All parcels of the Project Area are within the same drainage district established by the City of Eagan. 5. The Holman, Corner and Lahr parcels had not previously been assessed for a lateral storm sewer project. 6. The fair market value of The Holman Parcel, parcel no. 10-68050-020-02CI and the Corner Lot, parcel no. 10-68050-010- 02CI combined prior to the City of Eagan Improvement Project No. 578 was $294,400.00. 7. The fair market value 10-68050-020-02CI and the Corner 02CI after completion of City 578 was $325,000.00. of The Holman Parcel, parcel no. Lot, parcel no. 10-68050-010- of Eagan Improvement Project No. 8. The fair market value of The Lahr Parcel, parcel no. 10- 68050-011-02CI prior to completion of City of Eagan Improvement Project No. 578 was $97,465.00. 9. The fair market value of The Lahr Parcel, parcel no. 10- 68050-011-02CI after completion of the City of Eagan Improvement Project No. 578 was $108,000.00. 10. The fair market value of the Holman Parcel, The Corner Lot and The Lahr Parcel increased as a result of the City of Eagan Improvement Project No. 578. 11. The special benefit to The Holman Parcel and The Corner Lot was $5,457.00 per acre. The special benefit to the Lahr Parcel was $5,164.00 per acre. 12. The Appellant claims costs and disbursements under M.S. 429.081 for expert witness fee of $2,000, plus other disbursements (see counsel's affidavit) in the amount of $427.85, all of which are fair and reasonable for the prosecution of this appeal. CONCLUSIONS OF LAW 1. The assessment formula adopted by the City of Eagan was adopted pursuant to Minnesota Statutes Chapter 429 and was not arbitrary and capricious. 2. The completion of the City of Eagan Improvement Project No. 578 did increase the fair market value of The Holman Parcel, 6 The Corner Lot and The Lahr Parcel. 3. The maximum special benefit to The Holman Parcel and The Corner Lot when put to their highest and best use is $5,457.00 per acre. 4. The maximum special benefit to The Lahr Parcel when put to its highest and best use is $5,164.00 per acre. 5. The City of Eagan shall reallocate the special assessment at the rate of $5,457.00 per acre for Holman and corner lot parcels, and $5,164.00 for Lahr Parcel with the resulting special assessments as follows: The Holman Parcel $19,864.00 Parcel No. 10-680507020-02CI The Corner Lot 511,133.00 Parcel No. 10-68050-010-02CI The Lahr Parcel $10,535.00 Parcel No. 10-68060-011-02CI 6. In support thereof, the Petitioner pleads the following objections, defenses and allegations: 1. Petitioner is the contract for deed purchaser, equitable title holder of and taxpayer for real property in the City of Eagan, Dakota County, Minnesota described as: That Part of Lot 1, Block 2, Sibley Terminal Industrial Park, lying southeasterly of a line which lies 250 feet northwesterly and parallel to the southeasterly line of said Lot 1. Parcel No. 10-68050-011-02 2. The Eagan City Council met on June 4, 1991, and at that time approved a special assessment for improvement Project No. 578 against the Petitioner's real property in the amount of $18,563.63 for storm sewer laterals. 3. That Petitioner is a person aggreived by the adoption Q '° M ?•3? c1J of the special assessment set forth above. 1 4. That by notice of objection filed with the City Clerk of the City of Eagan (Exhibit A attached hereto) and by objection interposed at the time of hearing on June 4, 1991, the Petitioner has complied with the requirements of Minnesota Statutes Section 429.061. 5. That the special assessment against Petitioner's real property is unfair, unreasonable and in excess of the benefits received by such property from the improvement. 6. That a portion of the special assessment described above represent costs not properly related to the improvement and/or incurred through negligence; such special assessments are therefore unfair, and unreasonable. 7. That the manner in which the special assessment has been apportioned among the properties alleged to have been benefited by the improvement, which the City claims to include the Petitioner's property and additional property within the assessment area described as: Lots 1 through 5, Block 1 and Lots 1 and 2, Block 2, Sibley Terminal Industrial Park, Dakota County, Minnesota is unfair, and unreasonable. 8. That the special assessment is, as to Petitioner in all respects unfair, unreasonable and contrary to the requirements of Minnesota Statutes Chapter 429, due process and equal protection of the law under the Fourteenth Amendment of the Constitution of the United States, and Section 7 of Article I and Section 1 of Article X of the Constitution of the State of Minnesota. 11 4 WHEREFORE, Petitioner prays that the district court order as follows: 1. That the court set aside, reverse and vacate the assessment against the real property of Petitioner and order a reassessment as provided in Minnesota Statutes S 429.071 Subd. 2 in an amount substantially less than the amount currently allocated to the Petitioner's property. 2.
