Dear Mr. Franz:
At the Special Assessment Committee meeting of July 30, 1984, the
Committee was informed that your representative, John Kline, was
unable to attend to present your objections on your behalf. Sub-
sequently, the Special Assessment Committee continued the review
pertaining to your objections until the next Special Assessment
Committee meeting which has been scheduled for 4:00 P.M. on Tuesday,
October 9, 1984 in the City Council Chambers of the new Municipal
Center.
Since it is anticipated that this will be the last meeting of the
Committee during 1984, it is strongly recommended that you make
whatever arrangements are necessary to present your position at
that time. Any additional information you can provide in advance
would be appreciated so that the Committee will have an opportunity
to review before the meeting to insure that the discussion relates
to the merits and not establishing the facts.

In response to the City's reauest in June of 1982, MnDOT prepared a draft oopy
of a Cost Participation Agreement No. 61103 to facilitate joint aon,;sition of
approxi.matel_y 3.43 acres for the future 6.0 M.G. water reservoir on the above
referenced parcel. After reviewing the draft copy of this agreenient and the
estimated cost to the City of Eagan for joint acquisition of this parcel
through MnDOT's riqht-of-way acquisition for 35E, the City Council at theis
formal n-eeting of JanLary 4, 1983 passed a motion to withdraa fran further con-
sideration of this joint acrn,;sition.
In addition, at the January 4, 1983 Council meeting, the City Council passed a
resolution requesting MTDC7P to aoquire the neoessasy pesmanent right-of-way and
tesrr-orary easeineits resulting frean the irprover.ient o£ Deenwood Drive fran the
bridge ovPYil?lCs with I-35E and its connection to the existing irrproved section
of Deerwood Drive east of Riverton Avenue. It is my understancling that the
City of Eagan is responsible for the constx-uction, right-of-way and easement
acquisition for approximately 150' of Deenaood Drive constrnction. Therefore,
it would be appropriate to have a cost participation and joint acquisition agree-
ment prepared delineating the City's responsibility for this portion of Deenaood
Drive. The City feels that this joint acquisition and construction under MnDOT
contract would be the mnst efficient and econcanical reans for the City. There-
fore, we will wait for further infoxmation fran MmDOT as to what additional ao-
tion is required on bekialf of the City pertaining to Deexwood Drive.

ing to similar requests and look forward to workinq cooperatively with you per-

Your note of October 27 requested information on the acquieition of the reser-
voir site for the 6.0 M.G. Water &eservoir south of Deerwood Driue. This is
on arcel No. 1.0'-02100-010-50?owned hy Francis Franz. ?

Immediately after we received your letter of June 21, 1982, we had a meeting
with representatives of Mn/DdT here at our office. At that.time we diacussed
a number of topics, among them being the acquisition of this reservoir si[e
during the acquisition of their right-of-way. We provided them with sketches
of the required site similar to those which we had previously provided to
you. It was not necessary for us to prepare a legal description nor to have
any surveying done on this project. Mn/DOT proceeded from that point with
their own right-of-way acquisition and were to prepare the necessary legal
description of the site together with the necessary joint agreement.
In telephone conversation with Chester Tollefson today, he indicated that the
survey had been prepared and Chat he would send a copy of it to us. We will
send a copy to you as soon as it is received. Also, he indicated that the
Mn/DOT central office was preparing or had prepared the proposed cooperative
agreement which would cover the cost sharing in the acquisition of this site.
After discussing this with Wally Swanson at Mn/DOT central office, he indi-
cated that the tentative agreement had been sent to you and tha[ he was re-
searching several questions which had been raised relative to thie agreement.
Please advise if you wish us to do anything further on this project at this
time.

