This easement, made t}ils Y4N ' day of 'tGW3C~, 2002, between Manley Land
Development, Inc., a Muuiesota corporatioq (hereinafter refecred to as "I,andowner") and the Ciry of
Eagan, a Mmnesota municipal corporatioq organized under the laws of the State of Mnnesota,
hereinafter referred to as "City".
WITNESSETH:
T'hat the Landowner, in consideration of the sum of One Dollar ($1.00) and other good and
valuable consideration, the receipt and suffiaency of which is hereby aclrnowledged, does hereby grant
and convey unto the City, its successors and assigns, forever, a trail easemern over, under and across
the following described property to wit:
A Uailway easemecrt 10.00 feet in width over and across I,ot 5, Block 1, Natures Edge, Dakota
County, Ivfinnesota, described as lying 10.00 feEt north and northwesterly of the following
descdbed line:
Beginning at the most easterly corner of said Lot 5, thence South 40°03'48" West along the
southeastedy lot line of said Lot 5 a distance of 107.51 feet, thence southwesterly 26.15 feet
along a tangential curve concave to the northwest having a radius of 30.00 feet, and a cenual
angle of 49°56' 12"; thence due West to the West line of said I.ot 5 and there tenninating.
The sidelines of said easemern are prolonged or shortened to terminate on the property lines of
said I.ot 5.
The grant of the foregoing peananent easement for trail purposes includes the right of the City,
its contractors, agerns and servants to construct, reconstruct, inspect, repair and maintain a sidewalk
and/or trail and erect and maintain signs in conjunction with the public's use of said sidewalk and/or
trail and any signs erected in conjunction with the use of the sidewalk andlor riail.
This Easement shall iun with the land and be a continuing encumbrance and seivitude on Lot 5,
Block 1, Natwe's Edge, and shall be binding on Landowner's successors and assigns, including azry
subsequent holder of mortgages.
And the Landowner, for itseif and its successors and assigns, dces covenant with the City, its
successors and assigns, that it is the fee owner of the lands and premises aforesaid and has good right
to grant and convey the easemerns herein to the City.
IN TESTIMONY WF3EREOF, the Landowner has caused this easement to be acecuted as of
the day and year first above written.
