When I was doing some reseazch on a surrounding parcel, I ran across this house move permit
application that was taken out in 1988. I looked up this address on PDS and the County website
and this house is still there with the original owners.
It's my guess that it would be rather difficult now to figure out what address this building move
permit should have actually been for. It looks like the landowner's name was °Lutz", not ""Irvin
Dahl".
Should I just leave the application in this file with a note on it that it has the incorrect address?

HUILDING MOVE POLICY 198$
NOTEe Up to a 21 day time frame is required to process applications and
information for a building move.
PERMITS REQUIRED:
I. Owner's permit - to obtain an owner's permit:
A. Read City Code, Chapter 4, Seetion 4.10
B. Fill out owner's permit application
C. Provide documentation that any existing septie system or aell has
been filled and/or capped in accordance with Mn. Dept. of Health WPC
40 and the Minnesota Water Well Abandonment Guidelines within 90 days
of move. (Requires a plumbing permit).
D. If structure is being disconnected from City sewer and water servicep
a permit to work in the right-of-way is required (contaet Engr.
Dept.)
E. If building is to be located in the City of Eagan:
1) an application must be submitted to Eagan's Community Development
Department for City Council approval of the owner's permit. A
filing fee ia required and all application submittals must be
provided 14 days prior to a City Council meeting. (Meetings are
held the first and third Tuesday of each month.)
2) obtain building permit, plumbing permit, HVAC permit, electrical
permit and sewer/water permit as for new construction.
F. There is no fee for an owner's permit unless City Couneil action is
required.
II. Mover's permit - to obtain a mover's permit:
A. Read City Code, Chapter 4, Seetion 4.10.
H. Fill out mover's permit application.
C. Provide a written guarantee to repair any and all damage to
City/County/State roaduays, utiliti s and/or right-of-way that may result

Notice of Continued Final Assessment Hearinq - Oct. 6, 1987
Dear Property Owner:
On September 15, a final assessment hearing was held before the
City Council regarding the improvements associated with the
above-referenced project. Prior to that meeting, you were mailed
a notice of that hearing which identified the proposed
assessments against your property.
Unfortunately, the amount referenced in that earlier notice did
not accurately reflect the total financial obligations of your
property in relationship to the improvements for that project.
The amounts that you were previously noticed for were based on
the assumption that you would execute an agreement with the City
postponing the additional assessments until such time that your
property were ever to be subdivided or developed to a greater
intensity than presently exists.
Because of this improper notification, the City Council continued
the final assessment hearing for your property until October 6 to
allow staff to provide you with a formal notification of your
property's total ohligation.
You will still have the opportunity to execute the appropriate
agreement which will allow your assessment to be reduced to the
amount that you were originally noticed of. As mentioned
previously, if you execute the appropriate agreement, the
significant difference between your previous noticed amount and
the one enclosed with this letter can be postponed at no interest
or carrying charge until the time of further development. If,
and when, your property should ever be subdivided or developed to
a higher use, the assessments to be levied at that time would be
in accordance with the rates in effect at the time of change of
use of your property. We cannot accurately state or guarantee
what those future rates will be. That is why you are being given
the opportunity to pay your property's entire obligation at the
present time or postpone a significant portion of it to a later
date at yet to be determined rates.

This special assessment policy providing for this postponement is
made available to those homeowners who currently homestead large
tracts of property adjacent to proposed City improvements and is
based on assessing only 100' of frontage and 1 acre of area.
If you have already submitted a written objection at the
September 15 meeting, that objection will still be honored at the
October 6 meeting without having to resubmit the new objection.
However, it is necessary for us to formally notice you of the
increased obligation and the necessity to execute the appropriate
agreement to have your assessment obligation reduced accordingly.
If you would like additional information regarding this policy or
the agreement, please feel free to contact me at your convenience
prior to October 6.

N. Encroachment Agreement—1025 Wescott Road
Action To Be Considered:
Approve an Encroachment Agreement for property at 1025 Wescott Road (Conservation
Easement).
Facts:
➢ On July 10, 2017, City staff received a submittal from Mr. Pat Hiller, representing the
property owner of 1025 Wescott Road (Parcel 100140053050), requesting a grading
encroachment within the existing conservation easement on the property, north of
Wescott Road, East of Lexington Avenue, in east-central Eagan.
➢ The easement was dedicated by document (December 2016), at no cost of the City, to
provide for the conservation of wetland and its buffer zone.
➢ The previous property owner removed all of the trees along the southeast side of the
wetland, prior to dedicating the conservation easement. All of the tree stumps
currently remain within the conservation easement and the area was never properly
restored.
➢ The purpose of the encroachment request is to remove the tree stumps, regrade the
area to address the stump removals and properly restore vegetation to the wetland
buffer.
➢ An agreement has been prepared by the City Attorney to allow the encroachment for
the restoration efforts. The agreement does not provide approval for any future
subdivision or development activity on the property.
➢ Public Works staff and the City Attorney's office have reviewed and found the
agreement to be in order for favorable Council action.