reqtesting the Minnesota Departrrent of Transportatiari to prepare an appmpriate

Eagan's future 6.0 M.G. water resenroir site located in the southwest corner of
the above-referenced parcel presently amed by Francis Franz. This request is
being pxooessed prematurely to our anticipated need for this site i.n the hopes
that A7nDot could incorporate this taking as a part of the 35E right-of-way ac-
quisition process for both pernnnent rightrof-way and tsmporaxy slope eas6nents.
The City of Eagan would be willing to accept the additional costs associated with
the fee title aa(uisition of thts additional land over and above the nornral costs
incixrred by the State in their right-of-way access negotiations frrn this pmper-
ty owner.
By copy of this letter, I am authorizing our Gonsulting Engineer, Mr. Aob Rosere,
to prepare the neozssary site plan and subsequent legal description for this rr
serwir site. When cmpleted, I will foxward this inforniation to your attention

Petitioner, by and through his attorney, states and alleges
as follows:
1. Petitioner is the owner of tax parcel #10-92100-010-50.
2. On September 3, 1991, the City Council of the City of
Eagan adopted an assessment against said tax parcel in the amount
of One Hundred Forty-seven Thousand Sixty and 24/100 Dollars
($147,060.24) pursuant to the Notice of Special Assessment for
Project #999372 attached hereto as Exhibit "A",
3. On June 28, 1991 Petitioner sold the property described
on Exhibit "B" to ACC/McCaw Cellular of Minneapolis.
4. Part of the assessment should be allocated to the parcel
purchased by ACC/McCaw Cellular of Minneapolis.
5. The assessment has been irregularly approved and adopted
and apportions the cost of the project among owners affected
thereby in an unfair manner.
6. The amount of the assessment exceeds the actual benefit,
if any, received by the lands owned by Petitioner.
7. On or before September 3, 1991, Petitioner qave written
notice to the City Clerk, City of Eagan, advising of his objection
to the assessment in accordance with Minnesota Statutes §429.061,
Subd. 1.
WHEREFORE, Petitioner asks the Court, pursuant to Minnesota
Statute §429.081, to set aside the assessment and order the City
of Eagan to re-assess Petitioner's property in order to accurately
reflect the special benefit, if any, received hy the property owned
by Petitioner as a result of City of Eagan Project #999372.

Petitioner, ACC/MeCaw Cellular of Minneapolis, by and through
its attorney, states and alleges as follows:
1. ACC/MCCaw Cellular of Minneapolis is the owner of the
property described on Exhibit "B", having purchased the same from
Francis Franz on June 28, 1991. The property purchased by
Petitioner was part of the lands which comprise tax parcel #10-
02100-010-50.
2. Petitioner did not receive notice of any assessment which
the City of Eagan intends to assess against the lands purchased by
Petitioner.
3. On September 3, 1991, the City Council of the City of
Eagan adopted an assessment against said tax parcel in the amount
of One Hundred Forty-seven Thousand Sixty and 24/100 Dollars
($147,060.24) pursuant to the Notice of Specfal Assessment for
Project #999372 attached hereto as Exhibit "A".
4. Pursuant to §429.061, Subd. 1 on or before September 3,
1991 Petitioner did serve written notice of its objection to the
assessment as to the parcel it purchased from Francis Franz.
5. The assessment has been irregularly approved and adopted
and apportions the cost of the project among owners affected
thereby in an unfair manner.
6. The amount of the assessment exceeds the actual benefit,
if any, received by the lands owned by Petitioner.
WHEREFORE, Petitioner asks the Court, pursuant to Minnesota
Statute §429.081, to set aside the assesement and order the City
of Eagan to re-assess Petitioner's property in order to accurately
reflect the special benefit, if any, received by the property owned
by the Petitioner as a result of City of Eaqan ProjeCt #999372.

I am the owner of tax parcel #10-02100-010-50 which is
proposed to be assessed by reason of City of Eagan Project
#999372. A copy of the Notice of Special Assessment for Project
#999372 is enclosed herewith.
Please be advised that by this letter I object to the
assessments set forth in the Notice of Special Assessment
attached hereto on the grounds that said assessment is illegal.
The reasons that I believe the assessment to be illegal include,
but are not limited to, the followinq:
(a) The assessment has been irregularly approved and
adopted;
(b) The assessment has been apportioned among the property
owners affected thereby in an unfair manner; and
(c) The amount of the assessment exceeds the actual
benefit, if any, received by my lands from said
project.
Please also note that the tax parcel as identified on the
Notice of Special Assessment includes lands which I no lonqer
own. I have previously sold to Cellular One the lands described
on Exhibit "B" attached hereto, for which lot split approval was
obtained from the City of Eagan. Their lands should be
separately assessed. I respectfully request that the amounts
proposed to be ultimately assessed to my parcel be separately
stated for purposes of my appeal proceeding.

