This letter is to inform you that the Community Development Department has received several complaints about an unsafe situation regarding your outdoor pool and the proximity of your deck to the pool. Chapter 4, Section 4.70 of the Eagan City Code was amended and adopted on November 15, 1988. This amendment requires that all existing outdoor swimming pools, and those constructed hereafter, shall be completely enclosed by a security fence or wall of at least four feet but not more than six feet in height and at least four feet from the edge of the pool. This Ordinance does not apply to above-ground swimming pools having at least four-foot-high vertical or outward inclined side walls, provided that the pool has a self-closinq and self-latching lockable qate, or sole access is by means of a removable ladder, ramp, or stairs which must be removed when the pool is not in use. The location of your pool and deck present safety concerns that need correcting. Reinspection of your property will be made within two weeks from the date of this correspondence to confirm that proper safety measures have been taken. One possibility is that you make improvements to your deck so as not to allow unsupervised access to the pool, or you may choose to move the pool at least four feet away from the deck. Within seven days of receipt of this letter, we will expect a reply from you indicating your intentions and a schedule of compliance. Should the code violation still exist upon reinspection of your property (during the week of June 12), we will be forced to turn the matter over to the City,police department. During this conversation, Mrs. Crouch and I spoke about the pool violation and the history involved with this problem. Mrs. Crouch said she would have her husband call me to discuss solutions. It has now been over a week and I have not heard from either of you. As you may, or may not recall, I measured the height of the pool in the presence of Mrs. Crouch last summer. Because the pool was not at least 4' in height, it was in violation of City Code. Solutions for this violation were souqht by you for the majority of the summer, until finally in early-September you told me that the pool would be taken down and next year (1990), you would have a different pool, or no pool. Because this pool is still present, there are two options available to you: 1. Install a security fence around the pool at least 41, but not more than 61, in height. 2. Remove the pool from the premises. I will reinspect this property May 15, 1990.
