WHEREAS, Petitioner Eleanor E. Weber ("Petitioner") is the owner
of a parcel of land in the City of Eagan with the Property
Identification No. of 10-58500-030-00 ("Subject Property"); and
WHEREAS, on July 2, 1991, Respondent City of Eagan ("City")
assessed the Subject Property a total sum of $2,402.74 for street
area as part of Public Improvement Project No. 543R; and
WHEREAS, Petitioner brought an action in District Court appealing
the sum of the assessments for Project 543R, known as Eleanor E.
Weber v. City of Eagan; Court File No. C8-91-7945; and
WHEREAS, the parties have resolved all dispute over the
assessments against the Subject Property.
NOW, THEREFORE, the parties do hereby agree as follows:
1. The assessments levied against the Subject Property for
Project 543R shall be reassessed in the sum of $0.

3. The City shall direct the Dakota County Treasurer to
recompute Petitioner's real estate tax statement using the new
assessment figure of $0 for assessments related to Project 543R.
4. The Petitioner waives Notice of Hearing and Hearing on the
reassessment of the Subject Property.
5. Upon the execution of this Stipulation, the Petitioner shall
cause this action, Court File No. C8-91-7945 to be dismissed with
prejudice.

PLEASE TAKE NOTICE that the Petitioner/Appellants herein,
Eleanor E. Weber

property located at: 2870 Sibley Hills Drive ,
hereby appeal to the above-named District Court from a special
assessment in the amount of $2,402.74, as and for Project Number
1OP543R (Sibley Hills Drive/Skyline Road - Streets and Utilities).
The nature of the Petitioners'/Appellants' claim is and the
grounds of this appeal are: 1) that there was no benefit to the
assessed property as a result of Project 543R; 2) the special
assessment exceeds the special benefits to the property and is
therefore a taking of property without fair compensation in
violation of the 14th Amendment; and 3) that said assessed property
has been improperly, unfairly and unequally assessed, in violation
of Minn. Stat. 429 and the 14th Amendment.
WHEREFORE, Petitioners/Appellants pray for the judgment of
this Court as follows:
1. That the Special Assessment Role be reviewed and
corrected, and that the assessment of Petitioners'/Appellants'
property be stricken from the Roll, or be reduced to a proper amount
and properly equalized with the assessments of other real properties
on the same Roll;
2. That this Court take evidence, or cause evidence to be
taken, to enable Petitioners/Appellants to show the illegality,
over-valuation, inequality, and error of the special assessment of
the real property of Petitioner/Appellants; and
3. That the Court grant such other and further relief as may
be just and as the nature of the case requires, together with the
costs and disbursements of this proceeding.

Minnesota, a municipal corporation,
Respondent.
WHEREAS, Petitioner Eleanor E. Weber ("Petitioner") is the owner
of a parcel of land in the City of Eagan with the Property
Identification No. of 10-58500-030-00 ("Subject Property"); and
WHEREAS, on July 2, 1991, Respondent City of Eagan ("City")
assessed the Subject Property a total sum of $2,402.74 for street
area as part of Public Improvement Project No. 543R; and
WHEREAS, Petitioner brought an action in District Court appealing
the sum of the assessments for Project 543R, known as Eleanor E.
Weber v. City of Eagan; Court File No. C8-91-7945; and
WHEREAS, the parties have resolved all dispute over the
assessments against the Subject Property.
NOW, THEREFORE, the parties do hereby agree as follows:
1. The assessments levied against the Subject Property for
Project 543R shall be reassessed in the sum of $0.
ORDER FOR JUDGMENT
Based upon the foregoing stipulation entered into by and between
the City of Eagan and Eleanor E. Weber;
IT IS THEREFORE THE ORDER OF THE COURT THAT JUDGMENT BE ENTERED
FORTHWITH.

I received the enclosed post card on March 13 requesting
reimbursement by the City of Eagan for $25 for costs incurred by
you during the period of water outage while the City tried to
repair a broken water main in your neighborhood.
In order for the City to process your claim for reimbursement, you
must provide the City with a copy of the invoice and/or a receipt
indicating the amount you paid for those services. This
information should be attached to the enclosed Claim Voucher and
returned to my attention for processing.
I apologize for the inconvenience that you incurred during the
period of water outage. It seems water main breaks never occur
during a convenient period for either the affected homeowners or
our maintenance personnel who do their best to try and repair them
as quickly as possible.
Thank you for your patience and understanding during this
unfortunate incidence. If you have any questions, please feel free
to contact me and I will help you with this or any other concerns
you may have.