Enclosed with this letter is a legal notice of the final assessment
hearing scheduled to be held before the City Council at 7:00 p.m.
on September 3, 1991. This is the final assessment hearing wherein
the final costs associated with the City street and utility
improvements installed in conjunction with I-35E will be formally
presented for consideration of final adoption and certification to
Dakota County.
Due to the number of business items that the City Council must
address at each meeting, time constraints may limit the staff's
ability to properly address all the questions and concerns that may
arise to the level of detail desired by the affected property
owners. Therefore, we would like to provide an opportunity for you
to review and discuss the completed project and proposed final
assessments with City staff at an informational meeting scheduled
to be held at 6:30 D.m. on Thursdav. Auctust 22, 1991. in the

NOTICE IS HEREBY GIVEN that the City Council of the City of
Eagan, Dakota County, Minnesota, will meet at the Eagan Municipal
Center located at 3830 Pilot Knob Road, in said City on September 3,
1991 at 7:00 p.m. to consider the proposed assessment of utility

The area proposed to be assessed is all property described above,
all as more fully and particularly described in the assessment roll
on file with the City Clerk in his office, which roll is open to
public inspection. The total amount of the proposed assessment is
$756,266.77. Written or oral objections will be considered at the
public hearing.
No appeal may be taken as to the amount of any assessment unless
a written objection, signed by the affected property owner, is filed
with the City Clerk prior to the hearing or presented to the
presiding officer at the meeting. An owner may appeal an assessment
to district court pursuant to M.S.A. Section 429.081 by serving
notice of the appeal upon the Mayor.or Clerk of the City of Eagan
within thirty (30) days after the adoption of the assessment and
filing such notice with the District Court of Dakota County within
ten (10) days after service upon the Mayor or Clerk.
Notice is further given that pursuant to the Minnesota Statutes,
Sections 435.193 to 435.195, the City of Eagan has adopted City

WHEREAS, Petitioner Frances Franz was the owner of a parcel of
land in the City of Eagan formerly with the property identification
number of 10-02100-010-50 ("Parcel A"); and
WHEREAS, on June 4, 1991, Respondent City of Eagan ("City")
approved the split of Parcel A and waiver of plat;
WHEREAS, on September 3, 1991, the City assessed Parcel A
$147,060.24 for water lateral trunk, storm sewer trunk, sanitary
sewer and street as part of'PUblic Improvement Project No. 372; and
WHEREAS, on October 25, 1991, a Warranty Deed dated June 28, 1991

Minneapolis was recorded with the Dakota County Recorder's office;
WHEREAS, Respondent was notified that on October 25, 1991, Parcel
A was divided into two tax parcels each with different identification
nwabers: 10-02100-012-50 ("Parcel B") and 10-02100-011-50 ("Parcel
C"); and

WHEREAS, Francis Franz is the owner of Parcel C; and
WHEREAS, the City apportioned $128,973.09 of the levied
assessments to Parcel C; and
WHEREAS, Petitioner brought an action in District Court appealing
the assessments against his property for Project No. 372, known as
Francis Franz v. Citv of Eaaan, Court File No. C1-91-8435; and
WHEREAS, the parties have resolved all dispute over the
assessments against Parcel C.
NOW, THEREFORE, the parties do hereby agree as follows:
1. The assessments levied against the Parcel C for Project No.
372 shall be reassessed in the sum of $75,000.00. The $75,000.00
special assessments from Project No. 372 shall be entirely for street
construction purposes.
2. This settlement is made without prejudice to the City's
.
assertion of any rights it may have in the future to claim sanitary
sewer, storm sewer and water connection charges if and when Parcel C
connects to City utilities ' This settlement is also without prejudice
to Petitioner's right to contest any such connection charges in the
event the same were made by the City.
3. The City shall direct the Dakota County Treasurer to
recompute Petitioner's real estate tax statement for Parcel C using
the new assessment figure of $75,000.00.

