Several of them dealt with the apparent excessive slope to the driveway while others have related to the overall elevation of the house in relationship to the neighborhood along with questions regarding its compliance with the protective covenants for the neighborhood. Although the driveway slope is greater than what would normally be expected, it is not uncommon in Eagan with its many rolling hills and changing topography. The City does have an ordinance that provides a guideline that is flexible to varied lot conditions that may require different slopes. Normally, Certificates of Surveys are submitted for review to insure that the planned house meets the appropriate setbacks and site criteria in relationship to adjacent ponds, utilities and streets. Unfortunately, when this particular site plan was reviewed, the proposed elevation was not recognized as being inappropriate for this lot and/or neighborhood. Unfortunately, the house has progressed to the point where there are no remedial actions available other than to revise the current review process to insure that greater emphasis is given to these types of concerns in the future. In the meantime, various staff have been in contact with the contractor and future homeowners to share the City's concerns regarding the driveway slope. They recognize the potential problems associated with it and have indicated a~ potential for installing heating wires under the dxiveway to minimize any potential for ice buildup. In relation to its compliance with the protective covenants, the City is not part of those agreements. Subsequently, we have little knowledge of these private type agreements nor any ability to insure compliance. This issue would have to be approached from a private neighborhood and/or property owner perspective. We regret that the City did not catch the opportunity to minimize the concerns that have resulted from this new home construction in your neighborhood. The following erosion and sediment control practices should be implemented to correct this problem: 1. The lot needs to be re-graded. Any excess material should be removed from the lot and the lot re-graded so that drainage is temporarily directed "back into the hill" (benched). A 4-5' cutslope on the backside of this site is a significant source of sediment onto the lot at 4867 Safari Court. This area also needs to be re-graded to eliminate this source of sediment. 2. After re-grading, at least two inches of topsoil needs to be spread on the lot. 3. After topsoil replacement, the entire lot ?eeds to be seeded and mulched. Either a temporary or permanent vegetative cover would be suitabl2, Approximately la- 15 bales of straw should be spread on the surface and anchored into the soil. We recommend that mulch is anchored into the soil using either a straight disk or jute netting. Jute netting will likely be needed to anchor the mulch on the steeper slopes. 4. Silt fence should be installed across the frontside of this lot and along the "downsteam" lot line. We recommend that the silt fence be immediately installed and maintained until 1) temporary vegetation is re- established and 2) during home construction.
