WITNESSETH, THAT:
WHEREAS, By instrument dated September 12, 1969, and
filed December 31, 1969, as Document No. 369335 in the office of
Minnesota, City was granted
and repair utility lines,
through and over certain
real estate described on Exhibit A attached hereto and hereby
made a part hereof (hereinafter called "Subject Property
WHEREAS, Said Subject Property contains a 10 -foot
perpetual easement and a 100 -foot temporary construction easement
but does not contain a termination date for said temporary
easement;
WHEREAS, Part of said Subject Property has been replatted
as Fox Ridge Addition according to the plat thereof on file and
of record in the office of the County Recorder, Dakota County,
Minnesota, since the date of said instrument;
WHEREAS, First National Bank of Minneapolis, a national
banking association, as Trustee, is the owner of Lot 1, Block 2,
Fox Ridge Addition (hereinafter called "FNB Property which
property is within said Subject Property;
WHEREAS, Easements granted in said instrument consist
of a 10 -foot perpetual easement which lies outside of the FNB
Property, and a 100 -foot temporary construction easement which lies
within the FNB Property but is no longer used or needed by the City,
and said owner desires that City release the FNB Property from
the rights and these easements contained in said instrument; and
WHEREAS, City is willing to grant such a release.
NOW, THEREFORE, In consideration of the foregoing and
for a valuable consideration, receipt whereof is hereby acknowledged,
City hereby grants, conveys, releases and discharges, without
all of its right, title and interest in and to the FNB
Property described as follows:
Lot 1, Block 2, Fox Ridge Addition, according to
the plat thereof on file and of record in the
office of the County Recorder, Dakota County,
Minnesota,
as acquired by instrument dated September 12, 1969, and filed
December 31, 1969, as Document No. 369335 in the office of the
County Recorder, Dakota County, Minnesota, including the right
to enter in and upon the FNB Property to lay, maintain, operate
and repair utility lines.
IN TESTIMONY WHEREOF, City has caused this instrument

EXHIBIT A
A 10 foot perpetual easement and a 100 foot temporary construction
easement for storm sewer purposes, over and across Lot 12, Block 1,
Robert Karatz Addition, as of record in Dakota County, Minnesota,
and a portion of the East 1/2 of the Southwest 1/4 of Section 9,
Township 27, Range 23, Dakota County, Minnesota. The centerline
of said 10 foot and 100 foot easements to be a common line and
described as follows: Beginning at a point on the south line
of Lot 12, Block 1, Robert Karatz Addition, said point being 5 feet
west of the southeast corner of said Lot 12; thence northerly
parallel with the east line of Lot 12, a distance of 340 feet;
thence westerly parallel with the south line of Lot 12 a distance
of 260 feet, said line to be known as line A; thence westerly a
distance of 110 feet to a point.362 feet north of the south line
of Lot 12 and there terminating. And also a 10 foot perpetual
easement for catch basin purposes, the centerline of which is to
be described as follows: Commencing at the easterly end of line A;
thence westerly along line A a distance of 88 feet to the inter-
section of the centerline of said 10 foot easement. Said centerline
being 50 feet in length, perpendicular to Line A, and extending
25 feet northerly and southerly from line A and there terminating.
A 10 foot perpetual easement and a 100 foot temporary construction
easement for sanitary sewer purposes, over and across Lot 12,
Block 1, Robert Karatz Addition, as of record in Dakota County,
Minnesota, and a portion of the East 1/2 of the Southwest 1/4
of Section 9, Township 27, Range 23, Dakota County, Minnesota.
The centerline of said 10 foot and 100 foot easements to be a
common line and described as follows: Beginning at a point,
said point being distance 268 feet east of the west line of Lot 12,
Block 1, and distance 50 feet north of the south line of said Lot 12;
thence northeasterly along a line to a point, said point being
distance 265 feet west of the east line of Lot 12, and distance
350 feet north of the south line of said Lot 12; thence northerly
perpendicular to the south line of Lot 12, a distance of 343 feet;
thence easterly parallel with the south line of Lot 12 to a point
5 feet west of the east line of said Lot 12; thence northerly
parallel with the east line of Lot 12 a distance of 800 feet; thence
northeasterly to an existing sanitary sewer manhole, said manhole
'being distance 83.7 feet east of the east line of Lot 12, Block 1,
also known as the East line of the East 1/2 of the West 1/2, of the
Southwest 1/4 of Section 9, Township 27, Range 23, and distance
1863.7 feet north of the South line of the Southwest 1/4 of Section
9, Township 27, Range 23, and there terminating.

easement, for water main purposes, over and across Lot 12, Block 1,
Robert Karatz Addition, as of record in Dakota County, Minnesota,
the center line of said 10 foot and 100 foot easements to be a
common line and described as follows:.
Beginning at a point on the west property line of Lot 12, Block 1,
Robert Karatz Addition, said point being distance 5 feet north of the
southwest corner thereof; thence easterly parallel with the south line
of said Lot 12, a distance of 258 feet; thence northerly perpendicular
to the south line of Lot 12, a distance of 55 feet; thence northeasterly
along a line to a point, said point being distance 350 feet north of
the south line of Lot 12, and distance 275 feet west of the east line
of Lot 12, said line to be known as line A; thence northerly
perpendicular to the south line of Lot 12, a distance of 100 feet and
