WITNESSETH WHEREAS, said Grantor is the owner of the tracts of land in the
City of Eagan, Dakota County, Minnesota, legally described as follows:
The East 15.00 feet (as measured at right angles to the east line) of Lots
2, 3, 4, and 5, Block 2, Lexington Square 4th Addition, on file and of
record in the office of the County Recorder, Dakota County, Minnesota.
NOW THEREFORE, the said Grantor in consideration of One C$1.00) Dollar and
other good and valuable consideration to it paid by Grantee, receipt whereof

all claims for any and all damages resulting to the landa through and across
which the parcel of land hereby conveyed is located by reason of the location,
grading, construction, maintenance, and use of a public trail over and upon
ihe premises hereby conveyed and from the uses incident thereto, and the said
City of Eagan shall have the right to use and remove all earth and other
materials lying within the parcel of land hereby conveyed and the right to
construct and maintain, upon the lands adjoining the parcel hereby conveyed,
such portable enow fencea during such months as weather conditione make

All stumps and other debria resulting from the clearing of the right-of-
way will be disposed of by Grantee by burning or otherwiae, according to law.
The Grantee shall have the right to post such signs and posters along said
trail as are deemed necessary and suitable to define the above lands and
locate them for public use.
