WHEREAS, Petitioners Carl W. Glewwe and Carol J. Glewwe

("Subject Property"); and
WHEREAS, on July 2, 1991, Respondent City of Eagan ("City")
assessed the Subject Property a total sum of $2,402.74 for street
area as part of Public Improvement Project No. 543R; and
WHEREAS, Petitioners brought an action in District Court
appealing the sum of the assessments for Project 543R, known as Carl
W Glewwe and Carol J Glewwe v City of Eagan; Court File No.
C6-91-7944; and
WHEREAS, the parties have resolved all dispute over the
assessments against the Subject Property.
NOW, THEREFORE, the parties do hereby agree as follows:
1. The assessments levied against the Subject Property for

assessment exceeds the special benefits to the property and is

therefore a taking of property without fair compensation in
violation of the 14th Amendment; and 3) that said assessed property
has been improperly, unfairly and unequally assessed, in violation
of Minn. Stat. 429 and the 14th Amendment.
WHEREFORE, Petitioners/Appellants pray for the judgment of
this Court as follows:
1. That the Special Assessment Role be reviewed and
corrected, and that the assessment of Petitioners'/Appellants'
property be stricken from the Roll, or be reduced to a proper amount
and properly equalized with the assessments of other real properties
on the same Roll;
2. That this Court take evidence, or cause evidence to be
taken, to enable Petitioners/Appellants to show the illegality,
over-valuation, inequality, and error of the special assessment of
the real property of Petitioner/Appellants; and
3. That the Court grant such other and further relief as may
be just and as the nature of the case requires, together with the
costs and disbursements of this proceeding.

Dear Mayor Egan:
We hereby assert our objections to the above referenced
assessment and notify you of our intent to oppose it by all legal
means. The basis for our protest includes our claim, among
others, that the value of our property has not increased as a
result of the project, but has in fact been decreased. Also, we
cannot understand or accept the reasoning that assigned the full
costs of the upgrading of our street, Sibley Hills Drive, to the
abutting properties and now asks us to also pay part of the cost
for upgrading of a remote street, Skyline Drive.
