Thank you for allowing me to meet with you at your home yesterday.
As we discussed, the fill material encroaching on Blackhawk Park, behind your
home, will need to be taken care of. Your contractor should be instructed to:
•Remove the debris (sticks, roeks, ete.) from the fill.
•To level the fill to fit the existing grades in the park.
*To apply a minimum of 6 inches of quality topsoil material
over the graded fill, and
*to seed and mulch the area to establish suitable turf grass.
This actlon should be taken at the earliest possible date. The optimum time
for spring seeding is right now.
, Please let me know of your plans to address these concerns, as soon as
possible. -

Dear Mr. VonDeLinde:
In reply to your letter of May 27, 1986, I would like to point
out to you that the Certificate of Survey for Lot 1, Block 3,
Blackhawk Oaks Additon, Dated Sept. 10, 1985, prepared by Greg
' Brick of Probe Engineering Co. was submitted tp the City of Eagan
when applying for building permits last year.
One would assume that if a building permit was issued by the City
of Eagan with no restrictions, or changes required, that the home
could be built accordingly.
Your mention of permission must be received from the Park Dept.
to construct a driveway over the trail service does not seem
reasonable as every home on the North side of Riverton Ave. has
built a driveway over the trail, and I am sure not one builder
has contacted your dept. for permission.
If the driveway is rebuilt to the specifications you have stated
in your letter, Mr. Roy Harvey will have a grade from the street
to his garage which will be impossable for his car to get up to
his garage in the winter. Last winter Mr. Harvey expressed that
their cars had difficulty with the existing slope. Also as you
probably know from talking with Mr. Harvey that he would like to
lessen the slope in his front yard by building a 12"-18" high
wall at the bottom of his front yard along the trail.
I do not agree with your conclusion that we are at fault with the
City of Eagan in the matter of the trail and Mr. Harvey's
driveway, but I would like to offer a solution to the matter. We
would raise the trail to Mr. Harvey's driveway and have a longer
taper so as there would be no noticable differance when using the
trail at our expense when we do some other patching in the next
two weeks.
Thequestion of grading & seeding the park property adjoining the
back yard of Mr. Iiarvey's will be taken care of this week.

On Mareh 26, 1986 Building Inspector, William Bruestle, and I performed a
' reinspeetion by request of the referenced dwelling. We were asked to
~ determine the reason for the excessive amount of moisture that was staining
the ceiling in the livingroom area. There is no way for the department to
determine the cause of the water problem, but Kozy Energy Homes is obligated
to correct the problem according to State of Minnesota Statute, Chapter 327a
Housing; Statutory Warranties. The building is to be warranted for one year
; against all defeets caused by faulty worlomanship or defeetive materials due to
~ non-complianee with building standards.

~ Keep me informed on the steps you take to correct the moisture problem. You
possibly should consider extra ventilation in the 2' x 12' combination rafter
and ceiling 3oist area or an additional vapor barrier type of sealer on the

Builder will regrade areas around the home to fill in areas
of settling by £oundation. No diqying up of foundation is
necessaxy, as Kremer & Davis Inc. a professional waterprofing
contractor mastic and polyed the foundation twice at contractor
request. Al1so entire foundation is drain tiled and tiled to open
space behi.nd the home which is has an walkout basement. Subject
home sits on a hill with ].ot sloping away in three directions.
During the digging in of the water and sewer to the street it was
discovered that the sewer stub was two feet to high to service
subject home. A grinder pump was installed and the area where the
pipe went throuqh the was was not cemented before backfilling.
This area did leak water., and bui.lder did in fact redig this area
oi the foundation up and mac]e the necessary repairs last spring.

homeowner. At the writting of this letter Jim Mason is in Canada
hunting for a week. But at an earler meeting at his office he
stated to me that he would come out and re-do the facia.