4. The Petitioner waives Notice of Hearing and Hearing on the
reassessment of Parcel C.
5. The Petitioner shall be permitted to pay the entire sum of
$75,000.00 within thirty (30) days after the Eagan City Council has
reassessed Parcel C without interest.
6. Upon the execution of this Stipulation, the Petitioner shall
cause this action, Court File No. C1-91-8435 to be dismissed with
prejudice.

BACKGROUND INFORMATION
The two properties owners referenced above, have previously been
addressed by the Special Assessment Committee at the October
9, 1984 meeting pertaining to their similar objections associated
with the recent completion of the upgrading of Deerwood Dr from
Riverton Av to the east side of I-35E. This upgrading of Deerwood
Dr was performed under project 372 by MnDot through cost participa-
tion agreement #16932. The information that was previously reviewed
by the Special Assessment Committee at the October 9, 1984 meeting
has been reproduced and is included with this packet for reference
and discussion on these continued assessment objections.
A copy of the minutes ot the October 9, 1984 Special Assesment
Committee meeting has also been included without page number
for reference and discussion pertaining to these issues.
Enclosed on page (s) 19 - 2.40 is a proposed Special Assessment
Policy that has been prepared by staff for the committee's review
and adoption pertaining to assessments associated with the installa-
tion of sidewalks or trailways.
Although a portion of the Anna Heuer property has beer acquired
by School District #196 for the construction of the new Deerwood
Elementary School, the frontage location is not affected by this
proposed project but will be addressed under project #455 in
a manner that anticipates adoption of the recommended policy
#86-1. ,
The second and third concerns expressed by the committee at the
previous meeting pertained to the determination of "benefitted
frontaqe" by taking into consideration the configuration, topoqraphy
and setback restrictions that may be unique to that parcel.``- -
Due to the varying degrees that any of these items can be applied
to any particular parcel, it is difficult to create a uniform
policy. Therefore, each parcel should be addressed on its own
merits. In the situation of the Francie Franz property, the
two severed residual portions of his property are located east
of I-35E/north of Deerwood Dr and west of I-35E/south of Deerwood
Dr. As can be seen on page 9, by themselves these parcels have
limitations based on their configuration. However, if combined
with adjacent parcels (which is likely for developtnent) it will
benefit by its full frontage.

In relation to the last item discussed by the committee, it was
felt that this issue should again be addressed by the Special
Assessment Committee to the necessity of the adoption of a new
Special Assessment Policy. It?is ant?.pa ?yd that the committee's
recommendations pertaining to ?e new policy and disposition
of these assessment objections will be forwarded to the Council
for formal consideration.
STAFF RECOMMENDATIONS
The staff recommends that Special Assessment Policy #86-1 be
adopted and applied to all future and pending public improvement
projects.
In addition, it is recommended that a 400' frontage reduction
be allocated to Mr. Francis C. Franz (10-02100-010-50) due to
the configuration of the residual parcels remaining after MnDOt's
taking, subject to an agreement whereby this reduction will be
assessed at the time of development if combined with adjacent
parcels which would eliminate the configuration restriction to
benefit. All other assessments as proposed under project #372
for both parcels, shall remain as proposed with the exceptions
so noted in this recommendation.

