Mr. Eastburn indicated he is intending to plant $8,000 in trees on this property, he has the holes dug, and the workers ready to go. He needs to know expeditiously whether he can plant trees there or not. I explained to him that although Craig told him the property was vacated, he may have simply meant that the road is no longer used. I told him that if the property was formally vacated, that my understanding is that the property then reverts to the adjacent property owner, which would be him. I spoke with Craig, and he said he told him the road was "abandoned". It was never formally vacated and according to Tom Colbert, will never be vacated because of the water main at that location. The city does have a policy about planting trees on "public street right-of-way°, and in parks, but this doesn't fit either of those categories. 1 made it very clear to Mr. Eastburn that unless the property is formally vacated, even if permission is given, the City still maintains ownership, and can remove those trees if they deem it necessary.