CONSTRUCTION STANDARD: (page 6, 1.2) The necessary grades and
swales should be established to insure proper drainage away from
the house. Site drainage is limited to the immediate grades and
swales affecting the structure. No standing or ponding of water

except swales which may drain longer than other areas after a
rain.

homebuyer within the life of the home. T3uilder is not responsible
for color variations or discontinued color grout.

in plaster And gypsum wallboard installation. However, obvious
defects of poor workmanship resulting in blisters in tape or

On March 26, 1986 Building Inspector, W1111am Bruestle, and I performed a
reinspection by request of the referenced dwelling. We were asked to
determine the reason for the excessive amount of moisture that was staining
the ceiling in the livingroom ar•ea. There is no way for the department to
determine the cause of the water problem, but Kozy Energy,Homes is obligated
to correct the problem according to State of Minnesota Statute, Chapter 327a
Housing; Statutory Warranties. The building is to be,warranted For one year
against all defects caused by faulty worlananship or defective materials due to
non-compliance with building standards.
Keep me informed on the steps you take to correct the moisture problem. You
possibly should consider extra vent:ilation in the 2' x 12' combination rafter
and ceiling joist area or an addLtLonal vapor barrier type of sealer on the
habitable space side of the finished ceiling.

tile on hearth, garage door was suppose to be open as we

out the end cut closest to the driveway and put a cap
of 2 inches of 5000 pound concrete over the exixting
sidewalk even thouErh it is not rny fault as the concrete
wdlk had been salted to remove ice.

I sold your clients a.1c>t in the above named subdivision.
Your clients' lot is ailjr:icent to a.bituminous path which
runs along the front si_i;ie of their lot and which directs
pedestrian and bike traf.[:i.c into Blackhawk Park. This path-
way has bcen dedicated to the City of Lagan and my obliya-
tion w.ith regarc3 to the maintenance of the pathway termi-
nated on June 24, 1986 when my letter of credit was released
in full by the City.
On June 20th Jerry Jor.genson of South Suburban 1lsphalt re-
shaped and extended the r;ump of the bike path up to the
grade of the ffarveys' dri.veway. In addition the ramp
was tack coated. This wcis Clone at the ins.istence of the
Parks DepartmenL- at the i.;ity and also because of numerous
complaints of your clierit_; to Mr. Ken 'Liru2, the builder.
Around July lst I was not.ified by Mr. Zirul that the newly
constructed ramp had bcen ripped apart; Within several
days thereafter I reviewerl the damage and could clearly
see that it was done by :;ome type of implement or tool. I
called the Harveys immediately thereafter and talked to
them and asked them what had happened. Their reply was
that they had been shoveling sand ofE of the ramp due to
the heavy ralns and that the r.amp began to "break up."

The Harvey Residence

Introduction
The Harvey Residence has experienced accelerated
deterioration from the time of its construction. At the
request of the Harveys, Encompass Inc. performed a limited
investigation of the house. Numerous and various elements
were found to be improperly designed and constructed, and
were performing unsatisfactorily. This report is
preliminary and not a full list of all defects.
Observations and Analvsis
Slabs on Grade:
The basement has several large cracks (1/4 in. wide) which
extend across the floor slab. These cracks occur in the
area immediately below the stair and the area near the
fireplace support. At several locations along the line of
the crack, one edge of the crack has risen vertically in
relation to the other edge. No slab contraction ,ioints were
observed within the entire basement. The cracks were of an
unusual extent and width and are obJectionable because of
their appearance, misalignment, and reported entry of water.
The slab on grade located in the garage was observed to have
experienced settlement of approximately 0.5 in. at the area
of the steps into the main house.
The front walk of the house has settled away from the steps.
The vertical movement is over 2 in. and appears to be
continuing. The ends of the steps have cracked due to the
loss of support as the ground has settled.

