor sharing my opinion with you prior to
publication. About ten O'dock in the evening af January 8, several eggs were thrown at my home, the
crows now feasting on the egg residue are damaging my new roof. The roof damage may extend beyoad
juvenile vandalism to malicious property damage. IYs been a long time since I had a teen age daughter at
home and suffered a simitar episode. Cleaning up a mess like that in &eezing weather is difficuh for a
seventy something persoq there is no easy remedy for the problem on the roof in mid-winter. I strongly
suspect juvenile perpeVators acting on the suggestion of adults w6o desire vindictive retaliation for my
holding a poor opinion of your govemance.
The Eagan "Petticoat PazliamenY' together with their adversaries and our residert "Dumpster DiveT' (his
actions are presented as a creative effort to stay within the law and gather evidence) have made the city of
Eagan a laughing stock. I am ashamed to admit that I voted for all of you. You even made the front page
of the Star Tribune. Your shenanigans read more like "Joe Millers Joke Book" than the crime novel the Star
headline mendons. Someone seems to have chosen to teach me Eagan Politics 101 by damaging my home,
possibly acting on information available only to all of you. I extend my sympathy to the those responsible,
please give up politics and grow up. Politics should be a game of words, it is now again reduced to
vandalism, what's next? physical violence? should I now be afraid of more serious retaliation? I trust tbat
my antagonist does not look to Kid Cann and Al Capone as a role models.
I am too old to challenge you at the polls but I look forward to the awakening of the electorate of Eagan
and retiring all the clowns at the next election.

Dear Tom:
Thsnk you for the list of residential Vash haulers licensed in Eagan. I will explore the new and only
Eagan based service, I always prefer a small local provider of services. I dearly miss the fine secvice and the
pleasant and efficient customer service people at Aagard. It appears that my concems regarding the qualiry
of service and rate increases we can expect from Waste Management were right on target. The Eagan
council should their homework and closely monitor the takeover of trash hauling in Eagan by W aste
Manttgement, or aze they party to the project? Did you pass along my comments of January 15 to the
council? Did they have any response?
My first bill from Waste Management, dated Jan 1, 2000, arrived on February 22. This bill
included a 37% increase in the chazge for yard waste service. They now bill in advance for service provided
oniy during the summer. They offered no prior notice of the price increase and the advance billing of
summer yardwaste service. I regard it as foolish to pay Waste Management in advance for the quality of
service they offer. The phone number on their bill provided access to several minutes of the usual "push 1
for ?" series of nested menus which ultimately required pushing zero to get a Gve person who said if I was
calling regazding service in Eagan I must call another number which again offered a series of"push 1 For ?"
menus. When I finally reached a Gve person who could respond to an Eagan customer I requested a priMed
schedule of their services and chazges. I was infortned that they offered no printed schedule of their various
services and charges and that the service I will receive is that which I was billed £or, no choices are offered,
take it or leave it! The arrogant atritude of the Waste Management customer service people and the
difficulty in contacting them is reminiscent of my past experiences with them. Years back they were
unavailable by phone, full carts in my drive waited for days, sometimes weeks, before they were serviced.
When I canceled their service they continued to bill for the canceled service.
Waste Management has also changed the time o£pickup in our area which now may require placing
the cart the night before. I am reluctant to expose my trash overnight in a communiTy which supports an
official dumpster diver and subjects those of us who challenge the powers that be to destructive vandalism.
Thanks again for your help, we aze fo[tunate to have professionals doing the real management of
our city and leavening the shenanigans of our politicos.

yard It is also hard to believe that an independent opetator would plow the entire block, curb to curb, to lay
down the track I observed. In any event it doe.s not seem necessery to make apologies for the inevitable
laavn damage.
Again I repea; you follcs do a great job, I thsnk you for your ldnd and considerate response and your offer

I was distressed to read a copy of your letter dated March 25, 1997. I am the individual with
whom you talked during that day. I feel badly because somehow we mis-communicated.
I appreciate your positive comments about our snow and ice control services. We have had over
fifty positive responses over this long winter. I also agree that it may have been unnecessary to
plow snow on March 25th, but unforiunately our residents and traveling public overwheltningly
request and demand this service. We make operational decisions taking moming rush hour
traffic into consideration and we cannot always count on forecast highs. Safety of the traveling
public is our foremost concern.
Once again, I apologize for the mis-communication. Ixnmediately after our initial conversarion, I
dispatched a maintenance operator to rernove the sod and dirt from your driveway while our
plowing operations continued.
When I called you back, the mainline plow operator who plows your road was standing in my
office and he stated that this damage occurted before he arrived. He is a fourteen year exemplary
employee, one of our most safe and careful operators. This is and was not a point of contention.
With almost 440 miles of curb line in our City and operations which occur approximately twelve
times each yeaz, it is inevitable that occasional damage to the City owned boulevazd directly
behind the curb line will occur. Our mainline plows aze all equipped with oversized wings and
only one operator. We must plow all the way to the curb and operators cannot readily detect the
curb line with our "surmountable" curb. Many fimes underlying freezing rain and ice causes

