This is to confirm our telephone conversation regarding the above
referenced project.
We have reviewed the specification booklet on the crematorium,
the existing drawings and the applicable codes. We have also
talked to Gene Bender at Bender Sheet Metal who is the Mechanical
Contractor. We offer the following comments.
The crematorium has a U.L. listing so it should qualify as a gas
burning appliance similar to a boiler. The crematorium should be
installed in a two hour rated room. All ducts penetrating the
walls or ceiling of this room should have fire dampers installed.
Please note that the input to the crematorium is 1,600,000-
2,000,000 BTUs and this room may require two exits. This
requirement should be checked with the Local Building Inspector.
The gas train to the crematorium should meet the requirements of
the Minnesota Codes and the Owners Insurance Company. The unit
should be placed in a location where the flue can go straight up
thru the roof. The flue should also be placed in a two hour
rated chase where it goes thru the upper floor. Code required
clearances must be maintained from the flue from any combustible
materials. This should be a minimum of 6

Fresh air will be required for combustion and cooling. The
combustion air opening required would be a free area of 1 square
inch per 4000 BTU of input or 500 square inches of free area.
The 36" X 36" louver recommended by the manufacturer would be
more than adequate. A 36 X 18 duct should go from the louver to
12" above the floor. A 36 X 12 opening should be provided at the
floor and 36 X 12 opening should be provided at the ceiling.
While a motorized damper in the louver interlocked with the
crematorium is not required by code we would recommend that one
be installed. This would cut down infiltration when the
crematorium is not in use.
In talking to the Mechanical Contractor, the combustion air will
not be heated. This room could possibly get cold in the winter.
We would recommend the installation of a gas fired unit heater in
this room to prevent any water pipes in this room from freezing.
This unit heater should have approximately 200,000 BTU output.
Also this room could get fairly warm in the summer while in use.
We would recommend an exhaust fan of approximately 1500 CFM be
installed and operated from a reverse acting thermostat so if the
room gets to warm the fan comes on.
This should provide you with the information you require. If you
have any questions, please do not hesitate to contact our office.

This letter will serve as a follow -up to our previous telephone
conversations concerning the installation of cremation equip-
ment.
We are presently engaged to furnish a 100 lb. per hour cremation
system to process human remains. This installation will take
place at the Southwest Funeral Home, 414 Marie Avenue, S. St.
Paul, MN 55075. The contact person there is Mr. Thomas Klecatsky
at (612) 451 -1551.
It is understood by our firm from previous discussions with you
that permitting is not required for human or animal pathological
cremation systems as long as the allowable particulate emission
rates do not exceed .08 grains per dry standard cubic foot,
corrected to 12% CO2.
The particulate levels on this unit based on previous stack test
data that we have on file is less than .02 grains per dry stan-
dard cubic foot corrected.

Please be advised we represent Thomas and Richard
Klecatsky, the owners of the Klecatsky Funeral Home, located in
the City of Eagan. More particularly, their funeral home is
located in Century Point Addition, just off Coachman Road.
I am writing to you with respect to the inadequate and /or
improper storm drainage along Coachman Road as it drains south-
ward toward Yankee Doodle Road. Because of improper engineer-
ing of Coachman Road and the inadequate provisions for drainage
of thet watershed north of the Klecatsky property, their pro-
perty is subject to flooding whenever there is rain in any
substantial amount.
The City of Eagan should be aware of this problem. In
Septemer, 1987, Thomas Klecatsky and Donald Klober sent the
City a letter which detailed the nature of this problem. A
copy of this letter is enclosed for your reference. Subse-
quent to this letter, there were a number of follow -up contacts
with the City requesting that action be taken to correct this
problem, but no corrective action has been taken.
On this past Wednesday, June 27, 1990, the Klecatsky pro-
perty was once again flooded as a direct result of the improper
drainage of storm runoff. It is intolerable that this situa-
tion continues without the City taking some direct action to
resolve the problem. The Klecatskys would appreciate knowing
what the City's intentions are on this matter. What does the
City intend to do to resolve the problem and when will it take
action?

