• a strong commitment to children.
In addition to the individualized attention and
services provided to each child, MYPM staff
teach children the value of being part of a family
group, the impact of their behavior on the group,
and the importance of their positive contributions
to the well-being of the group.
Services are designed to foster insight and
the development of new skills which will allow .
the children to. better manage their thoughts,
feelings, and behavior. MYPM staff focus on
enhancing children's understanding of the
impact of their behavior on others and
reinforcing the skills and learning which
maximize opportunities for success and positive
contribution.

(MYPM)
is a private, non-profit corporation
established to provide residential family care to
children with emotional and/ or behavioral
disturbances. The, MYPM is one of the
Menninger Youth Programs, a national network
of family care programs sponsored by The
Menninger Clinic. The Menninger Youth.
Programs have a lengthy history of success with
children who have not been. successful in other
placements.
The MYPM serves girls and boys, ages-6 to
18, of varying cultural and ethnic groups, from
the counties in and around the Twin Cities area.

Children must be able to function in a non-
secure residential environment and.to receive
benefit from a structured, stable family home
setting. To benefit from the program, children .
must be:
able to participate in an appropriate
educational or vocational plan;
r free of serious substance abuse problems,
acute psychoses, or significant neurological
problems, that substantially interfere.with the
children's ability to participate in the program;
• able to participate in local school and
community events and activities.
Children must be referred by theirfocal county
social service agency. -
- has the philosopy that all children share the
same basic needs and that, before normal
development can occur, children need love and
nurturance, parental guidance, structure; and
opportunities for family and community
.
Involvement.
The primary goal of the MYPM.is to provide
a caring, stable, and structured environment in
which children can:
• develop trust in the adults around them;
• acquire skills to improve functioning in the
home, school, and community;
• develop improved confidence and belief in
themselves through positive living
experiences;, and
• learn how to live successfully in a family. .
environment and to generalize that learning to
the community and society as a whole.
Care is provided by family care parents
within the home. In addition to the family care
parents, the MYPM has a treatment staff
consisting of two social worker/case workers and
executive director to provide coordination and
oversight of children's individual treatment plans
and liaison with families and other community
service providers involved with the children
during their program stay.

I recently met with representatives of the Menninger Foundation and
Dakota County Social Services to discuss a group home that is being
built in Eagan _Royale_by, the Henninger Foundation.
The Menninger Foundation purchased the property some time ago and
is currently building a home that could potentially house six to
eight children from 6 to 18 years old. You may want to share the
attached information with the City Council, in case there are
questions from the neighborhood regarding this residence.
If anyone has any issues concerning this, they should contact Jan
Gibson Talbot, the Executive Director of the Menninger Youth
Program of Minnesota at 457-2629.

I very much appreciated the opportunity to meet with you last
week to discuss the Menninger Youth Program of Minnesota and its
proposed family care home in Eagan. Per your request, I am
providing information which describes the program's background,
philosophy, treatment objectives, and children to be served.
The Menninger Youth Program of Minnesota (MYPM) is a private,
non-profit organization designed to provide residential family
care for children with emotional and/or behavioral disturbances
from the Twin Cities metroplitan area. Our Eagan home will serve
children from the Eagan area and surrounding Dakota County in
order to keep children close to their homes and families whenever
possible and appropriate to do so. r.7
The MYPM is one of the Menninger Youth Programs, a national
network of family care programs sponsored by the Menninger Clinic
in Topeka, Kansas. The Menninger Youth Programs have been
serving children since 1978 and have a lengthy history of
sucessfully serving children who have not been successful in
other out-of-home treatment settings. The MYPM will have the
support of the national Menninger Youth Program co-directors and
the Menninger Clinic, as well as the collective experience of the
other national programs over a number of years, in planning and
implementing these services in Minnesota.
The MYPM has the philosophy that all children share similar basic
needs. Before normal growth and development can occur, children
must have love and nurturance, parental guidance, structure and
stability, and opportunities for family and community
involvement.

