Dear Ms. Willey
Some time ago Tollefson Builders received a request from a Mr. Payne of
4858 Sheffield Lane,Eagan to have permission to construct a radio tower in
his yard. Since we are the developer of the sub-division Brittany in which
his home is located he would need our approval according to the covenants
of the area. These convenants are goverened by an Architectural Control
Committee.
It has been brought to our attention that Mr. Payne has put his request before
City Council for their approval.
Upon further information and our review of this information we have elected
to oppose the installation of this tower. Our reasons are the height of the
tower and his proposed location of the tower. Our covenants state that
all structures must also be in conjunction with the City of Eagan's regulations,
and we have been informed that the specifications of the tower are not within
the City standards. We therefore oppose the tower Mr. Payne is proposing.

APPLICATION SUMMARY
An application has been submitted by Timothy Payne requesting an
18.5' variance to the 37.5' height-limitation requirement in an
R-1 district.
Mr. Payne is a licensed amateur radio operator and would like to
place a 56' radio tower antenna next to his house in the side
yard. There are 30'-35' trees screening the side yard beginning
at the house setback line, and approximately 50' trees in the
side yard near the rear of the house. 'i'he majority of the rear
yard is heavily wooded and the slope is too steep to construct
the tower on.
The applicant has slelected the most feasible and well-screened
site on his lot to locate the antenna. The placement of the
tower/antenna would not impose on the drainage and utility
easement.
If approved,- the variance shall be subject to the following
conditions.
1. The antenna shall be unclimbable by design for the first
eight feet or completely surrounded by a fence in excess of
three feet.
2. No lights, relectors, flashers,.or other illumination devices
shall be permitted.
3. The tower shall be removed when the owner of the property
changes.

Onacceptable Utility Construction & 8asement Bncroachment
Dear Mr. Tollefson:
On October 24, 1985, a routine field inspection by City staff
identified the construction of an unauthorized retaining wall
within the existing utility easement over Lot 7, Block 1,
Srittany 6th Addition. I personally talked to the foreman on the
job and informed him that the referenced retaining wall must be
relocated to avoid encroachment within the dedicated easement.
Additional site investigation revealed an apparent encroachment
of the house under construction on Lot 5, Block 2, Brittany 7th
Addition.
As a result of this field inspection, a research of the building
permit application for Lots 4 and 5, Block 2, of Brittany 7th
Addition, revealed that the Certificate of Survey submitted with
the application incortectly referenced the side lot line utility
and drainage easements as being 5 ft, in width, instead of the
actual dimensions dedicated with the recorded plat of record.
Subsequently, on November 13, the City requested additional
information from your firm to verify the "asbuilt" information of
the houses undec construction and the existing sanitary sewer
lateral in relationship to dedicated easements and property
lines. (Copy enclosed.)
As a result of subsequent information submitted and reviewed by
the staff, it has been determined that the structure on Lot 4,
Block 2, of the 7th Addition, is approximately 5 ft. from the
center line of the sanitary sewer which is approximately 33 ft.
deep in that location. Due to conflicting information submitted
with the most recent "asbuilt" information, it is still uncertain
as to whether there might be a minor encroachment within the
dedicated side lot drainage and utility easement recorded as a
part of this plat.

This most recent information also verifies an encroachment of
approximately 3,0 ± ft. within the dedicated side lot drainage
and utility easement. This structure is approximately 12 ft.
from the center line of this 33 ft, deep sanitary sewer.
The incorrect location of the sanitary sewer line, depth of
excavation, moisture content of the backfill material and the
time of construction have raised serious questions pertaining to
existing and/or potential future settlement of this material,
which could affect the structures on Lots 4 and 5, Block 2, of
.the 7th Addition.
In addition, it appears the construction of the sanitary sewer
line is located outside of the dedicated utility easement along
the southerly portion of Lot 7, Slock 1, of the Brittany 6th
Addition. It also appears that the landscaping contractor did
not comply with the City's request to reconstruct the wood timber
retaining wall outside of the dedicated drainage and utility
easements as requested by myself on October 24.
It is our understanding that the occupancy permits have not yet
been granted for the referenced lots in the 7th Addition.
Therefore, this letter is to provide formal notice to you that
the City cannot, under these conditions, grant the Pinal
inspections or occupancy permits until the concerns addressed in
this letter are resolved to the City's satisfaction. Your most
recent petition to vacate that portion of the easement on Lot 5,
Block 2, 7th Addition, cannot be processed until this problem has
been resolved.
The City feels it is important that all individuals potentially
affected by this situation be informed as to these concerns.
In summary, it is important that the appropriate steps be taken
immediately to correc,t the errors that have taken place, and
also to compensate for what may be some very serious cnnditions
that could arise as a result of potential future settlement
occurring on the adjacent lots. Before the City can certify that
these dwelling units are acceptable for final occupancy, the City
will require that a document be drafted which would, in effect,
hold the City harmless from any claims that may arise at any time
in the future. The City will also require that this document be
recorded and filed with the County to run with the land as a
notice to all potential future buyers.

City Code Chapter 11, Section 11.40, Subd. 3, C states that the Council may grant a variance and
impose conditions and safeguards therein if:
1. The Council shall~determine that the speciat conditions appiying to the struciures or land
in question are peculiar m such property or immediately adjoining pmperty and do not
apply generally to other land or struciures in the district in which said land is located, and
that the ganting of the application is necessary for the applicant.
2. That granting of the proposed variance will not be contrary to the intent of this Chapter
and the Comprehensive Guide Plan.
3. 13at granting of such variance will not merely serve as a convenience to the applicant,
but is necessary to alleviate demonstrable hardslrip or difficutty.
