Recently, you had expressed concern regarding the water elevation
of the above referenced pond and its encroachment onto your
property during the past three weeks. Based on your concerns, I
have requested our Engineering and Maintenance Divisions to
investigate the outlet for this pond and downstream storm sewer
facilities to try and identify the reason for the increasing
water elevations.
With the significant amount of rainfall that the City experienced
during the month of July and first part of August, all of the
City's ponds, lakes and wetlands are at an elevation higher than
would normally be expected. Your pond is tied into a series of
several other lakes and ponds as a part of the City's overall
storm sewer system in our central district. The apparent reason
for the continuing rise in elevation is the drainage of the
upstream ponding areas to the south faster than what can be
pumped out through the storm water lift station at Hurley Lake
north of Wescott Road. All downstream facilities have been
checked and found to be operating at their full capacity.
Therefore, the limiting factor is the pumping station at Hurley
Lake.
Based on our evaluation of this system, it is likely that the
City will be expanding the pumping capacity of this lift station
to provide a quicker draw down of the storm sewer system,
minimizing the.impact of the fluctuating water levels.
It is unfortunate that our investigation did not discover
anything that could provide a quick solution to your concerns.
However, this explanation will help you to understand the system
and the future corrective actions that will be pursued by the
City.

Filling vs. Ponding Easement Acquisition

Dear Mr. Hill:
On July 23, I received a letter from you indicating your desires
to fill in the part of your property that is periodically inundated
by rising water elevations of the above-referenced pond.
This letter is to inform you that the City would have no objection
to this subject to the issuance of the appropriate permits. This
particular. City pond is also classified as a Department of Natural
Resources (DNR) Public Waters Protected Wetland #144W. The DNR has
jurisdiction over property up to elevation 818.7. It appears that
this elevation incorporates the extreme northeast corner of your
property. Any fill below this elevation would require a permit
from the DNR. However, historically, these types of permits have
not been issued.
Also, any fill that would exceed 5 feet in depth or cover more than
10,000 square feet would require the issuance of an Excavation and
Fill Permit from the City of Eagan.
After reviewing this information, if you wish to proceed further
with the application of an Excavation and. Fill Permit from the
City, please feel free to contact Mr. Craig Knudsen, of the
Engineering Division, who can assist you in that matter. He can
also help to coordinate the installation of some field markers
identifying the elevation jurisdiction of the DNR Public Waters
designation on your property.

Dear Mr. Hill:
On July 13, you submitted a letter expressing your concerns
regarding the elevation of the City's pond and its encroachment on
your property as a result of the continued rains we have
experienced this spring and early summer. I recall you expressing
similar concerns as indicated in my response to you of August 20,
1987. While the City has made corrective improvements to the
system, upstream development of the overall central drainage
district still continues to provide a significant amount of runoff
which results in the continuous fluctuation of the pond elevation
and its encroachment on your property.
Subsequently, it appears that the time has come for the City to
acquire a permanent ponding easement over that portion of your
property below the 830.0 elevation. Based on your recent concern,
the City Council on July 17 authorized the City to negotiate the
acquisition of this permanent ponding easement. Therefore, the
City Engineering Division will be coordinating the surveys to
prepare the legal description of the easement to be acquired. Mr.
Joe Earley, 432-3136, of the City Attorney's office, will then be
involved in preparing the formal easement documents and
coordinating the acquisition of this easement from you.
I regret that we were not able to modify the overall drainage
system to eliminate the need to acquire this ponding easement from
your property. However, please be assured that the City will
compensate you for the fair market value of this property similar
to the acquisition of a ponding easement from your neighbor on Lot
5, Mr. Victor Staff.

SETTLEMENT AGREEMENT
Agreement made this _a J s<- day of M,# y , 1986
between Victor and Sharon Staff of Eagan, Minnesota, herein
referred to as Plaintiffs and the City of Eagan, herein
referred to as Defendant.
PURPOSE
This Agreement is made as a compromise between the parties
for the complete and final settlement of their claims and
causes of action with respect to the following disputes:
a) Inverse condemnation action - Summons and Complaint
dated September 5, 1985;
b) Appeal of Special Assessment - Notice of Appeal dated
September 27, 1985.
The parties desire to reach a full and final compromise and
settlement of all matters and all causes of action arising out
of the facts and claims as set forth above.
SETTLEMENT
In consideration of the mutual promises and covenants
set forth below, the parties agree as follows:
1. Defendant agrees to pay to Plaintiffs the sum of
Three Thousand Eighty Dollars ($3,080.00) to be paid upon
execution of this Agreement.
2. Defendant agrees to reduce the assessment levied
against Plaintiffs property regarding Patrick Eagan Park -
Improvement Project Number 411 from a proposed assessment of
$2,970.oo to an assessment of $2,227.59, a reduction of
$ 742.41 .

3. Plaintiffs agree to convey to Defendant City of
Eagan an easement over a portion of their property legally
described as Lot 5, Block 1, Skovdale 2nd Addition. A copy
of the easement is attached hereto for reference.
4. Plaintiffs and Defendant agree that.all claims,
and demands that they have against the other with respect to
the above described disputes are satisfied, discharged and
settled.
RESERVATION OF RIGHTS
This Settlement Agreement is to operate as a release and
discharge only the parties hereto, and it is agreed that
Plaintiffs expressly reserve the right to prosecute suits and
claims against any and all other entities that may be
responsible for or that have contributed to the injuries
and damages sustained and claimed by Plaintiffs.
In witness whereof, the parties have executed this
Agreement the day and year first above written.

