Gene VanOverbeke, Director of Finance for the City of
Eagan concerning the above captioned potential claim for
damages regarding a sewer back-up.
Please be advised we have created a claim file and will be
investigating this matter. Should you receive additional
correspondence from Richard Jangula concerning this please
forward it to my attention.
My review of your memo indicated that the "back pitch" on
that portion of the service line affecting their residence
was installed under City Contract 85-11. At this time we
would request that you provide our office with documents
concerning this contract. Please advise whether or not
independent contractors were involved in installing this
line and if so whether or not certificates of insurance
were required by those contractors. Our review of these
documents will allow us to determine whether or not there
is third party involvement in this matter.

SUBJECT: POTENTIAL CLAIM FOR DAMAGES

SEWER BACK-UP & REPAIR
On Monday, October 5, the Public Works Utility Maintenance Division was contacted by
representatives of Schultie's Plumbing who was attempting a sanitary sewer service repair
at 3676 Ridgewood Drive. The plumber had been retained by the homeowner to dig up
the sanitary sewer service in an attempt to correct an unknown problem that had
apparently caused four sewer back-ups within the last four years to the property.
Upon excavating the extent of the private sewer service installation and not finding any
problems, they then contacted the City due to an observation of a "back pitch" on that
portion of the service line installed under City Contract 85-11. The elevation of this sewer
service line was checked by the Engineering Division's survey personnel and found, in
fact, to have a back pitch which created a low spot in the service line restricting full gravity
flow from the house to the main in the street.
Due to inadequate equipment employed by the private plumber, he was relieved of any
further work with City personnel securing the site for the remainder of the day. On
Tuesday, October 6, a private contractor hired by the City assisted City Maintenance
personnel in excavating the service line into the street to a point where reconstruction of
the sewer service would provide full positive gravity flow to the main. Approximately 15'-
20' of City installed 4" PVC sewer service pipe had to be removed and replaced. Visual
observation indicated that this pipe was deflected resulting in a dip in the service line.
City crews will proceed with the street, curbing and driveway restoration and a private
landscaper will be contracted to perform the yard restoration.
It is anticipated that the homeowner will seek reimbursement from the City for the cost
of the private plumber's work. At this time, it is unknown as to whether any damages
resulted from previous sewer back-ups that may be included. The following is the
information relating to this homeowner:
