FACTS
• The subject site is an unplatted 5.07 acre pazcel that contains a single fanuly home
constructed in 1983 and a fenced 30 yd. X 50 yd. horse riding azena.
• All building setback requirements are met. A site inspection by the Protective Inspections
Division revealed no additional modifications would be required to meet the current code
criterion and a building permit will be required for a new concrete foundation for the
structure.
• A building permit for the foundation must be applied for and issued prior to construction.

AUTHORITY FOR REVIEW
Moving Permits - City Code Chapter 4, Section 4.10, gives the Protective Inspections Division
auihority to issue permits to move a building and authorizes the City Councii to issue a permit to
move a building to a location within the City. City Code Chapter 4, Section 4.10, Subd. 13 states
that a moving pemut shall be denied for any one of the following reasons:
A. the applicant has not complied with any requirement of this section.
B. persons or property in the City would be endangered by moving the building.
C. the building is in such state of deterioration or disrepair or is otherwise so struciurally unsafe
that it would constitute a danger to persons or property in the City.
D. the building is structurally unsafe or unfit for the purpose for which it is moved.
E. the equipment for moving is unsafe and persons and property would be endangered by its
use.
F. the building or its use would not be in compliance with zoning, building codes or other
provisions of the City Code.

JACK SKOGLUND - VARIANCE
~ Following a brief introduction by Administrator Hedges, Senior Planner Lisa Freese
presented City staffs evaluation of the request as outlined in the City staffs planning report dated
Apri125, 1996.
The applicant, Jack Skoglund, noted that the addition would be 19 feet from the right-of-
way line, but actually 35 feet from the roadway curb. Mr. Skoglund further stated that he agrees
to the sta8s recommended conditions. He further advised that it would not be possible to move
the garage addition back. Mayor Egan stated that this application is not similar, but in fact at the
opposite spectrum from the Heartland Homes variance request. Mayor Egan explained that ~
Heartland is a new subdivision with the majority of homes having three-car garages and that the
Heartland variance would bring the house up to the surrounding neighborhood standards.
Conversely, as Mayor Egan stated, the applicant is located in a mature subdivision where a
dominant number of the homes have oniy two-car garages. Therefore, as Mayor Egan siated, the
addition of the third garage would surpass the surrounding neighborhood standards. The applicant
responded that the addition of a third garage wouid not be inconsistent with the neighborhood
because a number of the homes do have three-car stalls. Councilmember Awada noted that adding
a three-caz garage may in fact bring the neighborhood standards up. Dave Wolf, a resident at
Coventry and Beacon, stated he supported the request for the variance because it would add to
the neighborhood and noted that he has a three-caz garage.
Councilmember Awada moved, Member Wachter seconded, a morion to approve the 11
foot variance to the required 30 foot setback from the public right of way for Lot 51, Block 6,
Beacon Fiill, (ocated at 4796 Beacon Hill Road, subject to the three conditions outlined in the

Councilmember Hunter stated that he would prepare a memorandum presenting proposed
policy language regarding implementation of a hazdship standazd for variances.

The appGcant was not present and no persons from the public were present to comment.
Mayor Egan indicated he had concerns that the barn proposed to be moved into Eagan would
~ adversely affect the neighborhood development and would be incompatible with future residential
use in the area. Councilmember Awada opined that the area in which the barn is proposed to be
moved should be left rural. She added that the location is private properry and if it is developed in
the future it will be the property owner's expense to remove the barn. Councilmembers Masin and
Wachter concurred. Councilmember Hunter reiterated that by the letter of the ordinance, the
Council should deny the request, but will support the applicant's request.

Council concurred that the matters would be heazd together.

