Dear Claudia:
As a reminder, the City's landscape ordinance amendments will be
given consideration by the City Council at the next regular City
Council meeting scheduled for Tuesday, June 19, 1990. The
landscape ordinance amendment, which pertains to both private and
public properties, will be heard sometime between 7:30 and 8:00
p.m.
During the past year, the City staff has worked on language that
would require a certain amount of buffering and reforestation with
the planting of trees and other appropriate vegetation in new
subdivisions. This proposed ordinance amendment proposes a direct
regulation and responsibility to the appropriate developer. The
other ordinance provides an opportunity for the planting of certain
tree species on public properties.
As we discussed in a recent telephone conversation, the Dakota
County Board of Commissioners has recently adopted a policy on
erosion control and plantings along county roads. Their action is
similar to the ordinance and policy the City Council will consider
for boulevard plantings along City collectors and other streets
within the community. For a copy of that policy, refer to the
attachment.
The commitment and interest you have given to this public policy
issue is greatly appreciated. I look forward to your input at the
City Council meeting on Tuesday, June 19.

PROPOSED POLICY
EROSION CONTROL AND PLANIMS AILING GOWN ROADS
1. Dakota County will plant and maintain vegetation an the County Highway right of way
only for the purposes of erosion control and slope and soil stability.
2. Dakota County will not advocate or fund tree and shrub planting on County Highway

3. The County Engineer shall regulate placement and selection of varieties of trees and
shrubs, taking into account safety clear zones for traffic movement, sight lines to

pertinent to placement non-highway appertenances within highway right of way.
4. Dakota County will compensate property owners adjacent to County highways for trees
and shrubs removed from temporary construction easements. Property owners may replace

accepted by the city or township in writing prior to permitting such plantings. The

Dear Claudia:
Sorry for all the confusion and apparent miscommunication regarding
your desire to address a neighborhood concern about the lack of
reforestation that has occurred with the improvements to County
Road 31 and County Road 32. My office was not aware that you were
attending and, therefore, there was no background information for
the Mayor and City Council prior to the meeting with the exception
of the letter you had submitted several weeks ago. Your
presentation was appreciated and does address an important
ecological and aesthetic issue concerning county road improvements
throughout our community. The specific issue is obviously the
change of topography and elimination of mature trees and other
vegetation.
As I stated in our telephone conversation, our City Planner and
Parks Planner both hold degrees in landscape architecture and have
expressed concern that a program be established by Dakota County
to properly restore boulevard areas throughout our community with
some acceptable plantings. The issue was recently discussed at a
City staff meeting and identified as a high priority and important
issue for the community to address. Typically, our staff would
interface with County staff and work on some type of policy that
could be presented before both jurisdictions: the City of Eagan and
Dakota County Board of Commissioners.
With the recent involvement of your neighborhood and willingness
to meet with our Dakota County Commissioner, Don Chapdelaine, this
could be an excellent forum to raise what is obviously a mutual
concern and ask for some direction from his office. once the
meeting has been set, I will plan to attend or request that the
Director of Community Development or City Planner attend in my
absence.

Dear Mr. Pawlenty,
We the undersigned homeowners who reside in the northwest
corner of the development of Fairway Hills in Eagan, are
extremely concerned about the noise, air pollution and
aesthetic damage occasioned by the recent construction
project during which Cliff and Pilot Knob Roads were widened.
Another major issue is the erosion of the dirt embankments at
the sides of these thoroughfares; and the resultant damage to
the landscaping of the properties adjacent to these
embanl;ment.s. Erosion has already begun with snow melt,and is
likely to increase dramatically with the spring rains.
Wi!hin the last two years, we have constructed our homes,
valued at $170,000 to $200,000, in the Fairway Hills area
becaLlse of its relative isolation and natural beauty. While
the majority of us were aware of the proposed construction
project, we all were astonished at the extent of the
destruction of the natural habitat caused by the removal of
significant numbers of trees and quantities of dirt which
served as natural barriers against the noise created by the
vehicle traffic. It appears that many of the trees that
remain have suffered damage and may not survive. We feel
that our property values may be negatively influenced by this
aeti.on.
The noise level has increased dramatically because of the
removal of these natural barriers, and due to the recent
increase in vehicular traffic created by the widening of the
roads. This problem has become more apparent as we have
begun to spend more time outdoors with the onset of warmer
weather. We are deeply concerned about the adverse effects
of this noise and the other environmental pollutants on the
health of both ourselves and our children.
Preliminary contact with the State of Minnesota Air Quality
Division office indicates that such pollutants can be a major
problem to persons residing in relative close proximity to an
intersection of this size and anticipated traffic density.
We feel tPiat, in this era of ecological consciousness, every
consideration should be given to restoring this area to a
more natural habitat; and we, therefore, request that. the
following action be taken:
Correction of, and prevention of further, erosion
on the embankments at the intersection of Cliff
and Pilot Knob Roads. We feel that seeding or
sodding alone would not suffice to control erosion
or be an aesthetically reasonable substitution for
trees and wild shrubs that were previously present.
2. Erection of some type of noise abatement barrier
at the intersection and for a reasonable distance
south on Pilot Knob Road and east on Cliff Road to
replace the natural barrier in place prior to
commencement of the construction.
3. Replacement of the trees, shrubs and other plantings
removed by the grading.

issues outlined in this letter.

As the completion of Pilot Knob Road nears, I would like to off'br
my assistance to the county regarding the restoration and
landscaping, especially at steep slope areas and along the Fish
Lake curve. Recently, I spoke with John Voss about my concern of
some potentially sensitive areas along both Pilot Knob and
Diffley Roads. Aside from the aesthetic need to restore these
areas, plant material may also serve as a physical barrier
between the steep slopes and bike paths, possibly eliminating the
need of fencing.
The City of Eagan' and MnDot worked closely on the interstate and
park 6 ride landscaping; the reaction has been very positive. I
am aware that the County has made a commitment for some
landscaping and I would be happy to help in the preparation of
those plans.

We are;writing regarding the concerns expressed in your November 8, 1988
letter concerning landscaping, etc. on the Pilot Knob Road project.
Current Dakota County policy provides restoration of turf cover to prevent'
erosion. Ibis may include a combination of seeding and mulching, sodding,
and/or fibre blankets and these items were included in the project
letting. You have mentioned physical barriers between the bike paths and
slopes or the roadway. the roadway and bike trail meet Mn/DOT standards
and no further physical barriers are necessary.
Mn/DOT may have had special programmed landscaping funds on the projects
you mention but Dakota County has no similar type of funding. Any work
like you mention has been entirely funded by Cities and of course we would
want to review any plans you have prior to letting should you prepare to
d.) t}Tat.