I have discussed this matter with both Tom and Dick
Klecatsky and they would appreciate having an opportunity to
meet at the property with you and any members of your staff

Dear Sir,
As property owners of the Century Point Addition and adjoining Foxridge properties
we are writing you with regard to the gross inadequacy in storm drainage along
Coachman Road as it drains southward to Yankee Doodle Road. Recent storms have made
us aware foc the first time of poor engineering in the upgrade of Coachman Road, that
widened and added curbing to the street. Work was completed in the fall of 1985.
Examining the catch basins as provided in the street upgrade, revealed that water
collected from the street and adjoining property( much of which is city park land,
must run to the catch basins at the corner of Coachman and Yankee Doodle Road.
Southward flow begins near the Woodridge Apartments at 3255 Coachman Road. We
have been told by Mr. Craig Knutson of your staff that these catch basins and piping
are of adequate design to carry the run off.
Looking at the results of overwhelming water on July 23rd which put five feet of
water and mud in the basement of the Klecatsky Funeral Home, sewer backup into
Century 21 Realty plus large mud deposits in the Foxridge garage areas we were told
that nothing could have handled such a volume. We will not dispute this claim;
however, in looking at the elevations and possible run off locations as Coachman is
now built, it is apparent that a rainfall of much less magnitude will produce similar
results.
As runoff water is channeled down Coachman Road by the curb and gutter, there are
four openings at which it will be diverted from its path to the corner at Yankee
Doodle. The first two are the driveways that enter the parking and garage areas of
Foxridge Apartments. Next is the street of Century Point. Finally the driveway
leading to Century 21 Realty. At each point the grade established in the improvement
of Coachman Road allows water to run off the street intorthe previously mentioned
openings. This water does not reach the catch basins designed to carry it away. All
grades at these openings were established and installed with city approval at the time.
Catch basins and drainage are provided for in the apartments and the Century Point
addition; however, their capacity was established for the area they serve, not for
additional water channeled to them by the Coachman Road curb and gutter.
We feel the city can remedy this problem with the placement of additional catch
basins on Coachman Road prior to the four openings. This letter may be considered
a formal request for such action. If the city fails to act to remedy the problem, I.
are prepared to do what is necessary to obtain relief. We contend that our area
storm drains bear no responsibility to carry off rainfall that occurs outside the
limits of our property. May we please hear from your office on this matter within a
reasonable time after your complete examination of the area.

This letter is intended to solicit the co-operation of the City of Eagan in
an assignment of the corner lot credit due Donald B. Virginia C. Klober for the
improvements to Yankee Doodle Road, namely Project No. 427 City of Eagan, Dakota
County, Minnesota.
At the time improvements were made on Coachman Road (1007 Street 348) the en-
tire Century Addition was owned by Donald B. Virginia Klober, husband and wife,
and Klecatsky Brothers Investments, a General Partnership. while the addition had
already been platted and recorded as of September 20, 1984, the assessments for
Coachman Road were made to all properties in the Century Addition. At a later
time it was realized that only abutting property was liable for the Coachman Road
improvements. The Klobers owned all the abutting property at that time. Klecatsky
Brothers Investments owned all the non abutting property. None the less, Klecatsky
Brothers Investments became liable for $3,698.34 of the total project. No protest
of the assessment was made due to our lack of knowledge of how the assessments
applied or did not apply to non abutting property. Payments of the assessment
are current with the Dakota County Assessors Office including interest due for
annual installments.
We understand that the corner lot credit for project No. 427 is based on 75'
feet times the $7.43 per foot commercial assessment rate. This is $5657.25
We propose to divide this amount on a 2 /3rd 1 /3rd basis; the same formula used to
divide the Coachman Road assessment on Century Addition. Th3at�will mean Klecatsky
Brothers Investments will receive the 2 /3rd portion, or-$3771.5 and Donald Virginia
Klober will receive the 1 /3rd portion, or $1885.75.
All parties agree to this division of the corner lot credit as a means to in-