BACKGROUND INFORMATION
The two property owners referenced above share the same concern
pertaining to the assessments associated with Project 372 for the
installation of utilities and street improvements along Deerwood
Drive as a part of the I-35E freeway construction. These utility
and street improvements are being performed in conjunction with a
Cost Participation Agreement No. 16932 between MN DOT and the City
of Eagan. Enclosed on pages -3 and 'l- are the letters
staff received from Mr. Franz (No. 010-50) and Mrs. Heuer (No.
010-78) requesting consideration by the Special Assessment Commit-
tee pertaining to their proposed assessments under Project 372.
Enclosed on page < is the preliminary assessment role associat-
ed with Project 372 which identifies the various types of assess-
ments associated with each parcel.
The improvements being provided to the Francis Franz property
(010-50) include lateral benefit from trunk watermain, trunk area
and lateral storm sewer, street, sidewalk and bituminous trail-way
construction. The location of these proposed utilities in relat}on-
ship to Mr. Franz parcel (010-50) are identified on pages (p
through e for watermain, storm sewer lateral, trunk storms
sewer and street with sidewalk and/or trail improvements. Enclosed
on pages /p through 1q. _ are the computations that were used
to determine the assessment obligation of Mr. Franz's parcel for
each of the improvements respectively.
Mrs. Heuer's parcel (010-78) is proposed to be assessed for street
and sidewalk improvements only. Enclosed dn page /,S is the
map showing the relationship of Mrs. Heuer's property to the
Deerwood Drive proposed improvements. Enclosed on pages /6,
and /'7 is the computations used to determine the assessment
obligation of this property.

Based on previous conversations held with the affected property
owners, it is staffs understanding that the basis for the
petitioners objection relate to the street and sidewalk improve-
ments associated with the upgrading of Deerwood Drive. These
improvements are being performed by MN DOT under Cost Participation
Agreement No. 61824. Enclosed on page /,r is Special Assessment
Policy No. 82-5 which addresses the issue pertaining to assessments
associated with street improvements funded through Cost Participa-
tion Agreements.
STAFF RECOMMENDATION
Utility modifications.and improvements being performed along Deer-
wood Drive provide direct benefit to the property being served,
Mr. Francis Franz (010-50). G+???or,+?.±t?_••, staff recommends that all

assessments associated with these utility improvements be reaffirm-
ed as proposed under Project 372.
In relationship to the common objection pertaining to assessments
associated with the street improvements of Deerwood Drive, staff
feels that Special Assessment Policy No. 82-5 is fair and equitable
and that the assessments proposed under Project 372 to Mr. Franz
and Mrs. Heuer should be reaffirmed as outlined in the feasibility
report due to the fact that these properties receive the benefit
associated with having Deerwood Drive upgraded to present day City standards for residential streets.

JUSTIFIGATlov; Due to the fact that there are different levels of service

that a specific property should not have to be responsible
for any oversizing cnsts above and beyond that whi.ch wnuld
normally be req,;red to service that specific zoned parcel
of land to current City standards. All oversizing wsts are
then absorbed and beam-e the responsibility of the City's
Major Street Construction F?md. Because the City's Majar
Street Constzuction EUnd has several sources of revenue (i.e.
MSAS funds, major road mi.ll levy, road unit charge surchazge,
grants, etc.), it is determined that an tmequal advantage --
wnuld he realized b a s
y pecific pazcel of land whose adjacent
street could potentially qualify for scxne specific outside
ftmding source. Therefore, because the benefit received fm*i

POLICY #86-1
Sidewalk/Trailway Assessment
SUBJECT: Assessments for the installation of concrete and/or
bituminous trailways and sidewalks.
PQLICY: Sidewalks and trailways shall be installed in
accordance with the City o£ Fagan's master street
and trailway plan which also incorporates related
County and State installations. At the time of
Council adoption of a project. through the public
hearing process, sidewalks and t.railways shall
be assessed at the City's rate in effect at the
time of the public hearing against all properties
zoned Mulkinle Residential (R-3), Commercial,
Institutional or Public Facility (P.F.). For
nurposes of this policy, land use guide pIans
and planned unit developments (P.U.D.) shall not
be considered as existing zoning at the time of
the public hearing. Properties zoned agricultural
(Ag), single family (R-1) or duolex (R-2) shall
not be assessed for any costs associated with
the installation of sidewalks or trailways. If
applicable, nroperties that a.re subsequently rezoned
at a later date to a higher_ qualifying zoning
classification shall be assessed at the rates
in effect at the time of the rezoning as a condition
of development approval in accordance with policy
#82-1.
OBJECTIVE: The purpose of this policy is to require higher
density residential developments, commercial
property, public facilities. and institutions to
participate in the cost of the installation of
sidewalks and trailways which are necessary due
to the oedestrian traffic generated and/or,
benefitted by these off-street imnrovements.
JUSTIFICATION: Due to the fact that agricultural zoned property
does not generate pedestrian traffic and taking
into consideration the fact that single family
(R-1) and duplex lots (R-2) are not allowed frontage
on collector and arterial streets where sidewalks
and trailways are constructed, the benefit
associated with the related sidewalks and trailways
are minimized accordingly. However, multiple

