WHEREAS, Landowners are willing to accept the deferment and pay the assessment all
upon the terms and conditions contained herein.
NOW, THERE-FORE, in consideration of the mutual promises contained herein and other
good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged,
the Parties do agree as follows:
1. DePSxRED ASSESSnaENT. The ParCies agree that the street improvemenY
costs under the Project in the amount of $3,554.40 shall Ue deferred
without interest until the earlier of the following:

amount of $3,554.40. The Landowners hereby waive the right to object or
appeal the assessments pursuant to MiNN. 5 ra'r. § 429.081 and further
waive notice of hearing on this Agreement.
3. BINOnvG EFFecT. This Agreement shall be binding upon and inure to the
benefit of the Parties' heirs, successors and assigns and shall run with the
land.

Dear Mr. Blaha:
I investigated the Cedar Grove Disposals, Cedar Grove, Eagan [Site 2110 (U-19)] after
conversing with both James Cooper of Eagan Tire & Auto Service, 3999 Cedarvale
Drive, Eagan, and yourself and then conducting a site visit to verify the information
in the site file, the historical aerial photographs, and other available information.
As I noted to you, the site file information was poorly documented and so my
additional work was warranted. Because of the snow cover, frozen ground, and
covered debris and refuse, the extent, volume, and characteristics of this waste site
can only 6e best descri6ed as speculative without appropriate borings, trenches or
test pits and then followed by the testing of environmental media and wastes.
I have enclosed the revised (and renamed) waste site report and map. There is no
charge for this follow-up service. Please let me know if you have any questions or if

CEDAR GROVE DISPOSALS [SITE 2110 (U-19)], EAGAN
Location
The Cedar Grove Disposals are located northwest of the intersection of Cedar Grove Parlcway
(formerly Beau D'Rue Drive), Cedarvale Drive, and Cedarview Drive in the City of Eagan [all
located in Public land Survey (PLS): Northeast quarter, Southwest quarter, Southwest quarter,
Northeast quarter of Section 19, T.27N., R23W.; Elevation approximately 800 to 820 feet above
mean sea level (amsl)] (Figure 1.). The waste site is apparently distributed along an
approximately 8 to 12-foot high slope that includes at ieast three properties as follows:
1. Eagan Tire and Auto Service, 3999 Cedarvale Drive, Eagan, MN 55122-1421. The
northeast portion of PIN 10-01900-070-08; 1.08 acres; Service garage built in 1970;
Owner: BN Investments, cJo James Cooper, 3999 Cedarvale Drive, Eagan, MN 55122;
2. Null's Equipment (out-of-business), 3998 Sibley Memorial Highway, Eagan, MN 55122.
The southeast portion of PIN 10-01900-030-08; 0.44 acre; Retaii store buiit in 1967;
Owner: James W. Null, 6190 West 169"' Street, Fartnington, MN 55024-7827; and
3. Colonial Car Wash, Cedarvale Drive, Eagan, MN 55122. The northeast portion of PIN
10-01900-090-08; 0.72 acre; Car wash built in 1968; Owner: Jeffrey Schendel, 1009-991h
Street, Roberts, WI 54023-8405.
Two other adjacent businesses share property lines with the above parcels, but it is presently
not known if any of the covered waste disposals are on the following properties:
1. Ace Hardware, 4000 Sibley Memorial Highway, Eagan, MN 55122; Possibly the south
border of PIN 10-01900-020-08; 0.34 acre; Retail store built in 1965; Owner. Lawrence
M. and Patricia A. Frattatlone, 3527 North Lexington Avenue, Arden Hills MN 55126; and
2. (former) Schwinn Bike Shop, 3997 Cedarvale Drive, Eagan, MN 55122; The west border
of PIN 10-01900-080-08; 0.96 acre; Retail store built in 1968; Owner: City of Eagan,
3830 Pilot Knob Road, Eagan MN 55122-1810.
Geoloqy, Hvdroloav and Groundwater Qualitv
Although the soils have been significantly altered or removed by urban development in the
vicinity, a few undisturbed remnants of the natural soils, namely the Chetek sandy loam and the
Hawick loamy sand, may still be present in places. The soils have developed on stream
terraces and glacial outwash deposits, which are both rapidly permeabie. The unconsolidated
sediments are adjacent to the more upiand mix of late-Wisconsinan Des Moines lobe and
5uperior lobe tills and ice-contact deposits, and the latter are approximately 125 to 175 feet
thick in the vicinity and overlie the weathered Prairie du Chien Group's Oneota dolostone
formation and possibly the superjacent New Richmond sandstone member of the Shakopee
formation (bedrock elevation approximately 650 to 675 feet amsl).
The sand and gravel aquifer's water table elevation is about 800 feet amsl or approximately 20
to 40 feet below ground surface depending upon one's position in the landscape. The
unconsolidated formation aquifer's flow direction is north-noRhwest towards the Minnesota
River. The Prairie du Chien's Oneota dolostone aquifer has a potentiometric surface of 760 feet
amsi (about 50 to 60 feet below ground surface), and the flow direction is approximately
northwest.
There are a number of unsealed, abandoned welis in the vicinity. These are especially
associated with buildings constructed before 1970 in the immediate area. It is not known if the
original Valley Tire and Auto Service, as well as the adjacent businesses, had its own well or not
before the building was connected to the city drinking water supply. There may be other
unsealed, abandoned wells on adjacent properties that had buildings constructed before 1970.
Abandoned wells shouid be located and permanently sealed in compliance with MCAR Chapter
4725 and County Ordinance No. 114.