The primary goal of the MYPM is to provide a caring, stable, and
structured environment in which children can learn how to live
successfully in a family, community, and society by developing:
1) trust with adult role models; 2) skills to improve functioning
in the home, school, and community, and; 3) improved confidence
and belief in themselves and their capabilities within a healthy,
nurturing, and stable family environment.
The MYPM is committed to providing children a stable and secure
family environment, and to avoiding short-term placements which
contribute to the child's feelings of instability, lack of
permanency, and failure. Whenever possible, children will
participate in the program for periods of 18 months and longer to
allow for sufficient time to work with children in achieving
successful treatment outcomes.
Family care will be provided 24 hours-per-day by live-in family
care parents who have been successful in caring for children,
have an understanding and acceptance of the needs of children
with emotional/behavioral disurbances, and who have the skills
and abilities necessary to effectively care for this group of
children. Family care parents will have the support of a
treatment staff consisting of executive director, 2 social
worker/caseworkers, and consulting psychologist. These treatment
staff will provide ongoing support, consultation, coordination of
each child's individual treatment plan, and collaboration with
the child's family, other service providers working with the
child, the school, and the county to assure a coordinated and
effective plan of care for each child served by the MYPM.
Children served by the MYPM will range in age from 6 to 18, be
free of serious substance abuse, acute psychoses, or significant
neurological impairments that substantially limit children's
ability to function and receive benefit from the program.
Children must be referred by their county social service agency
(in the case of our Eagan home from the Dakota County Community
Services) and have the support of the.county for their stay in
the program.
The MYPM will work in collaboration with the county, the child's
family, the school, and other service providers to assure the
best possible treatment outcome and disposition for each child.

245A.01 CITATION.
Sections 245A.01 to 245A.16 maybe cited as the "human services licensing act."

245A.02 DEFINITIONS.
Subdivision 1. Scope. The terms used in sections 245A.01 to 245A.16 have the
meanings given them in this section.
Subd. 2. Adult. "Adult" means a person who is 18 years old or older and who:
(1) has mental illness, mental retardation or a related condition, a physical handi-
cap, or a functional impairment; or
(2) is chemically dependent or abuses chemicals.
Subd. 3. Applicant. "Applicant" means an individual, corporation, partnership,
voluntary association, controlling individual, or other organization that has applied for
licensure under sections 245A.01 to 245A.16 and the rules of the commissioner.
Subd. 4. Child. "Child" means a person who has not reached age 18.
Subd. 5. Commissioner. "Commissioner" means the commissioner of human ser-
vices or the commissioner's designated representative including county agencies and
private agencies.
Subd. 5a. Controlling individual. "Controlling individual" means a public body,
governmental agency, business entity, officer, program administrator, or director whose
responsibilities include the direction of the management or policies of a program. Con-
trolling individual also means an individual who, directly or indirectly, beneficially
owns an interest in a corporation, partnership, or other business association that is a
controlling individual. Controlling individual does not include:
(1) a bank, savings bank, trust company, building and loan association, savings
and loan association, credit union, industrial loan and thrift company, investment
banking firm, or insurance company unless the entity operates a program directly or
through a subsidiary;
(2) an individual who is a state or federal official, or state or federal employee, or
a member or employee of the governing body of a political subdivision of the state or
federal government that operates one or more programs, unless the individual is also
an officer or director of the program, receives remuneration from the program, or owns
any of the beneficial interests not excluded in this subdivision;
(3) an individual who owns less than five percent of the outstanding common
shares of a corporation:
(i) whose securities are exempt under section 80A.15, subdivision 1, clause (f); or
(ii) whose transactions are exempt under section 80A.15, subdivision 2, clause (b);
or