vehicles to steer poorly. All these things contribute to this problem. We monitor boulevazd
damage continuously and have spent many, many hours considering what might be done to
prevent this drain of City resources. Our operators aze extremely conscientious and proficient
and we believe that it is clearly the exceprion when damage occurs because of cazelessness.
Again, when I talked to you the second time that day, I was asking if you knew of any other plow
vehicle which may have caused the damage. You stated that you were certain that it was a City
plow. I then said that I would put your address on our sod list to be repaired in the first or second
week of May. Your response was "fine, if I don't take caze of it first."
As I re-read your letter, it stands out that you feel that the City "refuses to admit responsibility"
for this damage. I am very sorry. At the time of our second phone conversation I assumed we
had reached a point where you were satisfied with the City's response.
I stopped by your home on Friday, Mazch 27th at 4:15p.m. and personally removed the balance
of the damaged sod from your yard and had a short chat with your wife.
It is my wish that you will continue to "enjoy the best of City services." Please contact me
personally if the boulevazd repair does not meet your expectations.

For several years I have been plea,andy surprised by the superb job you follcs do on cleazing our streeu after a snowfall.
We have been Eagan homeowrters for about 5 years and have enjoyed the best of city services. The conhast of our
Eagan streets in winter to other twin cifles communities is remarkable. You do an excellent job ofmaintaining our
,treets. I am, however, deeply disappointed with the response I received from your office on htazch 25, 1997 aftec your
city plow damaged my front lawn for the second time this winter. This time it was sevzre da[nage. We apparently have
a different snowplow dnva serving our cul-de sac this year. In years past we have had no damage to the lawn and
excepRonally cansiderate care in plowing this azea.
This winter hes been a iude awakening. When the banks needed to be pushed back a few weeks ago your big wing glow
removed some sod and placed it and the sheet gravel about 10-12 feet into my yard, the only yazd in the block so
affected. I remarkcd to your pickup plow driver that day ihat the wittg plow encroached an unusual amount inW the
yazd that day. I accepted this as a hazazd of winter in Minnnesoffi and did not call your office a that time, intending W
repair the damage and sweep the gravel away when it thawed. Today was an unwelcome suiprise. I had not expected
any plowing today, it would have all melted by noon. As I wallced out to get my deily paper about 6:30 A11S I found a
pile of sod and dirt in my driveway and 6-12 feet into the yard. A foot wide sttip of sod had been peeled o8 by ihe wing
plow and thrown a considerable distance into the yard and driveway. At that time of moming it waa easy to see riie path
of the plow azound the cul-de-sac and into my yard. I am 70 years old and have coronary disease. I am advised against
shoveling, my snowblower could not handle the sod and dirt on the drive so I called your office to see if you could get
the sod and soil off the driveway.
I was greated by a very cardial end understanding genfleman who promised to try and get the problem corrected. About
mid afternoan he called back and advised me that he had viewed the damage and said that the Eagan city plow did not
do this damage, the plow drivet denies causing the damage, and the city will not repair the damage. He was 14nd enough
to partially clear the drive, for which I thanked him. He said some private plowing service woridng on a driveway in the
azea was responsible. There are no private plowing services serving any home on this cul-de sac. My eazly moming
assesment of the damage cleazly reveaLs, and my photos will conSrm, that the street plow deposited the sod and soil far
from the street The only eatplanation wouid be if some private service plowed the entire cul-de-sac this moming. The
pnor damage by the wing plow supports the fact ttiat todays damage was indeed caused by the city wing plow.
I perhaps undetstand the need for the plow driver ta deny responsibilty to protect his record, is he new on the job7 Prioi
years aze evidence that this cul-de sac can be plowed without the severe damage we suffered today and less severe
damage eazlier this winter. The thin snow cover last night made it easy to see the oudine o£the street and curb. I cannot
agree with the opinion of the supervisor aftzr he viewed the damage after the thaw, he did not see the plow tracks before
they melted. [ would have accepted a refiual to repair the damage if the city would have just said "we aresorry we
damaged your lawn due to the inconsiderate operation of our snowplow but the city lacks the resources to repair lawns
damaged by e-nowplows." No need to deny responsibility, just refuse to fix it! I question the need for the plows to have
been out on residentiel sheets this day, yesterdays light snow melted by noon. Perhaps the money spent on uneeded
plowing would be bette[ spent repairing prior damage by seenungly inconsiderate plow operators.
I do not accept the city of Eagans refusal W admit responsibility for this damage. I azn insulted by the denial of
responsibility for this incident. Is this typical Eagan street deparhnent policy, - to refuse to admit responsibilit}R The
cost of the repair is not the issue, fix it if you care W or I will do it. I challenge your aperators refusal to admit
responubility and your support of his actiun. From my past observation of the excellent work you follcs do, I mwt
regazd rhis upentors acdun and denial of responsibility as not typical of your staff.
