Dear a;r. Colbert:
I met with Nir. John Wingard in yoanr department on November 18, 1988 to
discuss the present status of the Safari Estates 2nd Addition adjacent
to our property and to go over drawings (Street Construction Plan/Frofiles
and the Grading & Erosion C~ntrvl Plan). I~1r. Wingard indicated that it
is the City Engin==ring's judgment, and we concur, that 3 catch basins
and a manhole on the access road (Safari Heights Trail) with an approximate
300 foot connecti~n to the street storn drain are necessary in order to
prevent future erosion to our proDerty, damag= or destruction of our
mature trees adjacent to this development, as well as prnvide for proper
water rur.off. These items ar= not.presently provided for on the Safari
cstates 2nd Addition Gradin~ & Erosion Control Plar. and Street Construction
Plan/Profiles. It was further p~inted out nn the plan drawings that a
hieher curve on the Safari Heights Trail road along with the fact that
the rnad will initially go uphill would mean that all water and soil runoff
from the development of this area adjacent to our property would directly
affect our property and our trees because we are at a lower elevation.
Because the hi~her curve ends at our property line, water runoff would
go directly through our large pla.nting area and the middle of our lot.
According to the preliminarv plan in its present form, the water runoff
would bypass the natural drainage on our property which we are curx-entTy
mair.taining. Grading under the canopy of our mature oak trees as well as
soil an@ water runoff because of the present gradin~ plan will cause some
immediate damage and definitely long term damage over a period of qears to
our trees. This is not acceptable.
As all parties involved thus far (City Council, City Engineering, Mr.
Watscnke, CCS: Inc.) are well aware, the mature trees on our property
adjacent to the new Safari Sstates 2nd Addition are of critical i.mportance
to uss
(1) We purchased our property because of the trees.
(2) 'r'1P went to ennsiderabl= additional expense to have our
home built further away from the trees (after original
plans were pr~posed) as we learned that soil compaction
would be a major contributin~ factor to the destruction
of the mature oaks.

. Because these mature trees are of sucn importance to us, we en~a~ed the
services of an arborist, Dir. Paul J. Seeling, with biinnesnta Yalley
Landscape Inc. He took photographs of all the trees on our property
adjacent to the development, categorized and numbered the trees, and
put a replacement value on them, Attached is a copy of his Nnvember 22
letter giving the details of his findings. We would ask that P4r. Watschke,
who is c~pied on this letter, take special note of Mr. Seeling's comment
on Page 2 of his letter, "It would be impossible to replace these oaks
at same size transplants". Flsase also take careful notice on Page 2
of this letter that the total replacement valu= of these mature oaks
and one elm would amount to ~267,245.00.
Aeain. we went to considerable additional expense in order to provide
proger drainage, prevent erosion, and plant trees and shrubs in our .yard
that would give good root systems to support this. These expenses
included a 100 foot, 6 inch deep rock wall which prevents erosion on the
natural water runoff pathway on our property (adjacent to the development).
Since that initial work, we have added more large river rock and extended
that pathway to the front of our property. A large plantine area was
added in the front nf our lot where the el=vation drops considerably.
It has a variety of plantings which provide good root systems and an
additional wiad/snow/safety break,
Safety is another matter nf concern due the placement and initial uphill
slope of Safari Heights Trail and its access From Safari Pass. There is
no major concern when traffic is traveli.^.g southwest and movine uphill
turning right, or north, onto Safari Heiehts Trail. However, traffic
coming from the opposite direction turning left while travelin~ downhill
(and cureir.g opposite the turn onto 9afari Heights Trail) directly toward
our property could conceivably lose control or slide during winter months
and miss the turn iF travelin~ more than 10 miles per hour, potentially
droppin~ directly into our Yront yard through our planting area. Our
children and their friends play in the fr~nt yard and in the winter
months snowsiide nn the hill in our front yard, We are very corrcerned
about this sa£ety aspect. Therefor=, I strongly recommend that some
type of natural buffer or barrier be placed between the Safari Heights
Trail entrance and our adjacent property to prevent suc?: an occurrence.
We further suggest that a retaining wall be built adjacent to our property
to insure erosion, drainage, and safety controls. Our concerns and con-
sidsrations are necessary due to the uniqueness of the topographical
elevation differences between the Safari Estates 2nd Addition and our
property.
It only stands to reason that we want to do everythin~ possible now at
this stage of the planned development to prevent any damage to our mature
trees, erosion to our property, and dan~er to persons and property alike.
~1e will not accept that this development will be put in without catch
basins and the manhole, as recnmmended by the Department of Fublic "vdorks,
and strona consideration ~iven to saiety. As this is the developer`s
property, we assume that ;:.r. Natschke wants to insure that future c13i:ns
by property owners do not result because of improper initial safety pre-
cautions, ~rading anc~ erosion control plans, and water redirection. These
additiaaal expenses should b= borne by th= ~eveloper just as we have had
to go to considera.ble expense in order to maintain 2nd pro~ect our property.

Ozmun-Pederson Inc, for the development, the marketing people, Dale and
Dee ~eans with Coldwell-Banker, Nir. Robert Jackson with CCST Inc., and

future are informed. Copies of all pertinent material in this matter,
which has been ongoing since June 1988. are attached.