Addition and your individual properties. It appears that the
current drainage pattern, storm sewer system and driveway /street
openings do not add to the drainage problems that you currently
experience within the Century Addition. The amount of runoff
from Coachman Road that enters into Century Point is very minimal
due to its being intercepted by upstream driveway entrances into
the Foxridge Apartments.
It appears the majority of the drainage problems that you are
encountering are associated with rainfall that falls within your
subdivision and the lack of adequate storm sewer facilities or
overflow drainage swales that should have been provided with the
development of this subdivision by the developer and /or builder
of the structures contained therein.
If any additional storm sewer improvements are requested either
within the Century Addition or along Coachman Road, the City can
proceed with such a public improvement upon petition of 51% of
the affected property owners. The cost associated with these
improvements will be spread as a special assessment against the
benefited property owners.
Although the City did review specific plans as a part of the
Century Addition development, these improvements were designed,
installed, inspected and recommended for acceptance by the
developer and his private engineer. Because the City requires
these types of improvements to be designed by a registered
professional engineer, it is their professional responsibility to
insure that City standards are met in their design and
construction procedures. The City does not review specific
design calculations but only a cursory review of those proposed
improvements.

response to that letter dated September 23, 1987.
It is my understanding that as a result of the flash flooding that
occurred in Eagan on June 27, the funeral home had the lower level
flooded out. In reviewing the site plan layout for this site,
there is very little protection on the property for any temporary
street flooding that may occur during similar high intensity
storms.
The City's storm sewer lateral system is designed to handle a five
year frequency storm event. Any rainfall in excess of that amount
is expected to be handled by an overland drainage system either
within the public street right -of -way or through defined overland
drainage swales to the City's trunk storm sewer system, which is
designed to handle the 100 -year frequency event.
Evidently, during the site planning of your internal parking lot
layout and drive -under garage, there does not appear to be any
provisions made for overland drainage to continue south into the
City's ponding area south of Yankee Doodle Road before flowing down
the driveway providing access to your lower level.

facilities if the benefitted property owners are willing to pay for
the cost. Therefore, the most expeditious manner to resolve this

identify the costs associated with the installation of additional

Re:. Coac Road Drainage Concerns
Dear Mr. Klecatsky Mr. Klober:
In response to your letter of September 4th, we reviewed the
drainage system for Coachman Road as it may impact the Century
Addition and your individual properties. It appears that the
current drainage pattern, storm sewer system and driveway /street
openings do not add to the drainage problems that you currently
experience within the Century Addition. The amount of runoff
from Coachman Road that enters into Century Point is very minimal
due to its being intercepted by upstream driveway entrances into
the Foxridge Apartments.
It appears the majority of the drainage problems that you are
encountering are associated with rainfall that falls within your
subdivision and the lack of adequate storm sewer facilities or
overflow drainage swales that should have been provided with the
development of this subdivision by the developer and /or builder
of the structures contained therein.
If any additional storm sewer improvements are requested either
within the Century Addition or along Coachman Road, the City can
proceed with such a public improvement upon petition of 51% of
the affected property. owners. The cost associated with these
improvements will be spread as a special assessment against the
benefited property owners.
Although the City did review specific plans as a part of the
Century Addition development, these improvements were designed,
installed, inspected and recommended for acceptance by the
developer and his private engineer. Because the City requires
these types of improvements to be designed by a registered
professional engineer, it is their professional responsibility to
insure. that City standards are met in their design and
construction procedures. The City does not review specific
design calculations but only a cursory review of those proposed
improvements.

Please be assured that the City stands ready to remedy any
problems you feel are necessary. However, we can only proceed to
take such corrective action based on our ability to assess the
benefited properties for those improvements or an agreement by
those property owners to accept all related costs. Again, a
detailed review of the drainage basin and on -site investigations
during recent rain storms show that your property does not
receive an inordinate amount of drainage outside of your
subdivision.
I regret that this letter may not contain the information that
you had expected. However, it is in line with City policies and
ordinances. Please let me know if we may assist you any further
in trying to alleviate your drainage concerns.

Please be advised we represent Thomas and Richard
Klecatsky, the owners of the Klecatsky Funeral Home, located in
the City of Eagan. More particularly, their funeral home is
located in Century Point Addition, just off Coachman Road.
I am writing to you with respect to the inadequate and /or
improper storm drainage along Coachman Road as it drains south-
ward toward Yankee Doodle Road. Because of improper engineer-
ing of Coachman Road and the inadequate provisions for drainage
of thet watershed north of the Klecatsky property, their pro-
perty is subject to flooding whenever there is rain in any
substantial amount.
The City of Eagan should be aware of this problem. In
Septemer, 1987, Thomas Klecatsky and Donald Klober sent the
City a letter which detailed the nature of this problem. A
copy of this letter is enclosed for your reference. Subse-
quent to this letter, there were a number of follow -up contacts
with the City requesting that action be taken to correct this
problem, but no corrective action has been taken.
On this past Wednesday, June 27, 1990, the Klecatsky pro-
perty was once again flooded as a direct result of the improper
drainage of storm runoff. It is intolerable that this situa-
tion continues without the City taking some direct action to
resolve the problem. The Klecatskys would appreciate knowing
what the City's intentions are on this matter. What does the
City intend to do to resolve the problem and when will it take
action?