(4) an individual who is a member of an organization exempt from taxation under
section 290.05, unless the individual is also an officer or director ofthe program or owns
any of the beneficial interests not excluded in this subdivision. This clause does not
exclude from the definition of controlling individual an organization that is exempt
from taxation.
Subd. 6. County agency. "County agency" means the agency designated by the
county board of commissioners, human service boards, county welfare boards or multi-
county welfare boards, or departments where those have been established under the
law.
Subd. 6a. Drop-in child care program. "Drop-in child care program" means a non-
residential program of child care in which children participate on a one-time only or
occasional basis up to a maximum of 45 hours per child, per month. A drop-in child
care program must be licensed under Minnesota Rules governing child care centers. A
drop-in child care program must meet one of the following requirements to qualify for
the rule exemptions specified in section 245A.14, subdivision 6:
(1) the drop-in child care program operates in a child care center which houses no
child care program except the drop-in child care program;
(2) the drop-in child care program operates in the same child care center but not
during the same hours as a regularly scheduled ongoing child care program with a stable
enrollment; or
(3) the drop-in child care program operates in a child care center at the same time
as a regularly scheduled ongoing child care program with a stable enrollment but the
program's activities, except for bathroom use and outdoor play, are conducted sepa-
rately from each other.
Subd. 7. Functional impairment. For the purposes of adult day care or adult foster
care, "functional impairment" means:
(1) a condition that is characterized by substantial difficulty in carrying out one
or more of the essential major activities of daily living, such as caring for oneself, per- .
forming manual tasks, walking, seeing, hearing, speaking, breathing, learning, working;
or
(2) a disorder of thought or mood that significantly impairs judgment, behavior,
capacity to recognize reality, or ability to cope with the ordinary demands of life and
that requires support to maintain independence in the community.
Subd. 8. License. "License" means a certificate issued by the commissioner autho-
rizing the license holder to provide a specified program for a specified period of time
and in accordance with the terms of the license and the rules of the commissioner.
Subd. 9. License holder. "License holder" means an individual, corporation, part-
nership, voluntary association, or other organization that is legally responsible for the
operation of the program, has been granted a license by the commissioner under sec-
tions 245A.01 to 245A.16 and the rules of the commissioner, and is a controlling indi-
vidual.
Subd. 10. Nonresidential program. "Nonresidential program" means care, supervi-
sion, rehabilitation, training or habilitation of a person provided outside *the person's
own home and provided for fewer than 24 hours a day, including adult day care pro-
grams; a nursing home that receives public funds to provide services for five or more
persons whose primary diagnosis is mental retardation or a related condition or mental
illness and who do not have a significant physical or medical problem that necessitates
nursing home care; a nursing home or hospital that was licensed by the commissioner
on July 1, 1987, to provide a program for persons with a physical handicap that is noi_
the result of the normal aging process and considered to be a chronic condition; and
chemical dependency or chemical abuse programs that are located in a nursing home
or hospital and receive public funds for providing chemical abuse or chemical depen-
dency treatment services under chapter 254B. Nonresidential programs include home
and community-based services and semi-independent living services for persons with
mental retardation or a related condition that are provided in or outside of a person's
own home?

partnership, voluntary association or other organization, other than a county agency,
or a court with jurisdiction, that places persons who cannot remain in their own homes
in residential programs, foster care, or adoptive homes.
Subd. 13. Individual who is related. "Individual who is related" means a spouse,
a parent, a natural or adopted child or stepchild, a stepparent, a stepbrother, a stepsis-
ter, a niece, a nephew, an adoptive parent, a grandparent, a sibling, an aunt, an uncle,
or It legal guardian.
Subd. 14. Residential program. "Residential program" means a program that pro-
vides 24-hour-a-day care, supervision, food, lodging, rehabilitation, training, educa-
tion, habilitation, or treatment outside a person's own home, including a nursing home
or hospital that receives public funds, administered by the commissioner, to provide
services for five or more persons whose primary diagnosis is mental retardation or a
related condition or mental illness and who do not have a significant physical or medi-
cal problem that necessitates nursing home care; a program in an intermediate care
facility for four or more persons with mental retardation or a related condition; a nurs-
ing home or hospital that was licensed by the commissioner on July 1, 1987, to provide
a program for persons with a physical handicap that is not the result of the normal aging
process and considered to be a chronic condition; and chemical dependency or chemi-
cal abuse programs that are located in a hospital or nursing home and receive public
funds for providing chemical abuse or chemical dependency treatment services under
chapter 254B. Residential programs include home and community-based services and
semi-independent living services for persons with mental retardation or a related con-
dition that are provided in or outside of a person's own home.

