Below is Mr. Wager's proposal: 1. Add three rectangular windows on the east side of the proposed addition. These windows will be similar to the windows that exist on the garage at 1741 Sartell Avenue. 2. A hip roof style will front the street on the proposed addition. This roof style will match the existing house. The peak of the roof will be slightly lower than the uppermost roof of the house. 3. Landscaping shrubs will be added to the east side of the garage. 4. Farmington, MN 55024 Dear Mr. Johnson: On April 2, 1998, our west property line was identified by a survey crew that your Land Use Manager, Sue Mohlis, arranged, as a result of a meeting we had with her on February 19. At issue is a dispute we have with your association, concerning a 30 foot spruce tree you wanted to remove and a further dispute concerning the placement of your utility poles and wires beyond the easement provided. The survey has certainly made it clear that, the 30 foot spruce tree is and was planted on our personal property (not in the easement and as shown in photo #I enclosed) and further more, your utility poles are located two (2) feet into our property (shown clearly on photo 42 with a white string stretched from one property marker to the other). In addition, the power lines extend another four (4) feet into our property, creating an illegal placement of your utility poles approximately six (6) feet into the west side of our property. As a result of the survey, we are at this time, demanding that Dakota Electric Association immediately remove the utility poles and wires off our personal property and away from our 30 foot spruce tree. Our preference, as we shared with your association earlier, would be to bury the lines on the other side of Blackhawk, where these lines were in the first place. Another, less favorable option, would be to bury the lines between the trail and the street (consistent with the fact that all utilities are buried in our subdivision). If, as a last resort, you must keep above ground poles, we would insist that they be located no closer than between the trail and the street (as exists 1 block to the south and 4 blocks to the north) and again, preferably across the street where they belong. We have retained. legal council concerning this matter and we are aware of ?three'Other property owners affected by this power line placement, that are considering action of their own. We are hopeful that this matter of illegal placement of utility poles will be resolved to our satisfaction, as soon as possible. In the mean time, we will not allow you to trim or remove our 30 foot spruce tree, located on private property. As I mentioned, DEA is not considering replacing the existing overhead line with underground or relocating the overhead line. I've spoken with City of Eagan staff and they've indicated that 7 they would not support or grant a permit to relocate that overhead line. First I'd like to apologize for the delay in getting this response to you but I required information from the city and others before I could reply. The filing of the Cedar Grove 8th plat (enclosed) provided a dedicated 100' of road right- of-way for Blackhawk Road. A variety of State statutes and local ordinances grant or provide Dakota Electric (DEA) and similar utilities with the ability to place power lines along roads and other public rights-of-way. Most commonly used are State Statute 222.37 and City Franchise ordinances which usually require a permit be obtained from the governing agency prior to construction within a specific right-of-way. The poleS for the power line you mention were installed in 1972 along the east side of Blackhawk Road within the dedicated Blackhawk Road right-of-way. Stray voltage is a situation that is found mainly on dairy farms. A difference in voltage between the hoofs and mouth of a cow will cause current to flow in its body which can cause various side effects. This is generally caused by grounding or neutral problems. This should not be a problem in your area. A concern that has arisen with regards to powerlines are Electric and Magnetic Fields (EMF). These fields are created by current through the power lines. Of the two of these, magnetic fields have caused the biggest stir. Electric fields are easy to dispel and cannot permeate a solid surface. Magnetic fields, on the other hand, are not stopped by walls, etc., so they have a greater potential for intrusion into the home. On a positive note, magnetic fields drop off very quickly and most of the time the majority of magnetic waves in the home are created by electrical appliances such as televisions and microwaves. As an example, at a recent survey, I read 40 mG at the surface of a TV screen, but only 0.1 mG one foot from the screen. Another example would be a microwave reading 275 mG at the door, 60 mG at one foot, 45 mG at two feet, and 10 mG at three feet. The current readings underneath the powerlines in your area are 20 mG. No one knows for sure if these fields are harmful or not. Extensive studies on the subject have proved inconclusive. I am including some literature on EMF. If you have any further questions or would like to find out what EMF levels there are in your house, please call me at 463-6122. The best time to check these levels would be on a hot day when the current on the lines is the highest. Farmington, MN 55024 Dear Mr. Sampson: I wanted to follow up our cordial phone conversation, concerning your interest in removing a 30 foot spruce tree from our yard, due to an obstruction with your power lines. As I stated to you on the phone, we asked your tree removal crew to leave when they showed up at our door, ready to take out the 30 foot spruce. His appearance at the door, with chainsaw at the ready, was the first notice we had that the tree was scheduled for removal. Perhaps it isn't your policy but we would have appreciated a prior contact to alert us to your intentions. Several Eagan citizens and Dakota Electric customers (including ourselves), who live on the east side of Blackhawk, have become increasingly concerned about the power lines that run along Blackhawk. We understand that these lines are main feeder lines, which carry with it, "stray voltage" and related health concerns, especially since we all live and sleep within 20 feet of the lines. In testimony contained in the stray voltage case in Connecticut (the Scanlon case of Lebanon), it was conceded by a utility expert that electrical systems designed in the past assumed that electrical current would find its way back to power substations or would be dispersed harmlessly into the ground. Power company engineers thought it wouldn't hurt anything and at lower usage levels that probably was true. However, at current levels and especially what is transmitted in these main trunk lines, the distribution networks are getting overloaded and accelerating the stray voltage problem and related concerns. These power lines were originally located on the west side of Blackhawk but were "temporarily" moved several years ago to the east side, due to underground utility work. Obviously, contrary to what property owners were told, these power lines were never returned to where they belong. The east side development had all utilities buried, which was very appealing until we got these lines placed on our property. Since these lines are still on the east side, we must deal with the problem at hand. We'd like you to address the following concerns. 1) It appears to us, that the power lines are not running entirely on and over city easement but are partially extending onto and over our private property. If this is the case, a re-positioning of the power line pole(s), perhaps closer to the road, to extend entirely on and over city easement, may eliminate the need to top off or remove this valuable and aesthetically pleasing 30 foot spruce tree, a tree that may have preceded the placement of the power lines. If this is the case then your firms callous disregard for proper power line placement is, at best, troubling. A better choice may be to bury the power lines, to eliminate the unsightly lines and be consistent with the development. An even better choice would be to move and bury the lines on the west side of Blackhawk. 2) We appreciated your offer to give us a $100 gift certificate towards the purchase of a replacement tree. Unfortunately, the privacy and aesthetic beauty this 30 foot tree currently provides, cannot be "replaced" with a $100 or $200 tree. According to a local Appraiser, the loss of this tree could reduce our property value by as much as $1000. This is in addition to the fact that the location of your high voltage power lines, a fuel pipeline and recent city trail has already reduced the value of our property below that of a comparable house on the west side of Blackhawk. We would appreciate a response to our questions before we allow you to proceed with this unwanted and perhaps, unnecessary taking of personal property.
