We have become aware, however, of a noticeable problemat the location of where we plan on building. illustrated in the attached diagram of the location of our property, we :are relatively close to Interstate =5E, an obvious heavily travelled throrough-- -sare. This tr-affi.c level, which will only increase with continued development presents two definite problems; a) exhaust emmissions, and b) noise from freeway traffic. The consequences of these two problems is that vegetation and condin_ry water in the area are being impacted negatively, not to mention the residents as well. To resolve these concerns, the possibility of constructing a wooden sound barrier to relieve the problem was considered. Since 1-35'E is a State highway, I contacted the Department of Transportation (MnDot) to determine the course of action to request sound barriers be constructed along the affected portion of l5E. MnDot informed us that since this area was developed after the construction of 35E, funding (federal) for such a project was not available. As I researched further, another alternative was uncovered. According to 1997 Legislation (Chapter 139, H.F. 867/S.F. 748), the State authorizes special assessments for sound barriers to the list of improvements that a city can levy special assessments for. Under the new law, a city may levy assessments for this purpose only against properties which directly benefit from the improvements. The amount of the benefit is to be measured by the - increase in the property's value as a direct result of the improvements. This alternative is obviously dependent upon the cost of willingness of the area residents to agree to an assessment. Before I would undertake beginning a petition for such an improvement I would like to have a preliminary estimate of the improvement's cost. According to MnDot, estimates of the proposed work: can be developed. It is therefore my request of the City, or its designee, Lo develop a preliminary cost estimate for these improvements. Your request was presented to the City Council at their meeting October 20, 1987, for review and consideration. Enclosed is a copy of the minutes from that Council meeting informing you of the action taken. Present City Council policy requires that a petition be signed by at least 35% of the ,affected property owners before the Council will consider the expenditure of funds necessary to prepare a formal feasibility report. This report is necessary in order to proceed with the public hearing process to determine whether the project should be formally approved or not. Enclosed with this letter is a copy of a petition for your information along with a map indicating the potential lots that have been determined to receive benefit and, subsequently, the related assessable costs associated with the installation of this wall. These are the properties that will be used to evaluate the compliance with the 35% criteria for the submission of a petition for pursuing this requested public improvement project. Based on very preliminary field observations and estimated construction costs, it is anticipated that the wall would be` approximately 1,050 feet long'.and vary in height from 20 to 40 feet in height resulting in a total "ballpark" estimated cost of $372,500 or $8 per square foot. Because the City has never been involved in the installation of a sound abatement retaining wall, further investigation will have to be pursued by our legal. department to help determine the appropriate method of spreading this cost `through the special assessment process to the"benefitted" properties...
