The san- itary manhole in question is an existing manhole. The storm sewer line we constructed was to the northwest of the existing sanitary line, away from the mini-storage building. Therefore, the grading work which was done was also to the northwest of the sanitary manhole. The cover over the sanitary manhole was a result of constructing the parking lot adjacent to the mini-storage building. Upon looking at the manhole location with respect to the mini- storage parking lot, it is obvious that the manhole must be raised as a result of constructing the mini-storage building and parking lot. It should be noted that the manhole must be raised by adding a manhole section and not by merely adding adjustment rings. The City standard for adjustment rings is 2-5 zings with cement between the rings and between the rings and casting. As stated previously, upon completion of the manhole adjustment, we will rec- ommend the City of Eagan make payment for the invoice. in the amount of $4,031.30. They claimed that they had no intent to connect to the system, and in the case of the Hosfords, that their house is 500 feet back from the south of the street and therefore, the project will connect to the street utilities. There was a question as to how Mr. Parranto arrived at the land value and there were questions concerning the storm sewer assessments and the reason for the proposed assessments. Members present discussed in aetail the potential for subdividing the four parcels on the south side and generally, the consensus was that they could not be subdivided, except for the Altobelli property. Councilman Egan stated that the parcel may not be developable in the future, but it would be difficult to control any deferrals administratively, and reviewed the options including the $14,000.00 increase in value, the $23,500.00 increase in value according to Mr. Parranto's appraisal for the three easterly parcels to defer the assessments, or determine a compromise. Egan moved to recommend to the City Council that the benefits for the Fritz, Hosford and Kohler parcels be determined at $14,000.00, and that the Altobelli parcel be determined to be two parcels due to its size, the potential for an additional residential unit to be constructed on the parcel, and the configuration of the property. It was noted the Altobelli property had been assessed $9,500.00 for earlier assessments and therefore the proposed assessment would be double the assessment for each of the other three parcels, or $28,000.00; further, that the Council could defer any assessment that, in its discretion, it determines for the parcel proposed to be assessed. The Hosfords objected to the $14,000.00 proposed assessment and requested that they be allowed to acquire an appraiser prior to the Council review. Mulrooney seconded the motion and all voted in favor. Consideration of this issue covered about 2 hours. CEDAR INDUSTRIAL PARK - LOT 2, BLOCK 2 EASY MINI STORAGE Chairman Don Knight then brought before the Committee, the consideration of the assessable footage for lateral benefit and trunk utilities provided for Lot 2, Block 2, Cedar Industrial Park. Tom Colbert noted that the parcel is intended to be developed by Richard Curry for rental storage units and that in 1978 sanitary sewer and water main utilities were installed in the industrial park. At that time, at the request of the property owner, Aspen Associates O.E. Parranto), the lateral benefit assessments for sanitary sewer and water were deferred until the time of connection. It was noted on the assessment card that there would be 350 feet of assessment, but Mr. Colbert stated that he could not determine how that figure was arrived at. 2 Assessment Committee Minutes August 1, 1985 The staff recommended that sanitary sewer be assessed at 763 adjacent feet, less 150 foot corner lot credit or 613 feet; further, that the water main be assessed at the benefited and assessable front footage of 693.89 feet. The rates in 1965 were $5.50 and $4.25 per foot for sanitary and water-lateral assessments, respectively, whereas, today the rates are $14.35 and $19.57 for sewer and water, respectively. Richard Curry and Joseph Lombardo were present and Mr. Curry made a presentation to the Committee. Councilman Egan stated that the 350 foot reference was only on the assessment card but there was no agreement for the assessments relating to the 350 feet.- Mr. Curry recommended an accrual of the assessments and reduction in the total assessments proposed at about $24,727.00. There was a question as to whether special consideration should be given because of the possible confusion relating to 350 feet on the record. Blomquist moved, Mulrooney aeconded the motion to recommend, noting some confusion, that the -assessments be determined on the full footage with the understanding that no precedent will be set, with assessment at the 1968 rates calculated below, utilizing an 8% simple interest accrual factor: $ 5.40 x 613 ft. _ $ 4.25 x 693 ft. $3,310.00 $2,949.00 TOTAL = 8% x 17 years or All members voted in favor $6,259.00 $8,500.00 a $14,771.00 LONE OAR ADDITION - TRUNK AREA WATERMAIN CREDIT A request from Laukka-Beck Properties for a watermain assessment credit, due to the oversizing of the trunk watermain in the Laukka-Beck Planned Development, was next brought before the committee. Tom Colbert reviewed a letter dated June 20, 1985 from Warren Beck regarding the request for increase from 12 inch to 16 inch watermain. Larry Laukka, developer, and Dale Beckman of BRW were present. Mr. Laukka stated that on may 30, 1985, the Bonestroo, Rosene consulting engineering office requested that the watermain be increased in size from 12 to 16 inches and he stated that-the developer is installing the watermain under a private contract. He further indicated that it was too late to request a City project at that point and the City policy is that it will not provide credit to existing or future assessments for the private installation of trunk utilities due to the fact that an accurate determination in value is hard to achieve without setting a precedent. UTILITIES: Sanitary sewer and watermain of sufficient size and capacity are in place adjacent to this proposed development to provide the necessary service to it. DRIVEWAY: Right -of access to this development is to be off of Shawnee Rd. as provided by a 40' road easement adjacent the right-of-way for T.H. 13. This proposed development is contemplating utilizing the existing LaFonda parking lot/driveway for use as access by obtaining necessary easements from the property owner. This would be in lieu of having to construct a separate roadway access within their easement. This would require removal of some improvements that the LaFonda property has installed such as curb and gutter, lighting and signage. Staff has no problem