Dear Mr. & Mrs. Arndtsen, The purpose of this letter is to summarize my observations and recommendations from my site visit to your property last Friday, September 23 as they relate to the drainage issues you are currently experiencing. Observations: It appears that your lot is graded correctly and should function as designed to handle the volume of water intended to flow through your lot. However, I observed a drain tile on your neighbor's property at 4906 Rusten Rd. that is pointing toward your property and is only a few feet from the property line. The presence and location of this drain tile is a significant concern as it is not out - letting in the proper location. Furthermore, the additional water the tile is bringing from the other side of the property, coupled with the landscaping and patio improvements that have been added over the past few years are likely bringing additional runoff towards your property and at an increased rate, all contributing to your issues. Finally, your neighbor has converted the steep slope in their backyard into garden space, while okay most of the year, it is a concern during those periods when no vegetation is present to hold the soils in place. Recommendations: Moving the drain tile outlet would substantially improve the situation and should be done as soon as possible. Since the intended drainage pattern is for the runoff to flow between the two houses and out to the street the drain tile outlet should be relocated to outlet between the houses at a point at or past the front of both homes. There may be other alterations that could/should be done in the back yard of 4906 that would split the drainage to run more evenly on both sides of the home as originally intended. However, I was not able to take a close look at the entire back yard in order to offer any specific recommendations. Finally, steps should be taken in the garden area to secure the slope during the non -growing periods of the year. Options include, but are not limited to, planting a cover crop, covering the slope with plastic, or installing several rows of silt fence running parallel to the slope and along the bottom. As discussed during our site visit, drainage situations such as this are considered civil issues and City Code does not give staff authority to intervene. We are only allowed to consult and offer suggestions. I do recommend that you continue to document the issues both written and with photos. Should the situation not get resolved and you end up sustaining a loss on your property this may need to be settled in court. I wish I had some better news for you and certainly hope your neighbor will have a change of heart and do the right thing for not only your property but for theirs as well.