INFORMATION
The two property owners referenced above share the same concern
pertaining to the assessments associated with Project 372 for the
installation of utilities and street improvements along Deerwood
Drive as a part of the I-35E freeway construction. These utility
and street improvements are being performed in conjunction with a
Cost Participation Agreement No. 16932 between MN DOT and the City
of Eagan. Enclosed on pages -3_ and A?L are the letters
staff received from Mr. Franz (No. 010-50) and Mrs. Heuer (No.
010-78) requesting consideration by the Special Assessment Commit-
tee pertaining to their proposed assessments under Project 372.
Enclosed on page <_ is the preliminary assessment role associat-
ed with Project 372 which identifies the various types of assess-
ments associated with each parcel.
The improvements being provided to the Francis Franz property
(010-50) include lateral benefit from trunk watermain, trunk area
and lateral storm sewer, street, sidewalk and bituminous trail-way
construction. The location of these proposed utilities in relat?on-
ship to Mr. Franz parcel (010-50) are identified on pages
through ? for watermain, storm sewer lateral, trunk storms
sewer and street with sidewalk and/or trail improvements. Enclosed
on paqes /p through lIq are the computations that were used
to determine the assessment obligation of Mr. Franz's parcel for
each of the improvements respectively.
Mrs. Heuer's parcel (010-78) is proposed to be assessed for street
and sidewalk improvements only. Enclosed on page 1? is the
map showing the relationship of Mrs. Heuer's property to the
Deerwood Drive proposed improvements. Enclosed on pages /6
and /? is the computations used to determine the assessment
obligation of this property.
Based on previous conversations held with the affected property
owners, it is staffs understanding that the basis for the
petitioners objection relate to the street and sidewalk improve-
ments associated with the upgrading of Deerwood Drive. These
improvements are being performed by MN DOT under Cost Participation
Agreement [VO. 61824. Enclosed on page /,r is Special Assessment
Policy No_ 82-5 which addresses the issue pertaining to assessments
associated with street improvements funded through Cost Participa-
tion Agreements.
STAFF RECOMMENDATION
Utility modifications and improvements being performed along Deer-
wood Drive provide direct benefit to the property being served,
Mr. Francis Franz (010-50). Subsequently, staff recommends that all

assessments associated with these utility improvements be reaffirm-
ed as proposed under Project 372.
In relationship to the common objection pertaining to assessments
associated with the street improvements of Deerwood Drive, staff
feels that Special Assessment Policy No. 82-5 is fair and equitable
and that the assessments proposed under Project 372 to Mr. Franz
and Mrs. Heuer should be reaffirmed as outlined in the feasibility
report due to the fact that these properties receive the benefit
associated with having Deerwood Drive upgraded to present day City
standards for residential streets.

JUSTIFICATIOV: Due to the fact that there are different levels of service
Crand classifications for streets within the City of Eagan,
there are respective different mnstsuction cbsts associated
with proviciing street thomughfares to their different con-
struction design criteria standards. Therefore, it is felt
that a specific propesty should not have to be responsible
for any oversizing costs above and beyond that whi.ch would
normally be required to seivice that specific zoned parcel
of land to current City standards. All oversizing msts are
then absorbecl and beccm the responsibility of the City's
Major Street Construction Ftmd. Because the City's Major
Street Construction FUnd has several sources of revenue (i.e.
I'4SAS funds, major road mill levy, mad unit charge surchan7e,
grants, etc_ ), it is deternuned that an imce[ual advantage
would be realized by a specific parcel of land whose adjacent
street could potentially qualify for sarne specific outside
ftmding source. Therefore, because the bertetit received fzan
the irgroved roadway renains the same irrecxardless of the
source of fLmds, the assessrrent should be }ased on the bere-
fit received as determined by the annual zoning classirica-
ticn enu;valent rate and should not take into consideration
any financial mntrihution towards the cbnstruction fran an