Cedar Grove Disposals [Site 2110 (U-19)], Eagan
The shallow groundwater aquifer is impacted in the immediate area by the Nicols Groundwater
Contamination Plume', whose source has yet to be proven. In 1988-89, one-half mile north
(direction of the shallow groundwater gradient) of Instant Testing, 4000 Cedar Grove Parkway, a
number of chlorinated VOCs were detected in private wells near Silver Bell and Nicols roads
and monitoring welis west of the Seneca wastewater treatment piant (WWTP). The VOCs
included tetrachloroethene (PCE), trichloroethene (TCE), trichioroethane (TCA), chloroform,
dichlorodifluoromethane, methylene chloride, tetrahydrofuran, and di-n-octyl phthalate2. The
source(s) of the contamination has never been determined, and no further investigations have
been conducted in the area to date.
Description
Eaqan Tire & Auto 5ervice (fortnerlv Vallev Tire and Auto Service). The mostly covered
disposals are located northeast of the building where they have apparently accumulated over
and unknown period. It is not known if the bulk of the disposals occurred before, during or after
1970. The tire and auto service center building was originally constructed in 1970, which was
adjacent to a number of other small retail businesses and all of which were constructed in 1965
to 1968.
Waste soils, demolition and construction debris, commercial refuse, vehicle parts, and shop
wastes comprise the majority of the disposals. Fili soils and asphalt pavement may have been
placed over some of the waste soils, debris and refuse along the northern property line. The
only readily observable wastes are located northeast of the tire and auto service center on the
downhill slope shared with the former Null's Equipment at 3998 Si61ey Memorial Highway.
There has been no known investigation, cleanup, or closure of the waste disposal site, and its
current status is unknown. -
Valiey Tire and Auto Service (both a past and present Goodyear tire distributor) operated an
automotive repair shop at this location for more than 16 years (1970 to 1986) 6efore being -
licensed as a hazardous waste generator by Dakota County in 1986. Two other tire and auto
service centers in Apple Valley and Bumsville were also once associated. In early 1987, the
business name "Valley Tire and Auto Service" was changed to Eagan Tire and Auto Service.
Only the Burnsville business remains associated with this Goodyear service center.
There is no historical record of a hazardous waste disclosure covering the period for 1970
through 1986. However, in 1986 the company disclosed the following hazardous wastes:
carburetor cleaner (methylene chloride and chrysilic acid), Safety Kieen parts washer solvent
(not identfied although it was probably 5toddard's soivent), lead-acid batteries, and waste oil.
Waste streams for oiiy rags, oil filters and fluorescent mercury lamps were added in subsequent
disclosures through the years. Violations for the proper storage, location, containerization and
labeling of hazardous wastes were issued during a number of inspections from 1987 through
1998. However, the business appears to have complied with the orders each time.
On October 1, 1975, the tire and auto service placed into service an underground 250-gallon
steel tank for used oil. The tank was decommissioned and removed on May 29, 1997. There is
no information in the file regarding the tank's condition, as well as the appurtenant piping, and
' Minnesota Pollution Control Agency. 1992. Screening Site Inspection Report for Nichols (sic) Ground
Water Contamination, Eagan, Minnesota. USEPA ID MN985681246. The report reviewed the following
submittal: Dakota County Environmental Management Department. 1992. Final Report for Nicols Road
CAT Project, which is attached to the MPCA document.