with a combined access other than the access should somehow be channelized to insure a driveway through the Lafonda propery to this develop- ment. Currently, a parking arrangement for LaFonda does not include any such channelization. During busy times for LaFondas, vehicles tend to park in a disorderly fashion, thereby creating problems for emergency vehicles and mini storage patrons from obtaining access to this development. In summary, Staff would recommend that improvements be made to separate the driveway from the parking lot whether the driveway access is built within the service road easement or a common driveway is shared with Lafonda. These improvements would probably be in the form of some additional curb and gutter, concrete islands, etc. RIGHT-OF-WAY/EASEMENTS: Easements shall be dedicated as per City Code if not already dedicated on the Cedar Industrial Park plat. If a common entrance is to be utilized with LaFonda, then a right of entrance easement or cross easement will be required over the LaFonda parcel. The average lot size is 9,800 square feet and the smallest lot is 8,000 square feet. The lot sizes are consistent with the lot sizes of the other Sun Cliff Additions. The applicant is requesting a 20-foot side yard setback from the street right-of-way instead of the standard 30 and similar variances were granted on the earlier plats. Pat Hoffman appeared for the applicant and requested the change to single family use. There were no objections. Bohne moved-; Mulrooney'seconded to recommend approval of the application noting that there is a downzoning in the use from the prior proposal and it was consistent with the use in density in the general area and subject to the following conditions: 1. ALL AMERICAN SELF STORAGE -- CONDITIONAL USE PERMIT The hearing regarding the application of RCKRRC Partnership - Dick Curry, for conditional use permit for caretaker's residence within two rental storage warehouse buildings located on a 2.8 acre site on the northwest side of Highway #13 south of Shawnee Road was convened by Chairman Mike Wold. Dale Runkle noted that the warehouse is a permitted use in a Limited Industrial District but a conditional use permit is required for the caretaker's residence, which will be located in Building No. 1. Mr. Runkle stated that the most important issue is access and it was noted that parking spaces along Highway #13 will be reduced to about two to three spaces. The applicant is working with the LaFonda restaurant owner to revise the access, with traffic generated at approximately 15 trips per day. Chuck Novack, architect, and Mr. Curry were present. They showed the access and'the architectural renderings for the buildings. One of the owners of LaFonda restaurant was also present and the staff recommended curbing through the parking area. Mulrooney moved, Trygg seconded the motion to recommend approval of the application subject to the following conditions noting that the parcel is essentially landlocked with a private easement, but that there is an easement of record over the LaFonda platted lot: 1. OAK CHASE FIRST ADDITION -- WAIVER OF PLAT The hearing regarding the application of Arthur Perri for waiver of plat consisting of Lot 1, Block 1, Oak Chase First Addition came before the Planning Commission. Mr. Runkle stated that the request is to split the 1.6 acre parcel into two lots with Parcel A including the existing house totalling 40.,000 square feet, with Parcel B being approximately 30,000 square feet. The property is zoned Estate Zoning with a minimum of 20,000 square feet per lot. There was concern by certain neighbors present about how the residence will be faced on the lot and Brad Swenson appeared for the applicant stating the future owners of the newly created lot, who were also present, were willing to face the house in such a way designated by the City staff. Bea Blomquist was present and asked if there were other lots in the subdivision which could be split and still comply with the minimum requirements. Dale Runkle indicated that no review of the subdivision had been made to determine whether there are lots in such a position. A neighborhood meeting had been held to explain the proposal and apparently there were no objections. There was concern, however, about starting a 115 8 I. SAC 8/1/85 V. LOT 2 BLOCK 2 CEDAR INDUSTRIAL PARR IL Enclosed on page JL is a letter received from the owner of Lot 2 Block 2 requesting some special consideration pertaining to the amount of assessments associated with the lateral benefit from trunk utilities for his parcel. Enclosed on page 3Z is a description of the property showing its relationship to the trunk sanitary sewer and the water main. In 1968, the sanitary sewer and water main utilities were installed in the Cedar Industrial Park. At that time, at the request of the property owner Aspen Associates (J. E. Parranto), the lateral benefit assessments for sanitary sewer and water were deferred until the time of connection. At that time, it was proposed that this property would be assessed for 350 feet for each improvement. Our records do not indicate how this 350 feet of-assessable frontage was determined. On March 28, 1985, the Advisory Planning Commission reviewed an application proposing to use this parcel as an EASY MINI STORAGE facility consisting of two storage warehouse buildings as shown on the site plan enclosed on page This proposed development was approved by Council action on April 16, 1985 with the condition that all outstanding additional assessments be paid as a condition of development. In calculating the present assessment obligation in accordance with current special assessment policy resulted in the following assessable footages: Sanitary sewer 763 adjacent footage less 150 foot corner lot credit equals 613 assessable feet Water main 693.89 benefitted and assessable feet When the original assessment was proposed to be levied, the rates were $5.40/ft and $4.25/ft for sanitary and water respectively. Part of the agreement to defer the original assessment until the time of connection allows the City to assess at the rates in effect at the time of connection which are $14.35/ft and $19.57/ft for sewer and water respectively. ay r ? STAFF'S RECOMMENDATION If the special assessment were to be calculated today in accordance with today's policies, the assessable footage would be as identified previously. There is incomplete records to determine how the original proposed 350 feet of assessable footage was originally determined in 1968. However, it is obvious that this lot receives more benefit than that footage. Therefore, it is the Staff's recommendation that the present special assessment policies be complied with and that the assessable footage be calculated as recommended and that the assessable rate be that which is currently in effect.
