DRAINAGE AND TILITY EASENIENT
THIS EASEMENT, made this day of 2001, between TIMOTHY
J. and GINA DWYER (hereinafter referred to as "Landowner"), and the CITY OF EAGAN, a
municipal corporation, organized under the laws of the State of Minnesota, (hereinafter referred
to as the "City").
WITNESSETH:
That the Landowner, in consideration of the sum of One Dollaz ($1.00) and other good
and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, does
hereby grant and convey unto the City, its successors and assigns, a permanent drainage and
utility easement, over, across and under the following described premises, situated within Dakota
County, Minnesota, to-wit:
A permanent drainage and utility easement over, under, and across the north 10' of the
south 15' of Lot 5, Block 4, Evergreen Park Addition.
The grant of the foregoing permanent easement for drainage and utility purposes includes
the right of the City, its contractors, agents and servants to enter upon the premises at all
reasonable times to construct, recor.struct, inspect, repair and maintain pipes, conduits and maixis;
and the further right to remove trees, brush, undergrowth and other obstructions. After
completion of such construction, maintenance, repair or removal, the City shall restore the
premises to the condition in which it was found prior to the commencement of such actions, save
only for the necessary removal of trees, brush, undergrowth and other obstructions.
And the Landowner, its successors and assigns, does covenant with the City, its
successors and assigns, that it is the Landowner of the premises aforesaid and has good right to
grant and convey the easement herein to the City.

a regular meeting held on Wednesday, Sanuary 2, 1980, the off-sale
liquor license application that is in process was continued for
consideration until the January 15, 1980, mee*ing.
T'ie City Council is suggesting policy that off-sale intoxicating
livuor licenses will not be cons.idered unless the license is con-
_ sidered for.a specific location. It is my understanding that you
do have a specific location and are in the,process of negotiating
an agreement with a shopping center proprietor.

• Dear Mark and Pam:
In o£ficial action that was taken by the Eagan City Counicl at
a regular meeting held on Tuesday,.February 5, 1980, the application
submitted for an off-sale intoxicating liquor license was denied
due to the fact that the location of tne proposed off-sale liquor
establishment is not in compliance with the Eagan Intoxicating
Liquor Ozdinance #42, Section 42.05, Subdivision 8, which reauires
that no intoxicating liquor establishment cae be within 300 feet
of a church.
The City Attorney is working on language that will offer.some clari-
fication to the 300 feet provisjon in all tne liquor ordinances
as directed by the City Council.
I spoke with. Mr. iZichard Ravanbeck, representing the James Refri-
geration Company; and he Rentioned that James Refrigeration Company
may consider. an off-sale liquor establishment in Phase Two which
is that section oif the shopping center that wi11 be extended south
of the proposed Phase One project. Mr. Kavanbeck has submitted
a letter to my attention stating that he is in support of a liquor
store within his'establishment and is hopeful that the City can
clarify the issue of setbac'xs for the liquor establishments as
they per.tain to churches and schoois which would a11ow an off-sale
liquor license to b2 considered.for his shopping center.
I wi11 inform you as to the proposed changes that are prepared
by the City Attorney's office for the intexicating liquor ordinance.
These changes must be presented to the Czty Council for their review
and consideration.