PROJECT NO. 699 - SAFARI AT EAGAN 3RD ADDIT'ION
Following a brief introduction by Administrator Hedges, Public Works Director Tom
Colbert presented a brief history of the project. Mazk Hanson of Bonestroo, Rosene, Anderlik &
Associates, Inc. highlighted the project and outlined the project costs.
Byron Watschke, the developer for Safari at Eagan 3rd Addition pre]iminary plat,
expressed opposition to the cost allocation of the improvements. He stated that the right-tum lane
was recommended as a result of his development, but it will benefit all users of Thomas Center
Drive. He stated that the improvement is not a speciai benefit to his property, but a benefit to the
entire commercial development at Thomas Lake Center. Mr. Watschke expressed opposition to

SDBDIVISION ORDINAPCE
Mr. Colbert reviewed with the City Council the Subdivision Ordinance that
has been under study and ln the drafting stage for nearly two years. Numerous
meetings have been held with Planning Commission members, Couneil members,
Developers representatives and other interested citizens during this period of
time. The City Council reviewed the proposed Ordinance at its October 12
workshop meeting and the Planning Commission had submitted the Subdivision
Ordinance to the City Council and recommended approval. There was no further
discussion and no objections to the draft Ordinanee. Egan moved, Thomas
seconded the motion to approve the Subdivision Ordinance as submitted and to
order its implementation and publication. All voted yes.

NAiER TRSA2l~ENT PLANT PROJECT
On July 20, 1982, the City Council decided to install a water treatment
system for the City. City staff and Public Works Committee have been re-
viewing several.proposed treatment processees and existing plants have been
toured, including the Cities of Hurnsville and Plymouth. The City Council
members at a workshop meeting on Oetober 12, 1982 determined that a gravity
system water treatment plant would be preferable and a time sehedule has now
been prepared for authorization of preparation of plans and the advertisement
for bids, award of contract, construction and a completion date of September
to October of 198~7. Construction would take place on City property at
Coaehman Road and Yankee Doodle Road and it was recommended tHat the firm of
Bonestroo, Rosene, Anderlik ~ Associates be engaged to design and do the
engine~ring services for the plant. Councilman Waehter stated he had mixed
emotions about voting on such an extensive pro,ject without a referendum, but
stated that there is clearly a need for the improvement and favored the
Council's action to proceed with the pro~ect. Wachter moved, Thomas seconded
the motion to authorize construction of the 12 m.g. gravity filtration water
treatment plant as authorized in the July 20, 1982 City Council Resolution and
that the firm of Honestroo, Rosene, Anderlik & Associates be engaged for
design and engineering services as provided in their proposal and the Contract
to be entered into with the engineering fira. All voted in favor.

The application of Richard Buchan for waiver of plat to split off one
homestead and create a five aere parcel on the Buchan property on Dodd Road
xas then considered by the Council. Mr. Buchan was present and explained the
reasons why he asked for the split. The Advisory Planning Commission recom-
mended approval subject to certain conditions. There were no ob,jections and
after consideration, Egan moved, Wachter seconded the motion to approve the
~ application for Waiver of plat, sub,ject to the Pollowing conditions:
1. Only one home shall be allowed on the 5-acre parcel and this home
shall be located within one of the lots proposed on the overlay plan.

-The application of Mr. and Mrs. Elmer Scott for preliminary plat approval
of Clarkson Place on Highway ~3 was then brought before the Council. Mrs.
Scott was present and the Advisory Planning Commission recommended approval
sub,ject to certain conditions. It was noted the exisEing driveway on Lot 2
would be used for both lots and eventually 3ccess would be installed at the
property lines between Lots 1 and 2. The topography is very rough at the
present time and after consideration, Smith moved, Thomas seconded the motion
to approve the application subject to the following conditions:
1. An easement be grantd to Lot 1 from the southerly access on Lot 2 to
provide access.
2. IP Lot 1 is sold for the storage of refuse trucks and a building is
constructed for this storage, no other construction or development shall be
alloNed on these lots until such time that utilities are provided to the site.
3• The access to Lot 2 shall be graded and a slope approved by the..City
Engineer and the disturbed area should be seeded in order to prevent soil
erosioa.
4. There shall be adequate screening provided to the City's satisfac-
tion for the two sto^age arsaa.
