Y Approve Cross Easement Agreement, Safari Reservoir and Lot 5, Block 4, ,Eagan Royale--When the Eagan Royale Addition was developed, the developer requested the City to relocate its reservoir access road from Safari Pass to the new internal Royale Drive. The developer provided a cross-easement over Lot 5, Block 4 for City access in exchange for the City granting a cross-easement over the Safari Reservoir property (Outlot B) adjacent to the south edge of Lot 5. This would allow both access to the reservoir by the City maintenance personnel as well as driveway access to the single family lot necessitated by the elevation differential of this high knob. Staff has now received a building permit application for a house plan that requires this cross-easement for private usage to extend along the west edge of Lot 5 in order to provide adequate access to the proposed garage elevation. This requires a modification to the cross- easement agreement. The property owner has agreed to reimburse the City for the legal costs incurred to modify this cross-easement and to contribute $500 towards the bituminous surfacing of this reservoir access road which will serve as their driveway as well. Enclosed on page is a sketch showing the location of the access road and the proposed house. ACTION TO BE CONSIDERED ON THIS ITEM: To expand/modify the current cross- easement agreement between Outlot B (Safari Reservoir) and Lot 5, Block 4, of Eagan Royale to allow a private driveway access in consideration of $500 paid to the City and reimbursement for legal fees to modify said agreement.
