We have started our review of the construction documents submitted in pursuit of
obtaining a building permit for the above-referenced project. This review is not
intended to be an exhaustive and comprehensive report. Unless otherwise noted, all
references are to the 2006 I.B.C. It is our goal that this review will help you in
complying with the applicable codes and we are, therefore, requesting that the
following items be addressed:
1. Provide a SAC determination letter from the Met Council. Please direct your SAC
questions to Karon Cappaert @ (651) 602-1118.
2. Provide a Code Analysis (example enclosed).
3. Provide elevation drawings including any grade height differences from the patio
surface and the surrounding grade (IE: parking surface).
4. If you are providing a heat source, please submit the type of heating units being
used along with their manufactured specifications.
5. If the design occupant load requires that the patio have two (2) exits, (Table
1015.0 of the 2006 IBC) both means of egress from the patio will have to be
accessible per Section 1007.1 of the 2006 IBC.

The application for a sign permit to the Valley Lounge, 3385
Sibley Memorial Highway was received. Upon motion by Supervisor Rahn
and seconded by Supervisor Jacobson, it saes RESOLVED that said sign
permit be approved.
Rids had been received from several companies for a 12 HP
tractor with mower. Upon motion by Supervisor Jacobson, seconded by
Supervisor Rahn, it was RESOLVED that a Simplicity Sovereign Tractor,
12 HP, variable speed with a 48" mower be purchased from Arrow Mower
Service in So. St. Paul for $925.00 delivered, from the Seuer and Water
Fund.
Upon nation by Supervisor.Jacobson and seconded by Supervisor
Rahn, it was RESOLVED that a Spartan trailer flat bed, 51" wide, S' long
be purchased from Arrow Mower Service for $174.95 from the General Fund.
Arnold Carlson appeared requesting permission to install a
package type sewage treatment plant in Evergreen Addition to Carlson
acres. After considerable discussion, the above matter was tabled until
the June 4th regular meeting.
The request of Cedar Grove Construction Co. to install a small
section of storm sewer and a catch basin in Cedar Crest in the cul de
sac between Lot 4 & Lots 2 & 3 was then discussed. Upon motion by
Supervisor Rahn and seconded by Supervisor Jacobson, the above improve-
went was approved.
Relocation of fire hydrants for Pilot Knob Elementary School
was then discussed. It was the feeling of the Boa_d that the Township

Our office appeared on behalf of the City of Eagan in prosecuting the matters
of James Tousignant and Ronald Smith. I am not sure whether Mr. Tousignant is
involved in the holding of the license for Valley Lounge, however, in this
instance both Mr. Tousignant and Mr. Smith served beer to Officer Kevin
McGrath acting as an undercover officer. The beer was served prior to the
legal opening hour as prescribed by Eagan Ordinance.
Both of these matters were disposed of by the defendants tendering a plea of
guilty (offering an admission to the charge) which plea was not accepted by
the Court, but rather the matter was continued for a period of one year on
conditions that each individual pay $100 in court costs and that there he no
similar violations during that period of time.
Our office initially took a strong approach in these matters, feeling that a
plea should be obtained and that the City Council should then have authority
to act as it felt appropriate regarding the license. However, a review of the
Eagan Beer, Wine & Liquor Ordinance, specifically Section 5.02, Subd. 4(F)
states "the Council shall revoke the license upon conviction of any law
relating to the sale or possession of beer, wine or liquor upon the premises
of the licensee, or if such revocation is mandatory by statute."
This reference appears to take out any discretion that the Council may have as
to the revocation of a license following such a conviction. Our ordinance
then goes on to state that the license may simply be suspended if the
violation is not willful. Even this discretion seems to contradict the

mandatory sanction of revocation in the preceding sentence. There is not
provision in the City Code as to the length of time for the suspension.
As the primary concern of an establishment in appearing on an alleged
violation of the liquor ordinance is the impact that such a violation would
have upon the license, I think it is important to clear up any ambiguity with
regards to these issues. If it is the Council's desire to take a strict
approach with regards to this issue and require the revocation of the license
upon any violation, it would be helpful to be aware of this so that we can
support the Council's intention.
If a suspension of the license is to take place upon the first two violations,
as is suggested in the ordinance, it would be helpful to determine the length
of these suspensions so that the licensee can be advised of this at the time
of entering into plea negotiations.
It appears to me that the ordinance is somewhat confusing in this regard. If
staff or Council would request that we amend the ordinance in this respect, I
would request an opportunity to meet with staff to discuss the general concept
which would be incorporated into the ordinance.
With regards to Valley Lounge, in my duties as Assistant City Attorney, I have
not become aware of other ordinance violations and therefore felt that the
plea negotiation that I have described above was appropriate and that, with
the admission of guilt, the Council could take this into consideration when
next acting upon the license of Valley Lounge.

Applicant requirements
1. This application must be completed and returned at least 30 days prior to sales and/or storage of fireworks.
2. A letter from the property owner granting permission to the applicant to sell and/or store fireworks on the property
shall accompany the application.
3. A floor plan designating the area where the fireworks will be sold and/or stored shall accompany the application.
4. A list of the fireworks that will be sold and/or stored along with the name, weight, quantity, and material safety data
sheets (MSDS) shall be included.
5. A copy of the certificate of insurance coverage as per City of Eagan City Ordinance No. 378, Chapter 6, Section 6.53
Fireworks is required.
6. Fee upon application for retail sellers selling exclusively consumer fireworks-$350; all other retail sellers-$100 per
vendor annually payable to the City of Eagan.
7. The fire chief or his/her designee will inspect the proposed location for selling and/or storing fireworks to determine if
it is a suitable location.
8 A criminal record check will be done on all applicants.
9. A copy of the City of Eagan license (permit) shall be displayed by the register.
