We searched the area for the suspect and were not able to locate him. We then met with the r/p, Rajan Thomas, at his residence, in the backyard. According to the r/p, he and a contractor had a meeting time scheduled for approximately 1730 hours at the r/p's residence to discuss some payment for services that the suspect had done. The contractor, Edwin Meister, is the owner of Meister Construction, out of Delano, MN. Meister reportedly has not returned the key that the r/p said he gave to him to enter the residence to do some of the work that was needed to be completed. Because of this, the r/p stated he was not going to be paying Meister for the services that he provided. In addition, the r/p stated that city inspectors had not checked off on several of the jobs that were to be done around the house, therefore, making the project unfinished. While speaking with the r/p, Edwin Meister, called the r/p's home to speak with him. The r/p informed him that police were at the house and then turned the telephone over to me. I spoke with Meister. He told me that he never had a key given to him by the r/p. He said in order for them to get inside the house to do some work, they had to either come in through a side door and use a key that was under the mat, or that someone was home to let them in. He said he was never given a key and that they always had other means to enter the premises. Both the r/p and Meister told me that Meister had consent to enter the premises. When I asked Meister if he had done any damage to the house or to the premises that day, he said that he didn't. He said he had only taken a hammer and nailed in a couple of nails that were sticking out on a bench off the back porch. The r/p had reported that during the meeting, the two parties got into an argument over 2 EAGAN POLICE DEPARTMENT CASE NUMBER : 01002561 payment of fees. At this point, the r/p said the suspect left, went outside and got a hammer and started to pound on the bench on the r/p's deck. Reportedly, the suspect also attempted to pull the bench off of the deck and tear it apart. Meister denied doing any of this. He stated he merely pounded in the nail and was not trying to destroy the property. The r/p stated that he was afraid of what he might do next. He said Meister appeared to be extremely angry and enraged. After checking the bench, the deck, and the perimeter of the house, Officer Heath and I could not find anything wrong with the property. It was determined that no damage was done. No threats were made and no assault occurred at this residence. At this point, this is a civil matter to be cleared up between the two parties. I informed both parties that this report may be forwarded to the City Engineer's Office, should further developments occur in the dispute. 3 . Following is a summary of questions and answers to the concerns you have posed regarding construction of your new home: The house on Lot 8, Block 2 (next door) was constructed two feet higher than the City's approved grading plan, thus affecting drainage. The City reviewed this with Schoell and Madson Inc., engineering firm for Maplewood Development, developer of Blackhawk Forest. It was found that the home on Lot 8, Block 2, had been constructed somewhat higher than shown on the City's grading plan; however, drainage could still work between the two homes. Construction of the garage was decreased by two feet from the size indicated on the blueprint (28' instead of 30'). At the time of the footing inspection, our inspector found that the garage extended into an easement. The contractor agreed to shorten the garage to 28' to eliminate this problem. Flooding in the basement caused by soil around the basementwalls not being compacted properly. On residential construction it is common to lightly compact soil during backffll so as not to damage the foundation. Depending on location and the type of soil, a basement may remain wet for up to a year until positive drainage away from the home and yard has been established. This is not a problem; the jacket on the electrical wire allows this. • A sump pump was installed without backflow preventing valve and without proper electrical connections. This was only a temporary pump installed by the contractor during construction. On October 16, Bill Bruestle met with Terry Mahoney, agent for Seasonal Builders, to discuss your concerns and gave Mr. Mahoney a copy of your letter. Mr. Mahoney assured Bill that these concerns had all been taken care of to your satisfaction. • The neighbor crossed his property line with landscaping equipment while landscaping. This is usually allowed during construction when the property they cross has not been final graded. The first floor ceiling height was 9' instead of 1 Was indicated on the plan. The Uniform Building Code enforced by the City inspectors designates 7'6" ceiling heights in dwelling spaces. That is what we are allowed to enforce. Any deviations from the code are the sole responsibility of the purchaser to see that the builder fulfills specific requirements that are spelled out on the building plans. On November 13, 1995 we were copied on a letter sent to Seasonal Builders by you indicating that in order to maintain your current interest rate, your mortgage needed to be locked in by November 17, 1995. You also stated that you had not heard from Craig Knudsen regarding new grading specifications. On November 14, 1995 1 received a two-page faxed summary report containing the minutes and agreements of a meeting held November 13, 1995 at the above address (attached). On November 15, 1995 you sent a letter to Peggy Reichert thanking her for reviewing your concerns and