Your letter of March 14 to Mayor Maguire has been forwarded to me and I've been asked
to look into the situation and get back to you. Let. me begin by apologizing for our part in
the situation and to thank you for bringing it to our attention,
I am concerned by the issues you brought up, because we stress the importance of our staff
people asking clarifying questions to determine whether there are aspects of a customer
question or request that we may not know. I also know that we have made efforts to have
links to fact sheets available on the website to help homeowners and contractors
understand the basic and key aspects of home improvement projects and that I had seen
egress window information in one of the fact sheets.
As I looked into the matter further and discussed it with Dale and Craig, we realized that
the information regarding egress window opening dimensions is included in the fact sheet
about lower level finishes, but that we did not have a fact sheet or link for window
replacements themselves, as you noted. We have prepared a separate fact sheet for that
purpose and it will be posted on the City website as quickly as the webmaster can do so.
Dale and I will also be using this situation to underscore our expectations that clarifying
questions be asked and fact sheets be used, especially to help homeowners and others
doing one-time projects find the information they need.
I realize that this is after the fact and does not resolve the fact that you will need to incur
additional costs to bring the windows into compliance with the building code. While Dale
is correct that we cannot authorize a situation to remain out of compliance until the
property is sold, he also shared that work can be spaced out as long as some work is done
under the permit within the preceding six months. If that helps, I would ask you to visit
with him more about how the work could be phased or completed over time.
You 'also ask whether the City would reimburse you for the cost to replace the windows.
The City cannot do that directly, but we are obligated to turn over claims for financial
compensation to our insurance company to be investigated and adjusted. If you would like
us to treat this as a claim for that purpose, please let me know and I will forward it to the
company to begin that process.

Dear Mayor Maguire,
Why does the City of Eagan have a Department of Building Inspections? As a city of
Eagan resident who is a homeowner and also likes to do home projects himself, I find
that other than issuing building permits the department falls short of providing any useful
information to city residents. The department cannot and does not communicate well on
what the city building codes are to residents. I am frustrated with the department because
their inability to communicate the egress window requirements to me is going to cost me
an additional $3000 dollars to replace bedroom windows this year.
Eighteen months ago I realized that the windows in my house were a major reason why
my energy costs were so high. I started doing my homework on what I wanted and
needed to do to replace the existing windows. The research also included researching
what I needed to do to meet city code — nothing could be found online. I could find
information on neighboring suburbs websites but not on Eagan's website. On November
25, 2008 I had to pay an assessment to the City of Eagan for resurfacing Riverton Avenue
which goes past my house. I stopped and talked to a young gentleman who said he was an
inspector in the Building Inspection department. I told him I was going to replace
windows in my house. He told me I needed to have a permit and all bedrooms needed
smoke detectors and if alterations of windows were made they needed to be inspected.
On April 16, 2009 and June 5, 2009 I made two phones calls to the Department to
corroborate what I had been told previously. Each time I was transferred to an inspector
and each time I was told I needed a permit, a smoke detector in each bedroom, and if
changing the size of my windows they needed to be inspected before installation of the
windows. I then proceeded to order the windows. Nothing was made of needing egress
windows in bedrooms and at no time during my contacting the Inspections department
was the requirement brought to my attention. It was not until the final inspection by
Inspector Craig that that fact was bought to my attention.
Right now I looking at spending an additional $3000 this year (that is if I can get the
financing) on top of the $4500 dollars that I spent last year to comply with the egress
requirement. On January 12, 2010 I received a letter notifying me of my obligation to
meet all safety requirements of the Minnesota State Building Code. Another issue I have
with this whole debacle is a comment made in the inspector's remarks. He states, "that
the homeowner neglected to ask the right questions". (See attached sheet) I totally
disagree, when I make a conscious effort to contact the Building Inspections department
three times and arrive in person to pay my $90 for a building permit and the inspection
record states "improvements to the home require smoke detectors in all bedrooms and if
altering window openings — call for inspection. Nothing was said by anyone in the
Building Inspections department about needing egress windows in the bedrooms. When I
make the effort to purchase a permit, I am making the effort to comply with all Federal,
State, and local statutes and I should be supplied with all the necessary information by the
regulatory agency issuing the permit. If I did ask the wrong questions, which I dispute,
then it is the responsibility of the regulatory agency issuing the permit to correct me.
This seems to be where the Building Inspection department failed. .
When I moved to Eagan four years ago I realized that the house I purchased would need
some upgrading. I had no problem with that because the previous two homes I owned in
Rochester MN were in the same shape and I made improvements to them. My goal has
always been to follow the statutes as they are written and I always consulted the people
who knew. For over sixteen years I consulted the City of Rochester's Building Safety
Department and the people in that department were always able to answer my questions.
They even had a Do -It -Yourself Guideline for Homeowners (this information is now
online) which they handed out as a reference and their inspectors were always willing and
able to answer any questions I had. I expected the same type of service and information
when I inquired at the Municipal Center in Eagan. I was wrong.
In business when I make a mistake and it costs customer's money, I make every effort to
make the situation right. I do not suppose that the city of Eagan will reimburse me (your
customer) the $3000 cost of replacing the non-compliant windows. I did talk to the chief
inspector, Dale Schoepner about giving me an opportunity to replace the windows when I
sell the house but I was told I need to replace the windows now.
I have a few suggestions regarding making information about building codes more
accessible to city residents. A number of neighboring suburbs have wonderful websites
with access to building codes requirements, why can not Eagan do this? Along with that
information, handouts could be printed and given to city residents to answer questions,
and this could be taken right from the website. Building Inspection staff could do a better
job of communicating. And finally on the Inspection Record a short line could be added
regarding windows — all bedrooms shall have egress windows.
In short the City of Eagan's Building Inspections department did not provide me with the
necessary information to be compliant with Minnesota State Building Code. When I
purchase a building permit from the City of Eagan every effort shall be made by
municipal employees to help me be compliant. Will the City of Eagan pay me the $3000
dollars to replace non-compliant bedroom windows or give me an opportunity to replace
the windows when I sell the house? Probably not! The only satisfaction I am getting is
sharing my story with you.

