The City of Eagan must honor the Supreme court ruling that up to 5 unrelated persons, or certainly other family members, can reside within a single-family dwelling. However, a single-family dwelling cannot be remodeled or divided into two (2) separate living units within the same dwelling. Two (2) separate living units within the same dwelling is defined as a duplex and requires an R-2 zoning status according to our City Code. On behalf of our City staff, especially Dale and I, I would like to express my sincere apology for the amount of time and delay that you experienced throughout the past several months in receiving a clear interpretation as to why the accessory housing permit was denied for your neighbor but not enforced by the City. With all that is happening in our community, accessory housing has not been a high priority; however, your persistence and involvement brought it to the forefront and finally a revision and action by the City Council. Your patience and understanding are appreciated and I believe the outcome of this regulatory action by the City Council will be more restrictive for the preservation of single-family neighborhoods. We are concerned with the renting of the basement and single-room ',on the main floor in the house at 1725 Deerwood Drive. The owner of this house has been renting the two areas to non-family members since it was purchased in the fall of 1986. We feel that this should not be allowed since we are living in an area zoned for single-family dwelings. This practice of renting part of a house will lower the value our property. Most of us have lived in our homes since the area was developed. We moved in because of the zoning and we want it to remain as single-family dwellings. It is our understanding that according to the Eagan ordinance, which took effect April 2, 1987, the property must pass an inspection, and be approved by the City Planner for a permit to be issued.
