September 23, 2009 Martin Simmons 14801 Judicial Rd Burnsville, MN 55306 RE: 1475 Highview Avenue Building Code Violations Dear Mr. Simmons: On September 22, 2009, the City of Eagan Building Inspections Division performed an inspection of the lower level of your home. There were numerous Building Code violations found during our inspection: 1. The newly installed lower level exit door shall be accessed by a complying ramp or stair per Section R311.4.1 of the Code. Reference 311.5.1 through 311.5.7 for stairs and 311.6.1 through 311.6.3.3 for ramps. Guards complying with Section 312 would be required for the stair opening. 2. There shall be landings on both sides of this door complying with Section R311.4.3 of the Code. 3. Two of the Emergency Escape and Rescue openings have non Code complying window wells. Reference Section 310.2 for Code requirements. 4. The drip cap flashing for the new windows and door were installed on the outside of the existing siding. These flashing shall be installed so that the upper leg is behind the siding, creating a water intrusion barrier at the top of the windows and door. 5. It was also discovered that the water heater in the lower level had a manufacturer's date of January 2008. There is no record of a permit being issued for a new water heater installation. 6. There is one bedroom that does not have a complying egress window required by the Code. A complying window shall be installed in all sleeping rooms per Section R310 of the Code. 7. Smoke detectors are also required per Section R313 of the Code. The lower level had no smoke detectors at the time of this inspection. 8. A Code complying hand- railing per Sections 311.5.6 through 311.5.6.3 shall be installed on the interior stairwell leading from the lower level to the main level of the house. 9. There appeared to be Electrical Code violations in the lower level as well. I have contacted Marty Kumm of the Minnesota Department of Labor and Industry, CCLD (Electrical Division) and informed him that there may be some issued with electrical work that was done. At some point, the lower level of your home was finished. The City of Eagan has no record of any permits being issued for this work. Please respond in writing before October 9, 2009 with your plan of action concerning this matter. Thank you in advance for your attention to these items.