PONDING AND UTILITY EASEMENT
THIS INDENTURE, made and entered into this 1L0 day of
1986, by and between VICTOR STAFF and SHARON STAFF, husband ane, as
Grantors, and the CITY OF EAGAN, Dakota County, Minnesota, as Grantee,
WITNESSETH WHEREAS, said Grantors are the owners of the tracts of land in
the City of Eagan, Dakota County, Minnesota, legally described as follows:
A perpetual drainage, utility and ponding easement over and across that
part of Lot 5, SKOVDALE NO. 2, according to the recorded plat thereof,
Dakota County, Minnesota, lying northeasterly and northerly of a line
described as follows:
Commencing at the northeast corner of said Lot 5; thence on an
assumed bearing of South 0 degrees 02 minutes 21 seconds East along
the east line of said Lot 5 a distance of 251.98 feet to the point of
beginning of the line to be described; thence North 59 degrees 01
minutes 26 seconds West a distance of 151.54 feet; thence North 72
degrees 17 minutes 55 seconds West a distance of 70.37 feet; thence
North 61 degrees 00 minutes 51 seconds West a distance of 63.13 feet;
thence North 84 degrees 15 minutes 42 seconds West a distance of
58.26 feet to the west line of said Lot 5 and there terminating.
NOW, THEREFORE, the said Grantor-, in consideration of One Dollar ($1.00)
and other good and valuable consideration, to them paid by Grantee, receipt of
which is hereby acknowledged, hereby grants an easement to the above premises
to said Grantee, its heirs and assigns, for permanent ponding purposes,
including the normal practice of filling with water the above described
premises from storm sewer runoff and for utility line purposes.
The Grantee shall have the right to do whatever is necessary for the
enjoyment of the rights herein granted, including the right of clearing the
easement area to allow ford the use of the land as stated herein, and for
ingress and egress to and from said tract of land and over and across said
easement only for the purpose of laying, maintaining, operating and repairing
said utility lines.
And the said Grantors, for themselves, their heirs, executors,
administrators and assigns do hereby release the said CITY OF EAGAN, its
successors and assigns, from all claims for any and all damages resulting to
said land by reason of the location of lake, ponding area or utility line.
By acceptance of these easements, the Grantee agrees that it shall restore
the property located outside the anticipated perimeter of standing water to as
near the existing grade as is reasonably possible and further agrees to
replace existing cultivated shrubs or sod and to seed all other areas not
covered with standing water.
It is expressly understood that the Grantee, its successors or assigns
shall waive and release said lands or that portion thereof used for permanent
lake or podding purposes from any special assessment levied on an area basis
on account of any improvement in the City of Eagan for such time as said lands
are used for permanent lake or ponding purposes, but at such time as such uses
or purposes are abandoned then said lands may again be subject to such special
assessments, as have been levied or may hereafter be levied.

The goal of a septic system is to protect human health and the environment by properly- treating
wastewater before returning it to the environment. Your septic system is designed to kill ham. ful
organisms and remove pollutants before the water is recycled back into our Iakes. streams aid
groundwater.
This management plan will identify the operation and maintenance activities necessary to ensure
long-term performance of your septic system. Some of these activities must be performed Sy y-oc, :he
homeowner. Other .tasks must be performed by a licensed septic rnaa:rtainer or service provider.
However, it is YOUR responsibility to make sure all :asks get accomplished in a timely manner.
The University of Minnesota's Sep& System Owner's Guidle contains additional zips and
recommendations designed to extend the effective life of your system and save you money over 'time.

Professional Management Tasks
These are the operation and maintenance activities that a pumperMaintainer performs to help enslire
long-term performance of _your system. Professionals should refer to the 0,'M Manual for ‘:ierailed
checklists for tanks, pumps, alarms and other ??2 potions. Call 800-322-8642 or more details,
• Written record provided to homeowner after each visit.
Plumbing/Source of Wastewater
• Review the Water Use Appliance Chart on Page 5 with homeowner. Discuss any chtinges in
water use and the impact those changes may have on the septic system.
• Review water usage rates (if available) with homeowner.
Septic Tank/Pump Tanks
Manhole lid. A riser is recommended if the lid is not accessible from the ground surface. Insulate
the riser cover for frost protection.
Liquid level. Check to make sure the tank is not leaking. The liquid level should be level with the
bottom of the outlet pipe. (If the water level is below the bottom of the outlet pipe. the Tank may
not be watertight. If the water level is higher than the bottom of the outlet pipe of the tank, the
effluent screen may need cleaniniz, or there may be ponding in the drainfield.)
• Inspection pipes. Replace damaged caps.
• Baffles. Check to make sure they are in place and attached, and that inletoutlet baffle's are clear
of buildup or obstructions.
• Effluent screen. Check to make sure it is in place; clean per manufacturer recommendation.
Recommend retrofitted installation if one is not present.
• Alarm. Verify that the alarm works.
• Scum and sludge. Measure scum and sludge in each compartment of each septic and pump tank,
pump if needed.
Pump
Pump and controls. Check to make sure the pump and controls are operating correctly.
Pump vault. Check to make sure it is in place: clean per manufacturer recommendations
Alarm. Verify that the alarm works.
• Drawback. Check to make sure it is operating properly.
• Event counter or run time Check to see if there is an event counter or run time log for the r unip
If there is one. calculate the water usage rate and compare to the anticipated average daily flow
listed on Page 2.