The basement slab, garage slab, and front walk have
experienced unusual amounts of settlement as an apparent
result of insufficient compaction of the earth during the
construction process. It is likely that the present amount
of settlement is not the ultimate settlement.
Foundation Walls:
The foundation walls at the north, west, south and southern
portion of the east wall are constructed of concrete block.
The northern and center portion of the east wall is
constructed of treated wood. The interior surfaces of the
walls are unfinished, with exposed fiherglass batt
insulation, covered with plastic sheets.
Due to the batt insulation over the interior faces of the
block walls throughout the basement, observations of
distress were limited to the north and central portions of
the west foundation wall.
This block wall was observed to have numerous vertical and
horizontal cracks extending the height and length of the
wall. The cracks ranged in width from hairline to almost
1/S in. wide.
Horizontal cracks in the mortar joints of the wall
correspond to flexural failure of the wall due to improper
backfill, inadequate reinforcement, and/or lack of bond
between mortar and blocks.
In the portion of the wall immediately below the west entry
to the house, the vertical mortar 3oints of the block wall
were almost in perfect vertical alignment from the bottom of
the wall to the top of the wall. This created a naturally
weak plane and, as a result, vertical cracks extend the
height of the wall at this location.
The cracks observed in the block walls were of unusual
extent and are obJectionable from strength, leakage, and
appearance considerations.
The wood stud portion of the basement wall is constructed
with wood paneling over fiberboard sheathing at the exterior
of the wall. The spaces between the wood studs are filled
with batt insulation. The 3nsulation was removed from the
lower portion of the wall at the south of the walkout door.
The sheathing at the exterior of the wall was discolored and
damp. The material had softened due to the moisture and
could be pulled apart with finger pressure. This
deterioration of the sheathing due to moisture will

continue, allowing the entry of water, drafts and vermin.
A stud of the wood foundation wall was observed to be bowed
inward. This stud had a split at the inside face as would
result from a combination of lateral earth thrust and
compressive load. It is not known whether the stud had heen
placed in that condition or whether it has moved since the
house was constructed. The siding at the exterior face of
the wall was bowed inward, corresponding to the bowed
condition of the stud.
First Floor Framing:
Typical framing for the first floor consists of 2x12 joists
at 16 inches on center. Three different grades of wood were
observed to have been used within the floor framing: Grades
1, 2 and 3. The structural suitability of the joists is
determined by the grade of wood used in the joist and the
span of the joist. If the floor 3oists are Grade 2 or
better, they are suited for use at all standard load span
locations within the Harvey Residence. If the floor joists
are Grade 3 or worse, they are not suited to the 18 ft.
spans beneath the octagonal portion of the house. On
examination, at least one joist with a Grade 3 stamp was
observed beneath the octagonal portion of the house. This
joist was split through its thickness in several locations.
Other joists beneath this portion were observed to have
similar large splits. Numerous joists throughout the
framing had been placed so that large knotholes occurred at
the bottom of, the Joist.
The main wood beam spanning from the north end of the
fireplace support to the wall beneath the stalrwell consist
of (2) 2x12 microlara wood joists. The microlam beams were
constructed so that the top of the beam is 0.5 in. out of
vertical alignment with the bottom of the beam.
The main framing beam made of (2) 2x12 immediately below the
passage between the kitchen and utility room was observed to
have a large hole cut through it to allow the passage of a
heating duct. The rectangular hole with vertical overruns
in the cuts through the 3oist left less than 2 in. of
material at the top and the bottom of the beam. It was
determined that this beam supports the first floor framing
and, by the means of a secondary beam, supports a large
portion of the weight of the roof in that area. Not only
was the main framing beam weakened Dy an oversized hole, it
was also subjected to greater than anticipated loadings by
the roof structure. Further, a specified post was omitted
from this area. The inadequacy of this main support beam is
indicated by the distinct dip in the floor at this area.