Thank you for the prompt review and response on this item. White one solution could be requiring plan
reviews for window replacements, you also shared that this is the first time this particular problem
(change of window type resulting in a compliant opening becoming noncompliant) has come to your
attention in your time with the City and I believe that the better solution would be to provide the notice
on the permit and the related information sheet. It does not seem necessary to add as substantial an
additional step as plan review for all window permits when the misunderstanding is this rare and Mr.
Jelinski indicates that he would have found the information on the website, if it had been available.
That said, I agree that this set of facts is a good case study to review with the staff to reinforce the
importance of asking extra questions to clarify whether there are unusual aspects of a project that
require additionat information.

1 would be happy to contact Mr. Jelinski on the Mayor's behalf or draft a letter for his signature if he'd
like us to.
Given the number of fact sheets the City has in our literature rack and on-line, I'm sorry that we have
not had a window replacement fact sheet to date. As Dale notes, the egress window requirement
already is in our Lower Level Finish handout, but since Mr. Jelinski was only replacing windows and not
finishing other space, he wouldn't have found that. Now that the issue has come up, Sarah and Dale are
collaborating on preparing one that could be printed and posted as soon as the webmaster can put it up.
As Dale noteswe cannot close the permit in a non-compliant status, but it can remain open as long as
some work 15 done and reported to us, 50 there is some fiexibility,but not as much as Mr. Jelinski has
asked for.
Relative to his request for reimbursement, it is my understanding that this would need to be a claim to
our insurance company that they would investigate and adjust. Given the facts1 don't believe that it
would be a compensable claim, but he could submit it for consideration.
I apologize for our part in the misunderstanding and we will make the changes and do the follow ups
with staff to prevent it from happening in the future.
Please review Dale's response and this overview of the steps we are taking to improve the information
we have available and make it easier to find. Let us know what steps you would like us to take from
there.

I do recall talking to Mr. Jalinski about the egress window issue. When we discussed the current
situation I indicated that we couldn't wave a code requirement but that we could keep his permit open
as long as he didn't abandon it for longer than 6 months. Essentially a permit is good indefinitely as long
as they make progress on the project.
As Craig indicates in his correction notes the original slider windows were replaced with center mulled
double -hung windows. It's not very typical for a window replacement project that also changes a style
change. While Craig was at the site Mr. Jalinski told Craig, "I guess I didn't ask the right question". That
is why Craig made the comment that he did.
We do have a lot of handouts both in paper form and on our web site and there's always room for
improvement. Our egress window requirements are in the lower level finish handout and in retrospect
we could have given Mr. Jalinski a lower level finish handout so he could see the egress window details.
We can put together a separate handout for just window replacements. Another item that we could do
is put a note referencing egress windows in the permit copy that goes to the permit holder.
Another item that we could do is ask for plans of the new windows from the contractors. A challenge
with this is we have been issuing hundreds of replacement window permits per year through our e
permit process and if we begin asking for plans we would not be able to use the e permit process.
I have seen our group taking extra steps by asking homeowners questions that can avert situations like
this. I will go over this project with them to illustrate the importance of asking the extra questions.

I've spoken with Dale and he remembers his conversation with Mr. Jelinski, but will look into things
further for the rest of the story to get back to me so I can share with you. We'll need to decide whether
it would be best to call him, write, do both and/or draft background and a letter for the Mayor.
I know that we have a lot of information on the web and we'll figure out if there are things to add. We
always encourage people to ask the extra question rather than just sticking to the basics, but we need to
find out more.

On September 12, 1986 a letter was mailed to Kozy Energy Homes informing them
of the Council action of September 2, 1986 placing a stop order on all future
building permits requested by them.
At that time, a letter was also sent to Mr. & Mrs. Neil C. Hvidhyld requesting
their assistance in initiating a meeting between themselves, their neighbors
owning Kozy Energy construeted dwellings and Kozy Energy Homes at Eagan City
offices.
We received a reply from the attorney for Kozy Energy Homea who was informed
that the information he requested could be obtained by reading the Couneil
minutes of September 2 in the Eagan City offices. As of this date, all
efforts to contact the Hvidhyld's have failed. They have not responded to the
letter, phone messages, or the notice left on their door.

I have received a request to initiate a meeting between you, your neighbors
who have purchased dwellings from Kozy Energy Homes, Inc., City staff, Mr.
Zirul of Kozy Energy Homes, and possibly one or two Couneilmembers.
The meeting will be held at City Hall as close to 4:00 P.M. as possible on a
mutually agreed date during the last week o£ September or the first week of
October. The purpose of the meeting would be to determine homeowner and City
responsibilities in the construction of your dwellings. I would like you to
assist in organizing a date and time for the informal meeting. It also would
be a valuable aid to have a list of the problems for City evaluation prior to
the meeting. However, please bear in mind that building codes primarily
address life safety items, not workmanship or purchase agreement
specifications. I can resolve code violations, but nothing more.
I look forward to working with you to coordinate the proposed meeting. Feel
free to contact me anytime after September 22nd as I will be out of town the
week of September 15.
