Dear Mr. Reid,
I am writing to request help with problems related to our builder,
Johnson-Reiland Construction, Inc., 1526 L T'10 Street, Burns-
ville, Mn. 55337, Telephone 894-9300.
We closed on this new home at 2009 Royale Drive on August 6, 1991
and said builder agreed to complete a "punch list" of items before
our move from Illinois on Sept. 6, 1991. We were also to be given
a list of contractors for warranty purposes.
Upon moving in, we found these items not done, but after several
phone calls, most were completed by November 1991, except for:
1) Repainting of one side of breakfast bar
2 Trimming of oak trees on property by seller (which was stated in
the original purchase agreement.)
When repeated calls to the builder went unanswered, a tree service
in the area did trim all dead limbs from three trees and cut down
one dead tree at our request in November. I then sent a letter to
Johnson-Reiland asking them to pay even one-half the cost with us
which amounted to $580.00, but again had no reply as of January 1991.
Last week our realtor, Jean McGinnis of Edina Realty offices in
Stillwater, contacted Johnson-Reiland asking about the two remaining
"punch list" items and was told by Mr. James Struffert that he would
do nothing further to this house as he had lost money on it already.
In the past few months, we have had the following incidents occur
which should be under warranty:
1) two ceramic soap dishes fall off the walls in each shower
2) main furnace shut down on 11/29/91 with repairs amounting to $134.00
3 master bath shower valve would not shut off on 1/15/92 with repairs
amounting to $68.00.
I am enclosing copies of the purchase agreement, my original letter
to Johnson-Reiland, a warranty repair form never completed, and bills
for tree trimming, furnace repair, and plumbing repair.
2.
Could you please advise as to our rights in this matter? We
fully expected the builder to abide by his contract, and to
provide some warranty on repairs. Because Johnson-Reiland lost
money on this house does not mean that we as homeowners have to
suffer. Any information you can provide would be appreciated.

I am in receipt of your letter dated November 21, 1991 concerning the
replacement of 2 ceramic soap holders in our home at 2009 Royale Drive.
However, there are still two items on our original punch list dated
August 6, 1991 which have'yet to be taken care of;
1. Repainting of the one side of breakfast bar. (Jeff Schultz
did look at this job and was to consult with you and get back to me.)
I also called and left a message about this item several times with
Mary McCleary.) -
2. Trimming of four oak trees on our property as per agreement.
(We recently had a tree service come to trim three oaks and cut down
one completely dead tree. All have suffered heavy construction damage
to their root systems. The work had to be done when the trees were
dormant and we could wait no longer, after leaving several messages
again with your office. We would ask that you pay at least J this
cost which amounted to $425.00, which we felt was quite reasonable.)
Two other items which were also in question are 1) Spring attachment
to laundry door leading to garage, and 2) laundry sink faucet end
piece is missing.
I have called at least three time with regard to all of the above and
have had no response except this letter which mentions only the soap
holders. May I please hear from.-you as soon as possible I will be
glad to sign "a form when everything is finally completed.

cabinets are factory finished, and the process used by WoodMode can't be
duplicated in the field. We are thus unable to repaint the panel to match
the cabinets. At the time of closing the cabinets were accepted. I have
ordered a WoodMode touch-up kit. Please call our office and stop by and
pick it up.
Prior to closing Johnson-Reiland Construction, Inc. paid a tree trimmer to
trim up theoak in the front.yard. Our position is that Johnson-Reiland
Construction, Inc. is not responsible to cut down any trees per the
purchase agreement, and the trimming we did was all that was intended.
3. Ceramic soap dishes - You have a copy of our request to Alpha Property
Repair dated Nov. 21, 1991. A second request has been made by phone and
it is our understanding that as of today's date Jeff Schulz has either
completed the work or made an appointment to do so. If this is not the
case please call for an appointment at a mutually agreeable time, the work
will be done at no charge to you.
4. According to the Plumbing and Heating warranty you must contact the original
installer or subcontractor to protect your warranty.

Any charges you incur outside the original manufacturer and or installer are