The secondary framing beam in this area consists of an
originally placed 2x12 3oist with a second 2x12 nailed to
its side. The reason for this unusual arrangement was to
carry the vertical load from the laminated wood roof beam.
The plans showed the laminated wood beam to be supported by
the short wall between the two mudroom closets at the first
floor, which in turn rested on an extension of the
foundation wall. Due to lack of accurate dimensions or
other problem, the laminated beam was constructed so as to
bear upon the end wall of the mudroom closet at the kitchen.
This resulted in the vertical load of the laminated wood
beam not being supported by the foundation wall, but by the
2x12s located approximately beneath the c3oset/kitchen wall.
An analysis of the (2) 2x12s indicates that they are
structurally inadequate for the loadings that develop 3n
this area. Adding to the unsuitability of the framing in
this area are the lack of effective end supports to develop
the strength of the second 2x12.
Diagonal bridging has been omitted from numerous joist
spaces. The maximum spacing of bridging in the octagonal
portion of the house should be at 8 ft. centers, resulting
in two lines of bridging for the spans at the octagonal
section. instead of the two lines required, the contractor
provided only one line of bridging. The contractor a2so
omitted bridging or blocking between ends of 3oists at major
bearing walls at the center of the house.
Numerous areas of floor have the nails popping out from the
floor joists. This has created noticeable bulges in the
vinyl floor covering. In several instances, the vinyl floor _
covering has worn through at the nail locations. The
separation or lack of attachment between the floor sheathing
and the joists results in loss of the floor systems ability
to act as a diaphragm to resist the lateral loads imposed by
backfill or wind, further jeopardizing the structural
capacity of the house.
Stud Walls:
The northeast and south walls of the octagonal portion of
the house are out of plumb with the remainder of the house.
At the northeast wall, vertical corner cracks were observed
at the interior of the house. At the south wall, the wall
was observed to be 1.5 in. out of plumb in 8 ft.. No cracks
were observed at this location. Viewed from the exterior,
these corners appeared to have moved outward, as judged from
the curved line of the trim.
The exterior finish siding is very poorly attached to the
house with many of the nails having worked free. The sid3ng

has expanded vertically relative to the framing which may
have shortened. At the areas of facade high enough to
require the use of two sheets of siding, the expansion of
the upper and lower panels have jammed the panels together.
At several locations the upper panel has buckled out of the
plane of the wall.
The sidinS cvts at the perimeter of many openings are poorly
executed, with gaps and misalignments. It is possible to
see daylight through the gaps in the siding at the garage.
The battens placed to seal the siding joints at the house
corners in many instances have separated. The caulking at
the batten/siding joints is missing or incomplete in many
locations.
The nails used to attach the siding to the exterior of the
house were corroded.
Numerous nail and screw heads were observed to be popping
out of the gypsum board finishes at the interior of the
house.
Vertical cracks were observed at several of the corners of
the octagonal portion of the house.
Interior wall surfaces were not straight and true.
Naticeable curves were observed at different sections of the
interior walls.
Roof:
when viewed from the interior of the house, there are gaps
between the exposed laminated roof beams of the octagonal
roof framing and the gypsum board ceiling and wall
finishes.
The support conditions of the laminated wood beams are
questionable due ta excessive vibrations observed when the
beams were lightly struck.
The design and construction of the roof framing at the
octagonal area does not allow the free flow of air required
to prevent condensation of moisture with3n the roof framing
and insulation. This has lead to water problems in the
winter.
The intersection of the octagonal and rectangular roofs is
framed in a haphazard, unconsidered method. Excessively
long roof rafter spans are propped with miscellaneous pieces
of lumber. There are gaps between the rafters and ridge
beam resulting in uncertain connection conditions. The