attached a "plan of action" so you could close on his home in just two days. On November 28, 1995 Craig Knudsen met with Ken Bergson, representative of Classic Home Design, to review the side yard drainage stakes on Lot 8. It was understood that one more timber would be placed below finished grade no later than November 29, 1995. Your June 16, 1996 letter to the Mayor expressed continuing concerns with drainage between your two homes. On July 2, 1996, Craig Knudsen performed an on-site inspection in response to these concerns and reported that the home does appear to have adequate grade from the foundation to the drainage swales. Bill Bruestle advised me that the retaining wall was constructed of railroad ties and did prevent water runoff from the neighboring lot which it is intended to do, but that it is in need of some backfill. I realize you would have preferred that the retaining wall be constructed of "block type" material, but the City does not require specific materials for retaining walls. Classic Home Designs constructed the retaining wall with railroad ties and even added an extra row below the existing retaining wall to provide for positive drainage. In regard to the sump pump continually running, this is not unusual until the ground has settled from construction. Normally if a yard has positive drainage away from the home after the yard has been established, basements do remain dry for the most part. You may want to consider installing rain gutters and down spouts to help keep water away from your foundation. You have the right to pursue through the State of Minnesota, Department of Commerce, Building Contractor License Division, any building concerns you may have with Seasonal Builders. Mr. Thomas, I hope this answers your concerns. I have not shown favoritism to either you or Seasonal Builders as you suggested in your letter and if you still have further concerns or I can be of help to you in any way, please do not hesitate to contact me directly. I have been finding several irregularities in the inspection of my home (lot 9) and of my neighbor's home (lot 8). My neighbor's home (lot 8) was allowed to be built at atleast 2' higher than the approved city plan. This will adversely affect the value, the landscaping, and the look of my home. I spoke with the city building inspector on August 23rd 1995 regarding this and he assured me that he will call me back after consulting with his supervisor but never heard from him. The same building inspector forced to reduce the size of the garage of my home (lot 9) to 28' from the approved city plan of 30'. Since then I have been closely watching the construction of my home and I believe that building inspectors do not insist on state/city building codes in the case of the home being built for me. Listed below are some of my concerns. ` The basement has been flooding since Friday, September 29th, 1995. I reported the problem to Mr.Terry Mahoney (builder's agent)immediately. When I spoke with Duane (Construction Superintend) on Monday, October 2, 1995, he indicated that water leaked into basement because the soil around the basement walls was not compacted properly. The excavator did some grading of the soil around the basement wall to alleviate the flooding problem temporarily on October 4, 1995. Duane explained that the soil need repacking again when it is dry during final grading. At the time of the footing inspection, our inspector found that the garage extended into an easement. The contractor agreed to shorten the garage to 28' to eliminate this problem. 10 Flooding in the basement caused by soil around the basement walls not being compacted properly. On residential construction it is common to lightly compact soil during backfill so as not to damage the foundation. Depending on location and the type of soil, a basement may remain wet for up to a year until positive drainage away from the home and yard has been established. • Electrical cables in the basement are laid on hot water supply lines and were concealed with sheetrock. This is not a problem; the jacket on the electrical wire allows this. • A sump pump was installed without backflow preventing valve and without proper electrical connections. This was only a tem o? ra[y pump installed by the contractor during construction. On October 16, Bill Bruestle met with Terry Mahoney, agent for Seasonal Builders, to discuss Mr Thomas' concerns and gave him a copy of the letter we received. Mr. Mahoney assured Bill that these concerns had all been taken care of to Mr. Thomas' satisfaction. • The neighbor crossed his property line with landscaping equipment while landscaping.. This is usually allowed during construction when the property they cross has not been final graded. The first floor ceiling height was 9' instead of Was indicated on the plan. The Uniform Building Code enforced by the City inspectors designates 8' ceilings heights in dwelling spaces. That is what we are allowed to enforce. Any deviations from the code are the sole responsibility of the purchaser to see that the builder fulfills specific requirements that are spelled out on the building plans. On November 13, 1995 we were copied on a letter sent to Seasonal Builders by Mr. Thomas indicating that in order to maintain his current interest rate, his mortgage needed to be locked in by November 17, 1995. He also stated that he had not heard from Craig Knudsen regarding new grading specifications. On November 14, 1995 1 received a two-page faxed summary report containing the minutes and agreements of a meeting held November 13, 1995 at the above address (attached). On November 15, 1995 Mr. Thomas sent a letter to Peggy