division of the site located at 1025 Wescott Rd. To date we have completed a preliminary site
layout,grading and wetland buffer restoration plan. Our site layout observes the existing 40'
wetland buffer and the 25' building setback from that buffer as well as the Wescott Rd and east
property boundary setbacks.
According to grading plan it will be necessary to temporarily grade into the existing 40'wetland
buffer. As you can see from the attached photos taken this spring the buffer currently consists
of several tree stumps. The proposed plan is to grind down the stumps as part of the site
grading work and then restore the wetland buffer with native seed and geofabric. This request
seems to be a win-win in that it restores.the buffer to a natural state and allows for the grading
necessary to develop the site.
Specifically, our request for the council to consider is to permit Norton Homes to temporarily
grade into the 40'wetland buffer as part of an approved R1-S residential sub-division
application. No changes are requested to the location and definition of the buffer.
For this attached grading plan we have made the following assumptions:
1. We are using Lidar topo and elevations since the site has not yet been surveyed.
2. Proposed LFEs for lots 2-4 are set at 3' above observed water elevations when the site
was last surveyed as part of the current Sakallah Addition plat. Those elevations will be
revised as necessary after a detailed hydrology analysis has been completed.
3. The proposed site grading will not impact the current water elevations and, as such, no
changes to existing D/U easements are necessary.
4. We were not able to obtain a tree inventory of the trees cut down in the buffer area.

We are bringing this request to the council now because permission to grade into the 40' buffer
is required in order to permit site development. Before we spend the time and money on a full
engineering design and plat application our desire is to seek the cooperation of the council with
this temporary grading request first.

ENCROACHMENT AGREEMENT
This Encroachment Agreement ("Agreement") is made and entered into this 3`d day of
August, 2017, by and between the City of Eagan, a Minnesota municipal corporation (the "City"),
and Wael Z.F. Sakallah and Heidi M. Sakallah, husband and wife (the "Owners"). The City and
Owners are hereinafter referred to as the"Parties."
WHEREAS,the Owners are the fee simple owners of certain real property located in the City
of Eagan and legally described as Lot 1,Block 1, Sakallah Addition(hereinafter the"Property"); and
WHEREAS, the Owners' dedicated a conservation easement in favor of the City, which
easement is dated December 20, 2016 and recorded with the Dakota County Recorder as Document
No. 3169807 and depicted on Exhibit"A"attached hereto(the"Easement"); and
WHEREAS, the Owners have requested permission from the City to undertake certain work
within the area covered by the Easement; and
WHEREAS, the Owners desire to have permission to clean-up the Easement and remove
stumps and other debris and regrade the easement area in a manner acceptable to the City Engineer
(the "Improvement"); and
WHEREAS, in connection with the Improvement, it is necessary for the Owners to encroach
within the Easement; and
WHEREAS, the City is willing to allow Owners to encroach within the Easement to
complete the Improvement, all upon the conditions contained herein.
NOW, THEREFORE, in consideration of the foregoing recitals which are hereby incorporated by
reference,the City and Owners agree as follows:
1. ENCROACHMENT. The City hereby grants permission (but not the obligation) to the
Owners to construct the Improvement within the Easement. The Improvement must be
completed no later than one year from the date of this Agreement.
2. No WAIVER.Nothing in the Agreement shall be deemed a waiver or abandonment of the
Parties rights in the Easement.
3. COSTS. In the event the Owners elect to exercise their rights hereunder, the Owners shall
be responsible for all costs relating to the construction of the Improvements.
4. ASSUMPTION OF RISK. Owners acknowledge that the future maintenance, repairs within
the Easement could possibly damage the Improvement. By entering into this Agreement,
Owners assume the risk of any and all damage to the Improvement that may result from
any work performed by the City and/or its agents within the Easement.
5. NOTICES.All written communications shall be directed to Owners at:

7. VALIDITY. If any portion, section, subsection, sentence, clause, paragraph or phrase of
this agreement is for any reason held to be invalid, such decision shall not affect the
validity of the remaining portion of this Agreement
8. BINDING AGREEMENT. The parties mutually recognize and agree that all terms and
conditions of this Agreement shall run with the land herein described and shall be binding
upon the successors and assigns of the parties hereto.
9. GOVERNING LAW. This Agreement shall be governed by and interpreted under the laws
of the State of Minnesota.