Mr. Hedges stated the Advisory Planning Commission is
recommenning approval of the rezoning and preliminary plat of Safari
Estates 2nd Addition.
N!r. Runkle stated a public hearing was held by the APC at their
last regular meeting on May 26, 1988 to consicer a rezonina of the
24.8 acres agricultural to estate and a preliminary plat for 31
single family lots located west of Safari Fass ana east oi High~vay 35
as sunmittea by Fortune Realty. Mr. Runkle stated the plat as
, proposea incorporates two outlots from the Eaoan Royale Addition to
the south ana two f rom the Safari 3rd Addition to the east. The

To Whom It May Concern,
On the morning of September 7th, 1988, I made an inspection and
inventory of the native woods on the west portion of the James
Nelson residence at 4909 Safari Pass. The weather that day was
clear and sunny providing ezcellent conditions for this work.
The area encompassed an area west of the lawn to the west
property line and south from the approximate utility easement line
ad,junct to Safari Pass, north to approximately the northwest corner
of the lot. The boundaries were clearly noted by an ezisting oId
wire fence on the west northwest and a right-of-way marker at the
west southwest.
In this area noted above, the terrain slopes down from the west
to meet the sod line of the yard sloping to meet it from the east.
A total of 46 trees were cataloged in this area of the Nelson yard.
All trees were measured for caliper size according to industry
standards prepared by the American Association of Nurserymen (ANN)
using a six foot flexible steel diameter tape measure. The
measurements were recorded at 12 inches above the groiuid- per .ANN -
standard for trees over 4" caliper. A rough field sketch on two
sheets was prepared showing approximate location, inventory number,
and corresponding caliper measurement in inches. Seven Polaroid
pictures were also taken as fl~rther documentation of the area.
All the trees with one exception were all 'Quercus' gerius
(oak), the one exception was inventory rnamber 45 which was 'IIlmus'
genus (alm).
All of the trees were live and appeared to be in good health.
~eir growth structure (shape) was typica2 of native trees in a
maturing hardwood environment. This area obviously provides several
benefits to the Nelson property including bird and wildlife habitat,

increased aesthetic value, good shading elements, and proportional
property worth for the valua of existing matiu~e oak trees. A quote
from Tavlor's Guide to 14^ees. p. 98~, best describes the 'Quercus'
genus:
"This gerrus includes the finest hardwood timber trees
in the temperate world, and also many beautiful species
for planting on lawns, parks, and streets."
The total caliper inches of oak inventoried in the area
equaled 2io8.35• It wouid be impossible to replace these oaks at
same size transplants. However, the total ca23per inches could be
replaced in smaller sizes up to 12" in caliper. This replacement
standard is currently a development guideline in some
municipalities such as Eden Prairie. At current market rates 3t
costs on average from $100.00 to $150.00 per caliper inch to
tlsx~nish and install oak species with a one-year warranty. If these
trees were then lost in total, an approxtmate replacement value
would be assumed using the current market price of, say, $125•~
per caliper inch x 2108.35 inches to equal $ 263.543.75 plus tax,
plus any prior removal costs (if any) to prepare for replanting.
The same would apply for the elm with a current approximate
market rate of $90.00 per caliper tnch x 40 inches (the one elm
being 40 caliper inches) to equal $ 36pp,pp in replacement
value.
Hopefully this information will be vsefYil to you. It should
be noted that a certified real estate appraisal is necessary in
determining total property value.

Dear Mr. & Mrs. Nelson:
I am in receipt of your letter dated November 28 wherein you have
expressed concerns relating to drainage, erosion control and
intersection design issues associated with the development of the
above-referenced subdivision. As a part of the final plat
application process, the developer must submit with the City a
grading and erosion control plan. The City will review this plan
to ensure that the grading is kept to an absolute minimus within
the boundaries of this plat or that adequate temporary
easements/rights-of-entry have been obtained from adjacent
private property beyond this boundary, if necessary. The erosion
control plan will address the potential of erosion, and temporary
erosion control measures will be required to be installed prior
to the disturbance of any land area associated with this
development. This process should provide the protection for
your property that you have expressed concerns with.
I have been informed that the additional storm sewer facilities
to intercept the runoff from Safari Pass near the intersection of
the proposed entrance to the Safari Estates 2nd Addition pertains
to an existing drainage situation and is not identified as a
responsibility of this new subdivision. In order for these
additional catch basins and storm sewer lines to be installed, it
would have to be under a City project initiated by a petition by
affected property owners. Affected property owners would be
those who both benefit by the proposed improvement and lie within
the drainage/assessment area. Unless adequate funds can be
obtained from the City Council or through a special assessment
project, it is not anticipated that this additional storm sewer
facility will be installed in this area. 'I'he drainage concerns
that you have identified are pre-existing and are not anticipated
to change as a result of this proposed sudivision.

The intersection designs will be carefully reviewed to ensure
they are designed in accordance with City standards. With the
numerous hills and related intersections within the entire
community, it is not appropriate that retaining walls or similar
type obstructions be constructed to contain vehicles within the
roadway due to potential isolated slippery conditions.

related materials to ensure that it is designed and constructed
to current City standards.