poorly planned and constructed nature of this area of roof
has resulted in an extra hip and valley at the west
elevation of the house over the main entrance.
At one observed location, a 2x12 rafter that framed between
the laminated wood beams of the octagonal roof was attached
with only one nail of undetermined size.
Nailing of the sheathing to the rafters of the octagonal
roof was haphazard and irregularly spaced.
Humps were visible in the slopes of the octagonal roof from
the exterior of the house. This was the apparent result of
the method of framing the octagonal roof where the 2x12
rafters ran perpendicular to the direction of the slope
where the placement of one end of the rafter higher than the
other would result in visible humps in the roofing.~. In
addition, some of the rafter tops had not been trimmed to
match the pitch of the roof.
The fascia edge of the roof was crooked with many
misalignments. At several locations the facia was observed
to be loose and moving in the wind.
Rafter and roof truss extensions to provide support for the
overhang were irregularly 2ocated with the result that for
the space of several trusses and rafters, the roof overhang
was not supported.
Miscellaneous:
The fireplace hearth was placed directly on the flakeboard
floor sheathing, presenting a fire hazard, especially at
exposed portions of the sheathing.
The frame of the exterior door to the mudroom was loose from
the wall framing.
Several closet doors could not be closed due to wall
misalignments.
Cracks were observed around the fiberglass shower enclosure
at the master bathroom.
The spindles of the rail at the stair to the basement were
loose. The top of the rail moved excessively.
Ceiling finishes were observed to be uneven and moisture
stained.

Differences Setween Plans and Construction:
Masonry foundation at a majority of the perimeter of the
basement 3nstead of the treated wood foundation shown on the
plans.
2x12 wood joists were provided instead of the 16 in. floor
trusses shown on the plans.
An area of wood s3ding shown on the north side (Left
Elevation) of the house was omitted, with concrete block
remaining exposed after construction. The block wa12 has
yellowish marks from the splashing during siding stain
application.
Instead of the cedar fascia and soffit shown on the
drawings, prefabricated sheet metal items were substituted.
No exterior waterproofing or membrane was shown on the
or4ginal drawings.
No raised hearth was provided for the fireplace as indicated
on the plans.
Utility entry points into the house are poorly executed with
large gaps between service pipes and surrounding walls.
Conclusion
The Harvey Residence has significant distress in its slabs _
on grade, foundation walls, floor framing, wall framing and
roof framing. The amount and extent of distress is unusual
and reflect inadequate planning and construction. Certain
conditions such as the cracks in foundation walls, and the
poorly executed floor and roof framing represent serious
structural problems. It is recommended that extensive
repair or reconstruction be initiated in the near future.
Proaosed Reconstruction Activities
There are two approaches to the problems encounter at the
Harvey Residence. One is a piecemeal, item by item repair
program. This repair program would involve the following
steps:
1. Excavate the perimeter of the house exposing the
foundation walls.
2. Reinforce or replace existing cracked block foundation

walls. Replace deteriorating wood foundation walls
with properly constructed concrete block walls.
3. Install drain tile with gravel surround at the
perimeter of the foundation.
4. Waterproof the exterior of foundation walls.
5. Backfill with an approved, inspected backfill material.
6. Remove salvageable items such as cabinets from the
interior of the house and store.
7. Remove roof, floor coverings, floor sheathing, interior
and exterior wall finishes.
8. Remove cracked and settled areas of basement, garage
and walk slabs. Remove steps at front entrance.
9. Reconstruct floors, walls and roof using acceptable
framing methods and materials. Glue and nail plywood
sheathing to floor joists. Provide a continuous
tension tie around the perimeter of the octagonal roof.
Allow for venting of the octagonal roof.
10. Reconstruct concrete slabs and walks.
11. Install new interior and exterior wall finishes.
Install new interior floor and ceiling finishes.
12. Reinstall stored salvageable items.
it can readily be seen that the repair program described
above is probably as extensive and possibly more expensive
than building an entirely new house. Further, given the
extent of problems observed in this preliminary inspection,
it is likely that additional defects in planning and
construction will be encountered during the repair process,
necessitating even more repairs and expense.
However, in order to restore the home to its proper
structural capacity and value we recoramend as a minimum that
the existing structure be dismantled, salvaging appropriate
items, and reconstructed properly in its entirety.
An alternative solution is to totally demolish the existing
structure and construct the home in a proper manner. In our
experience this solution is frequently more ecanomical and
will result in a house of a known quality and value.

This report contains observations made during an on-site
investigation of the Harvey Residence and subsequent analysis of
the problems observed. Due to the preliminary and limited nature
of the investigation, additional distress to that descr3bed above
may be encountered in the future.