In accordance with the City's Comprehensive Water Supply Plan and 5-Year Capital
Improvements Program, it is timely for us to begin the process of constructing the
communiry's sixth water reservoir. In accordance with our long-term Comprehensive Plans,
it has been proposed to be located south of Deervvood Drive and east of I-35E on the
above-referenced parcel. This structure wiil be similar in size and design to the Yankee
Doodle, Lexington and Safari Reservoirs. It will be a steel tank approximately 110' in
diameter and 83' tall. While the property is zoned Agricultural, its long-term land-use guide
is D-II. The Public Works Departmerrt has prepared a site plan for this site (copy enclosed)
and is actively pursuing the acquisition of the land through eminent domain proceedings as
authorized by Council action on October 4, 1994.
Upon the completion of the description for acquisition, we will be processing an application
to rezone this property and amend the Comp Guide Plan to Public Facilities (PF'. However,
we must determine the boundaries of the properry to be acquired. One of the defining
criteria is the setback required by City Code. In accordance with Section 112, Subdivision
7.C.2, the setback for public facility structures shall be 2' for every 1' in height. Based on
a proposed 83' tail reservoir, this computes to a minimum 165' setback from the base of the
reservoir.
This setback seems to be excessive in relationship to the setback that presently exists for
four out of the five other reservoirs within our community. The following is a table showing
setbacks for the Ciry's other reservoirs.

I'm not sure when the current setback zoning requirement was impiemented but, as can be
seen, none of the City's other reservoir facilities meet this setback.
Before the City can proceed with finalizing the detailed description of the area that must be
acquired through condemnation, I would like to have the City Council consider granting a
Variance to the Ciry Code allowing a setback of 50 feet.
I have attached copies of the site plan layout for the proposed Deervvood Reservoir along
with each of the other reservoirs showing the location of the tank in relationship to the
adjacent zoning/land use. Also, attached is a Variance request form completed by the
Pubiic Works Department on behalf of the City of Eagan. I would appreciate your
assistance in processing this request to the City Council so that a final determination can
be made to the configuration and size of the parcel that must be acquired by the City of
Eagan.
Historically, by constructing this type of public facility prior to the development of the
adjacent property minimizes many of the concerns that the code would try to address by
its setback requirement.
Please let me know when this can be presented to the Ciry Council and ff any addftional
information is needed.

WHEREAS, Francis Franz is the owner of property located in the
City of Eagan with the Property Identification No. of',10-02100-011-50 ?
("Subject Parcel"); and
WHEREAS, on September 3, 1991, the Subject Parcel, part of a
larger parcel, was assessed by the City of Eagan for water lateral
trunk, storm sewer trunk, storm sewer lateral and streets as part of
Public Improvement Project No. 372; and
WHEREAS, Francis Franz brought an action in District Court
appealing the sum of the assessments know as Francis Franz v. Citv of
Eaaan, Court File No. C1-91-8435; and
WHEREAS, the parties have agreed to settle this dispute according
to the terms of the attached Stipulation.
NOW, THEREFORE, BE IT RESOLVED, that the Eagan City Council
hereby adopts the attached Stipulation of Settlement resolving the
Franz assessment appeal and authorizes the Mayor and City Clerk to
execute the Stipulation on the City's behalf.

