E EAGAN, MN 55 FRONTIER MIDWEST HOMES CORPORATION FRONTIER MIDWEST REALTY, INC. 454.0433 Ken Vraa, Park's Director pity of Eagan 3830 Pilot Knob Road Eagan, Minnesota 55122 RE: Hampton Heights Trail Requirement As we have discussed over art ore than carie occasion in two to three weeks, Frontier Companies has serious reservations regarding the requirement of the Park's Committee to install a trail along Coachman Road through th Hampton Heights Subdivision. Our objection are based upon the following information. First, when the Park's Committee reviewed the and made its recommendation in March 1985, no re pr oaf Frontier Companies was at the meeting nor were we a hat the Park's Committee meeting would take place. A such, we had no opportunity for any input regarding the Subdivision and Park Committee requirements. At that meeting, the Park Committee reviewed the plat. The plat, which was reviewed by the Park Co contained 19U lots and showed Coachman Road as a straight --through connection from the existing Coachman to the southerly line on the Hampton Heights proper Subsequent to the first proposal made by Frontier Compan s a result of negotiations through the platting proc ith the :Planning Commission and City Council, the plat reduced to 130 lots, and a curvilinear street was attached Coachman on the north end of the plat and halted prior to 'nuecting to the south end of the proposed plat. Therefore, Coachman Road was reduced from a straight -t collector street with an eighty foot proposed righ to a sixty foot right--of-way, standard residential s The City Subdivision Ordinance, Section 13 of the i:ity Code, Page 388 delineates under Paragraphs 1 and 2, Subdivision 8, that in the event there is a trail --way designated through ars area proposed to be platted, then that trail -way must be May 2 , 1(56 Mr. Ken Vraa Page 2 accommodated by easements dedicated to the City. indicates that in lieu of the reasonable parkland dedication that may be required by the City, the City require a cash payment based upon a schedule established the City Council. The development agreement proposed fo` Hampton Heights indicates that the development will be responsible for the normal cash dedication requirement of $440 per unit ora total of $57,200. It also regdires> as currently drafted, that the developer provides a `ituinous trail --way located on Coachman Road which shall extend. North and South through the plat. This would indicate that a trail -way must be provided. along Coachman Road, South to termination at Pacific Avenue, and then westerly ,along Pacific to Baltic and then southerly to the southern edge the plat. This requirement of the plat, of the Planned Development Agreement, is based upon recommendations of the Park Co ittee which are, in our opinion, in violation of the Fagan. City Code. The Code requires that the trail -way, if labeled on a pian, be provided for. There iso trail -way plan on the trail plan included within the Eagan Comprehensive Guide Plan. Discussions with you indicate that there is no trail shown through the area occupied by Hampton Heights Subdivision; however, there is a trail shown along the general alignment of the gas line ea which' is located North of Hampton Heights. Th City's sidewalk requirements have always been only collector streets. Originally, Coachman Roacl would have qualifiedas a neighborhood collector; however, its status has been downgraded since the Park Committee reviewed the original plat. To our knowledge, the requirement o a tr way along residential streets located in Hampton Heigh s would represent the first time that the City has required a trail -way on a standard residential street. We are presently in the final stages of completing development agreement for Hampton Heights. This de agreement is required prior to final platting. We have tried. along with your cooperation, to obtain ti on a Park's Committee meeting prior to today; however e were unsuccessful due to the previous commitments of the Park Committee, especially those commitments regarding public hearings at Dakota County on bicycle trail --ways. Sind were unable to resolve this issue with the Park's Co it has remained in the development agreement draft. As have explained to you before, Frontier Companies did not realize that there was any requirement for a trail -way u approximately three weeks ago. Commission recommended a cash dedication, and a trailway along Coachman Road from Yankee Doodle south to the preliminary plat entitled "Blackhawk Glen".