Reichert thanking her for reviewing his concerns and attached a "plan of action" so he could close on his home in just two days. On November 28, 1995 Craig Knudsen met with Ken Bergson, representative of Classic Home Design, to review the side yard drainage stakes on Lot 8. It was understood that one more timber would be placed below finished grade no later than November 29, 1995. On June 16, 1996 Mr. Thomas sent a letter to the Mayor expressing continuing concerns with drainage between the two homes. On July 2, 1996, Craig Knudsen performed an on- site inspection in response to these concerns and reported that the home does appear to have adequate grade from the foundation to the drainage swales. In a memo to me dated July 9, 1996, Bill Bruestle advised that the retaining wall was constructed of railroad ties and did prevent water runoff from the neighboring lot which it is intended to do, but is in need of some backfill. Mr. Thomas wanted a retaining wall constructed of "block type" material. Classic Home Designs constructed the retaining wall with railroad ties and even added an extra row below the existing retaining wall to provide for positive drainage. The City does not require specific materials to be used in retaining walls. In regard to the sump pump continually running, Bill indicates that this is normal until the ground has settled from construction. Tom, I hope this provides the information needed to resolve Mr. Thomas' concerns. He has the right to pursue through the State of Minnesota, Department of Commerce, Building Contractor License Division, any building concerns he may have with Seasonal Builders. City staff has inquired into all of his concerns and have answered his questions. We have not shown favoritism to either the contractor or Mr. Thomas. Mr. Jillson also recommended constructing a swale on the south property line from a point approximately 5' east of the southwest corner of the garage and to the east and to direct the swale to the east along the property line and then to the pond area at the rear of the lot line. Mr. Craig Knudson did not concur because this will require removal of three trees. Instead, Mr. Knudson recommended to construct the South Property Line Swale in such a way that all drainage will be directed towards the street. Mr. Jillson, noted that the railroad timber retaining wall constructed by the owner of Lot 8 is not constructed properly, 1 it with a properly constructed keystone wall. Mr. Knudson agreed with this recommendation. Mr. Knudson agreed to contact Maplewood Development (the developer) and Schnell & Madson, Inc. (the survey engineer) for producing revised grading specification with required elevation points. Mr. Knudson will then contact the builder of lot 8 concerning removal of the retaining wall and the re-grading of lot 9 in order to eliminate the drainage to lot 9. The city will then issue permit to seasonal builders for proper grading of lot 9 in accordance with the revised specification. The legal description of the property is Lot 9, Block 2, Blackhauk Forest. Seasonal Builders made lot of errors in the construction of the house. The garage was built 2' shorter than the plan. They made the first floor height 9' instead of 10' as in the plan. The city inspector did not do a good job in the inspection process and missed these items. Seasonal Builders is trying to do the final grading of the yard. They cannot finish the grading in accordance with the city's grading plan because the city inspectors allowed my neighbor (Lot 8, Block 2, Blackhauk Forest) to build his house about 2 feet higher than the approved city plan. I contacted your building inspection office on August 23, 1995 and raised my concern. Your inspection department did not take any action. I formally filed a complaint with Bill Bruestle of your staff on October 9, 1995 but he did not want to take any corrective measures. We have had lot of water in the basement of my home two weeks ago. I hired an independent professional engineering company (Guy Engineering corporation) to evaluate the situation. They reports that the present grading of my neighbor (Lot 8, Block 2, Blackhauk Forest) adversely affect the drainage of my property. He recommends substantial grading work on my property and modification to Lot 8 grading. A copy of the report is attached for your reference. I have learnt from Seasonal Builders that your inspection staff does not want to concur with the recommendation of Guy Engineering Corporation because it affects the present grading of my neighbor's property (Lot 8). They did not concur with the original drainage plan by allowing the house on Lot 8 to be built 2' higher. I cannot close the deal with Seasonal Builder's until this situation is resolved. The same building inspector forced to reduce the size of the garage of my home (lot 9) to 28' from the approved city plan of 30'. Since then I have been closely watching the construction of my home and 1 believe that building inspectors do not insist on state/city building codes in the case of the home being built for me. Listed below are some of my concerns. The basement has been flooding since Friday, September 29th, 1995. I reported the problem to Mr.Terry Mahoney (builder's agent)immediately. When I spoke with Duane (Construction Superintend) on Monday, October 2, 1995, he indicated that water leaked into basement because the soil around the basement walls was not compacted properly. The excavator did some grading of the soil around the basement wall to alleviate the flooding problem temporarily on October 4, 1995. Duane explained that the soil need repacking again when it is dry during final grading.