WHEREAS, Petitioner Frances Franz was the owner of a parcel of
land in the City of Eagan formerly with the property identification
number of 10-02100-010-50 ("Parcel A"); and
WFiEREA5, on June 4, 1991, Respondent City of Eagan ("City")
approved the split of Parcel A and waiver of plat;
WHEREAS, on September 3, 1991, the City assessed Parcel A
$147,060.24 for water lateral trunk, storm sewer trunk, sanitary
sewer and street as part of Public Improvement Project No. 372; and
WHEREAS, on October 25, 1991, a Warranty Deed dated June 28, 1991
conveying part of Parcel A from Francis Franz to ACC/Cellular of
Minneapolis was recorded with the Dakota County Recorder's office;
WHEREAS, Respondent was notified that on October 25, 1991, Parcel
A was divided into two tax parcels each with different identification
numbers: 10-02100-012-50 ("Parcel B") and 10-02100-011-50 ("Parcel
C"); and
WHEREAS, Francis Franz is the owner of Parcel C; and
WHEREAS, the City apportioned $128,973.09 of the levied
assessments to Parcel C; and
WHEREAS, Petitioner brought an action in District Court appealing
the assessments against his property for Project No. 372, known as
Francis Franz v. Citv of Eaaan, CouTt File No. C1-91-8435; and
WfiEREAS, the parties have resolved all dispute over the
assessments against Parcel C.
NOW, THEREFORE, the parties do hereby agree as follows:
1. The assessments levied against the Parcel C for Project No.
372 shall be reassessed in the sum of $75,000.00. The $75,000.00
special assessments from Project No. 372 shall be entirely for street
construction purposes.
2. This settlement is made without prejudice to the City's
assertion of any rights it may have in the future to claim sanitary
sewer, storm sewer and water connection charges if and when Parcel C
connects to City utilities. This settlement is also without prejudice
to Petitioner's right to contest any such connection charges in the
event the same were made by the City.
3. The City shall direct the Dakota County Treasurer to
recompute Petitioner's real estate tax statement for Parcel C using
the new assessment figure of $75,000.00.

4. The Petitioner waives Notice of Hearing and Hearing on the
reassessment of Parcel C.
5. The Petitioner shall be permitted to pay the entire sum of
$75,000.00 within thirty (30) days after the Eagan City Council has
reassessed Parcel C without interest.
6. Upon the execution of this Stipulation, the Petitioner shall
cause this action, Court File No. C1-91-8435 to be dismissed with
prejudice.

SUBJECT: ABANDONED PRIVATE WELLS/I-35E CONSTRUCTION
In July of 1983, MnDOT awarded a contract which provides for the
removal of several residences due to the progression of I-35E
through the City. As a part of that contract, the contractor is
required to abandon all private wells and cap them in accordance
with the Minnesota Department of Health regulations and forward a
copy of the log to the City of Eagan for our information and file
purposes. The following is a list of properties where the houses
will be removed and the wells subsequently abandoned:

This letter is a follow-up to our telephone conversation of October
20, 1989, and it will confirm the City's position of the amount
that is considered owing by you.
Attached is a computation of the amount, i.e. $24,358.38, that is
owed. z contacted Phyl Engstrom in the Dakota County Auditor's
office, and she is in agreement with the amount owed. Ms. Engstrom
administers the collection of the installments of special
assessments that have "Green Acres#' status in Dakota County.
According to the records of Dakota County, your property has Green
Acres status, i.e. the payment of special assessment installments
is postponed and has had that status since the inception of the
sanitary sewer assessment that was placed on your property.
According to our records, in 1983 you paid off 46.49% of your
special assessment obligation. This payment was considered full
payment for the amounts attributed to the land taken by the State
of Minnesota. The balance of the special assessment obligation was
left unpaid and since that time, additional special assessment
installments have been postponed under the Green Acres statute.
The installments are computed on an assessment equal to $10,845.20
payable over a 20 year period. The balance owed consists of 1
installment of $1,800.30 and 16 installments of $1,409.88. In
summary, the amount owing is:
1 installment @ $1,800.30 = $ 1,800.30
16 installments @ $1,409.88 = 22,558.08
Total $24,358.38
The amount of interest included in the $24,358.38 is $15,139.96,
and balance is principal in the amount of $9,218.42.
We have notified the County of your payment for the last 3
installments that were paid by you on October 18, 1989.