I have discussed this matter with both Tom and Dick
Klecatsky and they would appreciate having an opportunity to
meet at the property with you and any members of your staff
whom you deem appropriate to attend such a meeting. The
purpose of the meeting will be to discuss how this problem can
be resolved in the most expeditious manner.
I would appreciate it if you would call me to arrange such
a meeting. I will be out of the office on Thursday and Friday,
so I would appreicate it if you would call me on next Monday to
arrange such a meeting.

Dear Sir,
As property owners of the Century Point Addition and adjoining Foxridge properties
we are writing you with regard to the gross inadequacy in storm drainage along
Coachman Road as it drains southward to Yankee Doodle Road. Recent storms have made
us aware for the first time of poor engineering in the upgrade of Coachman Road, that
widened and added curbing to the street. Work was completed in the fall of 1985.
Examining the catch basins as provided in the street upgrade, revealed that water
collected from the street and adjoining property, much of which is city park land,
must run to the catch basins at the corner of Coachman and Yankee Doodle Road.
Southward flow begins near the Woodridge Apartments at 3255 Coachman Road. We
have been told by Mr. Craig Knutson of your staff that these catch basins and piping
are of adequate design to carry the run off.
Looking at the results of overwhelming water on July 23rd which put five feet of
water and mud in the basement of the Klecatsky Funeral Home, sewer backup into
Century 21 Realty plus large mud deposits in the Foxridge garage areas we were told
that nothing could have handled such a volume. We will not dispute this claim;
however, in looking at the elevations and possible run off locations as Coachman is
now built, it is apparent that a rainfall of much less magnitude will produce similar
results.
As runoff water is channeled down Coachman Road by the curb and gutter, there are
four openings at which it will be diverted from its path to the corner at Yankee
Doodle. The first two are the driveways that enter the parking and garage areas of
Foxridge Apartments. Next is the street of Century Point. Finally the driveway
leading to Century 21 Realty. At each point the grade established in the improvement
of Coachman Road allows water to run off the street into'the previously mentioned
openings- This water does not reach the catch basins designed to carry it away. All
grades at these openings were established and installed with city approval at the time.
Catch basins and drainage are provided for in the apartments and the Century Point
addition; however, their capacity was established for the area they serve, not for
additional water channeled to them by the Coachman Road curb and gutter.
We feel the city can remedy this problem with the placement of additional catch
basins on Coachman Road prior to the four openings. This letter may be considered
a formal request for such action. If the city fails to act to remedy the problem,
are prepared to do what is necessary to obtain relief. We contend that our area
storm drains bear no responsibility to carry off rainfall that occurs outside the
limits of our property. May we please hear from your office on this matter within a
reasonable time after your complete examination of the area.

The model cremation unit being provided is our Power -Pak II,
Model IE43 -PPII.
To confirm our UL listing, I have enclosed a copy of the Under-
writers Laboratories test record; listing #87E8, file #MH14647
and project #89RT128. Also, enclosed is a set of drawings con-
firming the tested minimum clearances of our equipment.

Dear Ray;
We inspected the area where you propose to install a crematory furnace flue
and note the following:
1.) There is no problem with cutting one truss to permit flue installation.
2.) Header both the top and bottom chords to adjacent truss and girder
truss. Use 2 x 6 headers.
3.) Provide 2 x 6 verticals between top and bottom chords of truss each
side of opening. Use 3/8" plywood gussets at joints well nailed.
4.) Provide 2 layers of fire code gypsum board on all sides of flue
enclosure up to roof deck.
5.) Provide 2 layers of fire code gypsum board to wood frame walls and
ceiling.
6.) The door to the crematory room will also have to be 1 hour and
provided with a closer.
With the above provisions the installation should meet all code provisions.
