temporary. Mr. Leitner appeared and had no objection to the recommendations of the
Planner. Hedtke moved and Blomquist seconded the motion to recommend approval of
the application on a temporary basis for a maximum of 5 years or until the property
is developed to its full potential; further subject to the following conditions:
1. That the proposed storage garage be dlsassembled'and removed from the property
at the end of the 5 year period maximum unless specifically extended by the APC
and the City Council.
2. That the proposed structure meet all requirements of the building code and
other applicable ordinances.

RIGHT-OF-WAY AND DRAINAGE AND UTILITY EASEMENT
IN CONNECTION WITH EAGAN CITY PROJECT NO. 615R
This Easement Agreement, made this 3rd dayof October 1996, between
GEORGE M. LEITNER and COLLEEN V. LEITNER, husband and wife, hereinafter
collectively referred to as "Landowner"; ARNOLD J. LEITNER and LILLIAN B.
LEITNER, husband and wife, hereinafter collectively referred to as "Mortgagee" and the
CITY OF EAGAN, a Minnesota municipal corporation, organized under the laws of the State
of Minnesota, hereinafter referred to as "City'.
WITNESSETH:
That the Landowner and Mortgagee, in consideration of the sum of Four Thousand
and no/100 (54,000.00) and other good and valuable consideration, the receipt and
suriiciency of which is hereby acknowledged, do hereby grant and convey unto the City; its
successors and assigns, forever, the following easement:
A perpetual easement for public right-of-way, drainage and utility purposes
over, under and across the South 30.00 feet of the following described parcel:
All that part of the South % of the NE '/4 of the NE'/4 of Section 8, Township
27, Range 23, described as follows:
Commencing at the intersection of the Easterly right-of-way line
of the Chicago, St. Paul, Minneapolis and Omaha Railroad, with
the south line of said Quarter Quarter; thence East along said
South line 200.0 feet to the point of beginning; thence
Northeasterly and parallel with said railroad right-of-way a
distance of 290.0 feet; thence west parallel with said South line
200.00 feet to said right-of-way line; thence Northeasterly along
said right-of-way line a distance of 552.15 feet to its intersection
with the North line of the South % of said Quarter Quarter;
thence East along said North line 192.15 feet to the NE comer
of South %; thence South along the East line of said South 1/7 a
distance of 176.78 feet; thence Southwesterly and parallel with
said railroad right-of-way a distance of 619.45 feet to said South
line; thence West along said South line 134.25 feet to the point
of beginning.
Said easement contains 0.09 acres, more or less.
The grant of the foregoing permanent easement for right-of-way and utility purposes
includes the right of the City, its contractors, agents and servants to construct, reconstruct,
inspect, repair and maintain a roadway and erect and maintain signs in conjunction with the
public's use of said roadway and appurtenances and any signs erected in conjunction with the
use of the roadway and appurtenances.

The grant of the foregoing permanent easement for drainage and utility purposes
includes the right of the City, its contractors, agents and servants to enter upon the premises
at all reasonable times to construct, reconstruct, inspect, repair and maintain pipes, conduits
and mains; and the further right to remove trees, brush, undergrowth and other obstructions.
After completion of such construction, maintenance, repair or removal, the City shall restore
the premises to the condition in which it was found prior to the commencement of such
actions, save only for the necessary removal of trees, brush, undergrowth and other
obstructions.
And the Landowner and Mortgagee, for themselves, and their heirs and assigns, do
covenant with the City, its successors and assigns, they are the fee owner and mortgagee of
the lands and premises aforesaid and have good right to grant and convey the easement
herein to the City.
IN TESTIMONY WHEREOF, the Landowner and Mortgagee have caused this
easement to be executed as of the day and year first above written.

1969: Business started as a black dirt storage and distrilnution center.
No mining is done.
8-1-78: Mining permit under aTEnded Ordinance 8 is granted.
9-26-78: Building permit on unplatted property granted by A.P.C.
10-3-78: Building permit approved by Eagan City Council for a 30' x 32' steel
building for equipment storage.
Black dirt is obtained from excavations where there is a surplus. It is then
distributed as top soil for new yard and lawn work as needed. I met with Mr.
Initner on Tlnsday, May 11, 1982 at the site and my inspection did not reveal any
signs of erosion or siltation that was not contained on this site.
Mr. Leitner also informed me that the business only generates 6 to 8 trips a day
from the site. In my opinion, the operation meets the intent of Ordinance 8.

REQUEST FOR UTILITY IMPROVEMENTS
I/We hereby request of the Board of Supervisors, Eagan Township,
Minnesota, utility improvements on and over property owned by me/us as
follows: (Mention type of improvement, e.g.?water, sanitary sewer, etc.)
The location of said utility improvements shall be generally as follows:
I/We hereby waive notice of any and all hearings necessary for the
installation of said improvements and further consent to any assessments
necessarily levied by the Township of Eagan for such improvements.
I/We further agree to grant to the Township of Eagan any easements neces-
sary for the installation of such improvements.
It is further understood that this request shall be reviewed by the Board
of Supervisors of Eagan Township or its agent and I/we will be given reasonable

owned by you in Fagan. This year the Fagan City Council has requested addi-
tional information about the operation before they will renew the permit.
The questions raised were: How are you protecting the lake formed by Alex-
ander's gravel pit from infiltration? How much of the stockpiled black dirt
is mined on the site? How much is brought in from other areas? How much
black dirt do you anticipate mining on the site in 1982?

SUBJECT: ARNOLD LEITNER GRAVEL PERMIT LICENSE
The City Council again continued the Arnold Leitner gravel permit license
annual renewal for 1982. I explained to the City Council that this permit
is not for mining; it is merely for a stockpiling and storage situation.
However, they questioned where the gravel came from and also the condition
of the adjacent lake. This particular issue has become more complicated
than I thought it would, and, therefore, I would like to become involved
with your review.
It might be well that we make a visual inspection of the gravel storage
as it exists. I would also like for you to contact Mr. Leitner and ask
him where he receives his gravel and whether he knows anything about
the condition of the lake adjacent to the gravel storage piles. Apparently,
the City Council is concerned that the lake may become an attractive
nuisance and may be suggesting some type of screening, signage or other
cautionary measures adjacent to the gravel pit stockpiles.

This is a black dirt raining, stockpiling and distributing operation.
It is screened by railroad tracks to the west, a timbered area to the
north, oil storage tanks to the south and there is a single family
dwelling to the east that has been there longer than the mining opera-
tion. The railroad tracks dam off any run-off to Alexander Pond except
for a concrete culvert under the tracks.
A questionaire has.been sent to Mr. Leitner for more of the information
you have requested.
