3. It has come to my attention also that the properties with
Lone Oak frontage were excluded from the assessments, yet
Skyline Road is built with a temporary Cul-de-Sac to be joined
in the future by any subsequent development. This is totally
unfair to all of us who are expected to pay this assessment,
when at some point a developer can benefit from our loss.
We were told that they have access to a Lone Oak outlet.
During the planning hearings we submitted the same idea for
an outlet to Lone Oak instead of a major road to Highway 13,
which would have been much less costly and the responsibility
of the developer. We were told the County did not want another
outlet on Lone Oak. Why now is it 0 K for that outlet as well
as a link to roads we are paying for. Simply ludicrous is my
opinion.
The City Council should weigh heavily the burden to Rustic
Hills people---because in reality, one does not exist!

I believe I am not responsible for the assessment related to
Project 543R, Skyline Rd/Sibley Hills Drive.
Several points I wish to bring out are as follows:
1. We who live on Rustic Hills Drive are angry that we were
targeted to be a part of the development of Prettyman Heights
and therefore Project 543R, Skyline Road/Sibley Hills Drive.
Our street and utilities have been in place since early 1980's.
Arbitrarily, city engineers decided to close our exit to Hwy 13
(the southerly outlet of the former Sibley Hills Dr), when there
was no established need to do so. Our roadway was properly
maintained and very safe to that juncture, therefore closing of
this exit was unnecessary. Technically there was absolutely
no need to make us a part of this development. Therefore I
believe I should not be liable for the costs incurred.
2. The amount proposed for me to pay (1059.98) far exceeds
the feasibility report amount (723.83).The actual difference
is 336.15 or 46.44%• This is outrageous. Granted the F. R. was
only an estimate, how can you justify a blunder of 46%• At the
same time, Prettyman Heights lots show a decrease of 931.65.

fair share, I insist you check into the fairness!!!

mislocated.
Mr. and Mrs. Glass claim that they have suffered additional costs as
a result of the additional excavation, including additional rent as
the foundation would have been poured prior to a series of heavy
rains had it not been for the additional excavation. They also
indicate that the house was not designed to be a walkout on the west
side which faces the wind and their neighboring lot. It is not
clear to me as to how much the owner or builder could have mitigated
that problem. However, it appears that the home was designed and
planned well before the discovery of the mislocated utility line.
It is quite difficult to change house plans when construction has
already commenced.
At this point, Mr. and Mrs. Glass have requested a payment of $1,100
representing the one-half the cost of the retaining wall in exchange
for the necessary easement.
Unless it can be easily shown that the relocation of the home did
not create the need for additional retaining wall or caused delay in
occupancy by the owners, we would recommend that the amount
requested be paid to the land owners.

WITNESSETH, that the said Grantors, in consideration of One
Dollar and other good and valuable consideration, to them in hand
paid by the said Grantee, the receipt whereof is hereby
acknowledged, do hereby grant, bargain, convey and warrant to said
Grantee, its successors and assigns, the utility easements situate
in Dakota County, Minnesota, as follows:
That part of Lot 9, Block 1, Rustic Hills Addition lying
easterly of the following described line:
Beginning at a point on the South line of said Lot 9, 9.00 feet
west of the southeast corner thereof; thence North 1 degree 00
minutes 00 seconds West, assumed bearing, to the Southerly line
of Rustic Hills Drive and there terminating.
The said Grantee shall have the right to do whatever may be
necessary for the enjoyment of the rights herein granted, including
the right of clearing said right of way and of ingress and egress to
and from said tract of land over and across said easement only for
the purpose of laying, maintaining, operating, and repairing said
utility lines.
By the acceptance of these easements, the Grantee agrees that it
shall replace any shrubs or sod removed by it in the exercise of its
rights hereunder to as near the condition which existed immediately

Dear Tom,
Enclosed please find copies of bills that were incurred due to the storm sewer pipe
that is over the easement on 1570 Rustic Hills Dr., Eagan, MN.
Back in July, a letter was sent to the city of Fagan addressed "to wham it may
concern." In this letter I expressed my concerns of the extra expenses incurred
due to having to re-stake and re-dig the basement. At this time I was in correspondence
with Ed Kirsch wham stated to me that I should submit these bills to the city
for re-imbursement. Ed also stated that this was not the first time a storm sewer
was put in wrong, and that we were entitled to request a correction. He referred
me to Bob Rosene, or Jerry Border. In discussions with these gentlemen, they
referred me back to the city.
On August 12, 1987 I again spoke with Ed Kirsch, concerned about the lot and
easements, and also concerned about the re-imbursement of the extra expenses
incurred. At this time, Mr. Kirsch spoke very rudely to me, and denied anything
he had previously told me. He then referred me to yourself or Dave Rita.
Since then, I have received no answer as to what is going to happen with any
new easements, or wham is going to re-imburse Ratzlaff Construction, Inc. for
the enclosed expenses. I haw,though, appreciated your cooperation in trying to
work things out for us.
The closing is set for October 14, 1987, the new homeowners are Richard and
Christine Glass, they are also very anxious to know what is going to happen.
Richard has indicated that he would appreciate a call from someone at the
city regarding this matter. Their hone phone is 729-1530, Richards work
number is 721-7411. It would be greatly appreciated if this matter would be
cleared up soon. Thank you for your cooperation.
