The foundation ~vall was inspected on November 10, 2000. The basement was believed to be unfnished when the home was constructed. The original owner is l~etieved±o have finished a~rtion of the basement, i~cluding a family roorr~ at a later date_ At the present time, a bedroom is in process of completion, ~vhich also c~ntains a partion of The rear ~uall. ~ The visible portion of #he b(ock «~all in the bedroom under construction was found to be leaning inward at the top. The measurements indicate th~ top of the fo:utdation wail leans im~~ard approximately 1.5° - 2". The frame ~+,~all above lear.s eutward apgreximatei}~ 2-114". The adjoinin; finished room was found tb have similar eonstruetion. The ~vindows are instalted in a canted frame walL The finished walis are plumb, so the offsPt shows in the window frames. It appears that the foundation wall was not ad~quately braced during backfill operations and the soil andlor equipment ferces caused the block ~~al! ko lean inward. instead ~f rebuilding the wall, the frame wall was canted out to compensate for the lean. ConsYruction at the corners indicates that the f.*ame wal! was built in this fashion and no± dispIaced after consYructian. This was necessary to square the found»tion for pr;~per p?acement of ihe Floor joists. How- ever, because the garage was located in front of a family room, the varianee did not appear to be noticeable and reco~mended approval of the variance. i There were no objections and because of the_ misunderstanding and the hardshio involved, noting the builder had found the error and requested staff approve a variance, Smith moved, Egan seconded the motion to grant the variance because of the hardship involved with the understanding that Lot 13 would be required to have a 10 foot setback and that the garage be located adjacent to the Lot 14 property line. SONShT 3~1 ADDITION - PRE7.Il'IINARY PLAT AND REZOI~IING The application of Tri-Land Company for rezoning and preliminary plat approval of Sunset 3rd Addition was submitted to the Council. The Advisory Planning Commission recommended approval of the application to rezone from Agricultural to Single Family and for preliminary plat approval. Mr. Runkle presented the application to the Council and noted that Lot 7 which includes the existing homestead, consists of 3 acres and stated it uould be very difficult to subdivide that parcel. Brad Swenson was present and furthar stated that Lot 7 cannot feasibly be subdivided, but it aas suggestxd the plan for subdivision be submitted prior to final plat approval. Egan moved to approve the rezoning of the property as requested, Thomas seconded the motion. All voted in favor.