245A.03 WHO MUST BE LICENSED.
Subdivision 1. License required. Unless licensed by the commissioner, an individ-
ual, corporation, partnership, voluntary association, other organization, or controlling
individual must not:
(1) operate a residential or a nonresidential program;
(2) receive a child or adult for care, supervision, or placement in foster care or
adoption;
(3) help plan the placement of a child or adult in foster care or adoption; or
(4) advertise a residential or nonresidential program.
Subd. 2. Exclusion from licensure. Sections 245A.01 to 245A.16 do not apply to:
(1) residential or nonresidential programs that are provided to a person by an indi-
vidual who is related;
(2) nonresidential programs that are provided by an unrelated individual to per-
sons from a single related family;
(3) residential or nonresidential programs that are provided to adults who do not
abuse chemicals or who do not have a chemical dependency, a mental illness, mental
retardation or a related condition, a functional impairment, or a physical handicap;
(4) sheltered workshops or work activity programs that are certified by the com-
missioner of jobs and training;
(5) programs for children enrolled in kindergarten to the 12th grade and pre-
kindergarten special education programs that are operated by the commissioner of edu-
cation or a school as defined in section 120.101, subdivision 4;
(6) nonresidential programs for children that provide care or supervision for peri-
ods of less than three hours a day while the child's parent or legal guardian is in the same
building or present on property that is contiguous with the physical facility where the

After 18 years of service, I am deeply saddened to share that Hearthstone of Minnesota will be
closing its doors on February 26, 2010. As a small arid geographically disperse model of care,
Hearthstone has always needed to rely heavily on extremely high use of our services by counties.
With the significant financial difficulties faced by counties over the past two years,
Hearthstone's referrals have continued to decrease dramatically, to the point where Hearthstone
could no longer continue to provide services as a stand-alone organization.
Despite the continued growth of our development effort through the generous support of our
individual, foundation, corporate, and community partners, the loss of government revenues was
more than the organization could absorb. In response to this trend, the Hearthstone Board of
Directors and I have worked diligently over the past year to find a merger partner, one which
shared our vision and commitment to troubled youth and which could continue to operate
Hearthstone's services as a part of its larger organization. Unfortunately, the foundation that
granted us the funds to begin the Hearthstone program has now required that these funds be
returned, which results in the need to sell our homes in order to meet this financial obligation
rather than merging our services with another organization and thereby sustaining Hearthstone's
unique model of care for the youth we serve.
Regrettably, Hearthstone's journey has now come to an end. Despite this outcome, each of you
has shared in our being able to offer high quality care and treatment within a nurturing, safe, and
stable home to more than 600 youth, whose lives have been changed dramatically as a result of
the efforts of a dedicated Board of Directors, a caring and committed staff, and your ongoing
support and partnership over the years. Because of you, our youth will take with them the
relationships and experiences they might never have been afforded and which have truly helped
them on their way to becoming effective, contributing adults.
I : am deeply honored to have served as the founder and President of Hearthstone of Minnesota
and to work with each of you in this wonderful effort. Although words seem inadequate at this
tirne, please know that we are deeply grateful for your commitment to, and unwavering support
of, Hearthstone and its youth, a group of children we have been privileged to serve and will
