RE: BUILDING PERMIT AUTHORIZATION
Staff has received an application for a building permit by Mr. Halladay
_who presently owns Roadway Custom Trailers located at 3248 Terminal Dr.
Presently, Roadway Custom Trailers has a 10,320 square foot building and
is proposing to construct a secondary building consisting of approximate-
ly 2,000 square feet for the storage of scrap material. It is staff's
understanding that the building would be a pole building or steel build-
ing located at the northerly edge of the lot. In calculating the exist-
ing building and the proposed building, the lot coverage is approximately
16%, or under the miniumun lot coverage requirement in an industrial dis-
trict.
The concern staff has is in regard to the secondary building for the stor-
age of materials. The ordinance isn't specifically clear in regard to
issuing permits for more than one building per lot. Therefore, for clar-
ification, staff would like the permit to be authorized by the City Coun-
cil instead of staff issuing the building permit.
As you may be aware, there is a substantial amount of outside storage in
this general area and the industrial park does not meet the requirements
set forth in ordinance #52 in regard to landscaping, concrete curbing,
bituminous surface or driveways and parking areas, etc. Therefore, in is-
suing the building permit, would the applicant have to adhere to the land-
scape requirements, concrete curbing, etc. or can the permit be issued be-
cause the proposed building is hblping to clean up the area by putting
scrap materials inside of a building rather than storing the materials out-
side?
Staff is asking for direction from the city Council either to issue or
not issue the proposed building permit for the storage building which would
contain approximately 2,000 square feet.

Dear Mr. Thiel:
We have had an opportunity to discuss numerous times the
need for an easement for sewer and water for my client,
Mr. Richard Halladay, which would necessitate an easement
over the west 20 feet of a tract of land owned by your
client, Edina Engineering Company (Mr. Edward Steinbauer).
In light of my client's inability to obtain an easement for
sewer and water, we presented the Eagan Village Council with
a request to implement an individual well and drain field to
remedy our immediate and urgent need for sewer and water to
facilitate Mr. Halladay's business, Roadway Custom Trailers,
which is presently in operation and has been doing business
for the past few weeks. Our urgency is further predicated
on the rapid changes of weather with winter just around the
corner.
My client, Mr. Richard Halladay „ has obtained an estimate
from a local surveying company which has indicated that the
establishment of the lot line may cost him up to $700. He
is willing to establish the lot line and pay any and all
costs that a surveyor may require to accomplish the location
of the lot line (the southwesterly lot line of your client's
tract) for the purposes of installing sewer and water from
Terminal Drive on and across your client's tract of land so
as to connect to the Halladay tract. My client will pay
such costs if he has reasonable belief that he can obtain
an easement for sewer and water from your client. However,

previously you indicated that you could give me no guarantee
that such an easement would be granted.
My client also renews his offer to allow Edina Engineering,
Inc. to select a qualified real estate appraiser with an
MAI designation to estimate the damages or value of said
easement for sewer and water purposes. The selection of
such an appraiser may be made by your client and may be
anybody that you wish to select of your own choosing that
is certified as an MAI. My client shall agree to pay the
full costs of any such appraiser that you select. In addi-
tion, my client would agree to pay the full damages or value
of said easement that such appraiser would indicate.
In light of the above may I ask:
"Will Edina Engineering, Inc. grant Mr. Halladay
an easement for sewer and water?"
May I hear from you as soon as possible. Thank you very
much for your attention to this matter.

Reference is made to my previous correspondence relating to problems with
access and easement for sewer and water.
I have attached some of my correspondence to John Thiel, attorney for Edina
Engineering, and Mr. Ed Steinhauer. According to my telephone conversation
with Mr. Steinbauer's attorney on October 21, 1973, it is now apparent that my
client, Mr. Halladay, is not going to obtain an easement for sewer and water from
Mr. Steinbauer who owns the land between Mr. Halladay's property and the r-o-w
which has public sewer and water. If the Village of Eagan wishes to intervene and
obtain an easement, Mr. Halladay will immediately thereafter hook up.
I have enclosed a picture looking south across Mr. Halladay's tract and showing
the Steiner business operation on the right in the picture. Mr. Halladay contacted
Mr. Steiner about an easement but, as you can see from the picture, it would
necessitate tearing up a long hard-surfaced 'driveway or, if placed on the lot line,
taking down chain link fence. We are unable to obtain an easement on the lot
line anyway. Also, the sewer load generated by Mr. Halladay and his neighbor
(who would build) would be too much to handle if and when Steiner hooks up.
We have also considered the Holman property to the west, but his land is partly
improved with a black top parking lot and the long circuitous route would result .
in a prohibitive cost.

