Trail Planned Development Agreement, revised prelininary pla[ approval and annual
planned development review. The APC recommendzd approval subjec[ to certain condi-
tions. There were concerns about storm sewer and lake levels in the area and about
the future construction oE parkin~ when needed across the stree[ from the condoniniu*~
units. I[ was su~gested that the timing of [he par'~ing would be required at the grant
of the building permit rather than do it in the future as needed because of the in-
ability to efiectively~ make a demand upon the then owners. There was considerable
discu;sion about the green space, the unstable soil in the area, and Councilnenbers
ohjected to the changes ttia[ were made [o the layout resultino in parking across
Erom the condo units. Mr. Baratz statzd that the developers would install additional
parking south of the condos if required by the Council. Parranto moved, Sdachter
seconded the mocion that the preliminary plat applica[ion be approved subject to the
follocain~:
1. Parking on [he lot south of the condominiums be increased to provide
additional parking adjacent to the building with a total of 225 parking spaces to
be required for the 90-unit condominium project and 150 spaces adjacent to the,
building;
2. That the parking lot lighting be required in the parkinp across the street
C:,% with automa[ic outdoor parking lo[ lighting required in tha[ lot; •
3. That no berm would be allowed between the parking and the 90-unit condo-
minium project so the vision for security would be obscured;
4. Tha[ allowance of parking across the street not be a precedent for future
mu3tiple housing cons[ruction;
5. That a11 other conditions of the Planning Commission be imposed;
6. Tha[ the property be co~non proper[y.and that [he parking lot be tied to
the condominium property with the unders[anding that there would be a homeosanezs
association wi[h comnonly owned property. All vo[ed in favor, escept Smith who votad
no. D 80-90
B. PL'D ~endment. Parranto moved, Wachter seconded the mo[ion to approve the
amendment to the PUD Agreement with a11 voting yes except Smith who voted no.
C. Annual Review. Egan moved, (Jachter seconded the motion, to approve the