' Cedar Grove Disposals [Site 2110 (U-19)J, Eagan
apparently there was no release of used oil during its 22 years of use as nothing is recorded on
the Minnesota Pollution Control Agency (MPCA) Spilis and LUST (leaking underground storage
tank) databases.
Eagan Tire and Auto Service is presently licensed by Dakota County as a very small quantity
generator for the following waste streams: filters for the Zep parts washer recyclable solvent,
lead-acid batteries, used oil and oil filters, and fluorescent mercury lamps. The company has
recently requested a conditionaliy exempt status based on waste stream changes in 1998-2000.
DCEMD staff discussed the waste site with James Cooper~, the primary contact for the
business, who has been associated with it for more than 20 years. To his knowledge, he is not
aware of any disposals on the Tire and Auto Service property. He believes that the hillside
disposals are actually on the adjacent, presently vacant, Null's Equipment property to the north°.
In fact, the property line is not marked and so it is not known on whose property the observed
disposals were noted in the past, as well as on whose property the current observations were
made. Since the latter was conducted when there was a snow cover and the ground was
frozen, surticial evidence of waste disposals are scant as they be mostly obscured and soil-
covered.
Null's Eauipment. A retail store has been in operation at this location since about 1968.
However, the building footprint has changed dramatically suggesting that sometime in the past
the original building was demolished and a new building was constructed in its place. It is
possible, but unknown, that some of the o6served demolition and construction debris, as well as
other refuse, may have originated from that period.
According to James Cooper5, James Null operated an equipment rental and small engine repair
shop, called Null's Equipment, here until about a year ago when he went out-of-business. On
March 5, 2003, County staff investigated the waste site in response to a call from one of the
property owners in the area. The hill slope between Eagan Tire and Auto and Nuli's Equipment
was covered with mature arbor vitae and the ground was covered with snow over tree needle
and leaf duff, rooted vegetation, and trozen soil. A smail amount of scattered demolition debris
(primarily concrete and asphalt), refuse, and litter was observed. More apparent was a large
amount of abandoned machinery, containers, batteries, and small engine parts, as well as
refuse and litter on the ground behind the former business. Some containers appeared to
contain waste oil and other unknown wastes. Other than some machinery, batteries, and parts,
some of the other items were not labeled or readily identifiable. As some of the machinery and
parts are potentiafly salvageable or recyciable, the owner should be advised to recover as much
of it as possible to reduce the amount of solid and hazardous wastes, which would require,
respectively, proper landfill disposal and disclosure, manifesting and TSD handling.
Colonial Car Wash. The carwash has 6een in operation since about 1968. On March 5, 2003,
County staff investigated the waste site in response to a call from one of the property owners in
the area. It is not known if the underlying demolition and construction debris is continuous along
the slope west to the car wash property, as weli as its extent south into the hillside. However, at
the far west end of the slope, a large area of car wash sand and sump wastes was observed at

the northeast comer of the car wash property that abuts the Ace Hardware and Eagan Tire &
Auto Service properties.
It appears that the car wash sand and sump wastes have been accumulating at that location for
a considerable period of time. From the more recent deposits, it appears that the car wash
sand and sump wastes were deposited as a water slurry. Car wash sand and sump wastes
include road salts, oil and grease, petroleum product wastes, radiator fluid, transmission fluid,
refrigerants, detergents and waxes, and refuse and litter. Corrosive salts, heavy metals, semi-
volatile and volatile organic compounds, and other inorganic and organic chemical compounds
have been detected in similar wastes. The car wash owner shouid terminate this disposal
practice and properly dispose of these wastes in a permitted, licensed landfill. The waste
disposal area should be tested for the above contaminants to determine the appropriate
corrective actions that may be required by DGEMD Waste Regulation staff.
Recommendations
The owners and businesses should provide detailed disposal histories to this Department to
facilitate the investigation, appropriate remedial efforts, and eventual closure of the waste
disposal site. The property owners are required to comply with all applicable State Laws and
Rules and Couniy Ordinances and should disclose the disposal site's presence, condition, and
impacts to any prospective buyers. If the on-site shallow groundwater is impacted by off-site
contaminant sources (e.g., Instant Testings), it is recommended that the owners investigate the
above disposal site under the aegis of the MPCA Voluntary Investigation and Cleanup (VIC)
Program to qualify for a letter of assurance for an off-site source determinatibn (Minnesota Land
Recycling Act, 1992).
Nonconforming solid waste disposal sites must be formally closed in compliance with Chapter
14, entitled "Nonconforming Sites and Facilities", of County Ordinance No. 110. A copy of the
ordinance may be obtained by accessing Dakota County's website at URL

Should a release of contaminants to environmental media (air, land, surface water, ground
water, etc.) be discovered, the owner or his/her agent is required (Minnesota Statutes, Chapter
115) to report it to the Minnesota State Duty Officer within 24 hours of discovery [Telephone
(651) 649-5451 or Call Toll-Free at Telephone (800) 422-0798], as weli as to this Department.
Any site investigation, cleanup, and Gosure should be performed with the review and approval
of the appropriate regulatory authorities. This may include the MPCA SuperFund Section [VIC
Program] and the Petroleum and Landfill Remediation Section. This Departrnent enforces the
County's Solid Waste Management Ordinance No. 110, the Hazardous Waste Regulation
Ordinance No. 111, the On-Site Sewage Treatment System Ordinance No. 113, and the Well
and Water Supply Management Ordinance No. 114. Departmental review and approval of all
plans and specifications are required before any site work is authorized or may be initiated.