I specifically request permission for Mr. Halladay to be allowed to put in his own
well and drain field immediately, before the cold weather precludes same. He
has just completed a substantial building and is now operating without sewer and
water. Without sewer and water he will be severely hampered in his operation
and will be irreparably damaged.

Dear John:
I contacted Registered Land Surveyor and find it would be
seven to ten days before they could accomplish project.
Also, they believe stakes and monuments have been removed
and disrupted in this area. Do you know if Tor. Steinbauer
could locate stake near R-O-W of Terminal Drive Road.
The contractor to be utilized by Mr. halladay indicates
there is not adequate room to excavate between telephone
poles and Steiner fence; therefore, placement of sewer and
water on Steiner's property does not appear feasible. So
we may be back where we started.
How much does Mr. Steinbauer want for sewer and water ease-
ment on and across the 20-foot temporary strip?

RICHARD_HALLADY - ROADWAY CUSTOM TRAILERS - BUILDING PERMIT
An application of Richard Hallady who owns Roadway Custom Trailers at
3248 Terminal Drive, for building permit for a 2,000 square foot secondary
building on the property for storage purposes was considered by the Council.
Mr. Hallady was present and it was noted that the application appears to
conform with the Ordinance except for the interpretation of the additional
building on the property. It was noted, however, that it is not a primary
building and Smith moved, Egan seconded the motion to authorize the building
permit and not require the full concrete curbing and landscape requirements,
noting that the property abuts Highway #13 and it would be desirable to
enclose the storage material in an enclosed building; further, however, it is
not interpreted as a variance. All voted in favor.
SWIMMING POOL ORDINANCE
A proposed draft of a Swimming Pool Ordinance that has been requested by
property owners in the City was reviewed by the City Council. Councilmembers
were concerned about drainage onto neighboring owners property and there was a
suggestion that a dry well be installed in the event that the drainage cannot
be retained on the owner's property. After discussion, Wachter moved, Egan
seconded the motion to continue the consideration of the Ordinance to allow
the staff to submit revisions noting that percolation tests may be required
for the definition of the size of the dry well. All voted in favor.
CONTRACT #82-13 - BRITTANY 4TH AND SAFARI RESERVOIR 1iATERMAIN
The bids for Project #364, Brittany 4th Addition Trunk Water Main and
Project #366-I, Safari 4.0 M.G. Water Reservoir Water Main were opened on
October 27, 1982 and the bids were submitted to the Council. It was
recommended that the low alternate bid of $68,367.00 From Encon Utilities,
Inc. be accepted to include additional grading, together with a temporary
construction easement from an adjoining owner. Smith moved, Wachter seconded
the motion to approve the low alternate bid with Encon Utilities, Inc. and
authorize the execution of a contract. All voted in favor.
CONTRACT #82-14 - SAFARI WATER RESERVOIR
The plans and specifications for Contract #82-14 consisting of Project
#366-II for the Safari 4.0 M.G. Water Reservoir were submitted and it was
recommended that they be approved. There was an alternate with "Eagan"
wording on the reservoir tower. Upon motion by Wachter, seconded Smith, it
was resolved that the plans and specifications for Contract #82-14 be approved
and the Clerk be authorized to advertise for bids to be opened at 10:30 a.m.
on Thursday, December 2, 1982 at the City Hall. All voted yes.
SAFARI ROAD ACCESS AGREEMENT
It was recommended that a Joint Use Agreement with Mr. and Mrs. Michael
Patten, dated October 27, 1982 concerning access to the Safari Water Reservoir
site be approved. A copy of the Agreement was distributed to the Council.
