Dear Ms. Pester:
In response to your telephone call, I have researched the City file concerning the duplex
lot located at 1760 and 1762 Silverbell Road. Our records indicated that each unit has
its own water meter and its own water curb stop box near the street right-of-way line. Our
records indicate that Genz-Ryan Plumbing & Heating was the contractor who did the work
and Joe Connolly was the inspector for the City when the work was done in May of 1978.
Joe Connolly has since retired and no longer works for the City. Our as-built files indicate
only one service was installed from the sewer and water mains in the street to the
property line.
It is my contention that Lot 1, Block 1 is serviced by one sanitary sewer and one water
service from the sewer main and water main in the street and brahcnes or Y's off to two
services at approximately the property line location to serve the two units at 1760 and
1762 Silverbell Road. The only way we would know otherwise would be to have the
property owner dig up the services.

On April 27, 1979 a letter was sent to your attention informing you of the
proper procedure and construction specifications for the proper removal and
replacement of the concrete curb and gutter in front of the above referenced
duplex. Although we have not received a call for an inspection after this
curb and gutter has been removed, I have personally inspected this site and
found the removal not to be in compliance with the directive issued to you
on April 27. The curbing was not saw cut or removed at an existing expansion
joint and consequently extensive chipping and breakage occurred to the remaining
portion of curb and gutter. In addition, the sanitary manhole located adjacent
to the gutter section was disturbed and knocked off center during the removal
operaton. Consequently, any debris that gets into the sewer system and
subsequently creates a sewer backup will be considered a direct responsibility
of your curb and gutter removal operation. If you have a misunderstanding as
to what is being required by the City, please contact Mr. Bill Branch or myself
for the proper direction.
I have been informed by the Building Inspection Department that the existing
detached garages do not meet the required setback distance as per ordinance
from Silver Bell Road. It is my understanding that you were informed of this
violation last fall and have yet to bring it into compliance. Because we have
not received any indication of why this delay, we are required to set a deadline
for a completion of this relocation.
This letter is then to inform you that both the relocation of the garages to
insure compliance with the setback ordinance and the proper removal and replacement
of the curb and gutter sections will have to be completed by July 1, 1979. If the
work is not completed within this time frame and a proper written extension of time
has not been granted by Mr. Dale Peterson or myself, proper citations for ordinance
violations will be issued. Your anticipated cooperation in the compliance with this
requirement will be appreciated.

developer for the preparation of the feasibility report for street and utility
improvements in the First Addition subject to submission of an application by

CARL TOLLEFSON WAIVER OF PLAT
Carl Tollefson appeared on behalf of his application for waiver of plat
in order to subdivide six duplex lots for single ownership located in various
lots and blocks in Ches Mar and Cedar Grove Additions. The Planning Commis-
sion recommended approval on March 24, 1981, subject to certain conditions.
Mr. Tollefson indicated that Dave Gabbert and he are going to form a joint
homeowner's association for existing double bungalows in the Ches Mar area.
Egan moved, Parranto seconded the motion to approve the application subject to
the formation of a homeowner's association with the by-laws and articles to be
reviewed by the City staff and further subject to the following conditions:
1. All property shall retain the existing drainage and utility ease-
ments.
2. Each of the newly created lots must meet all applicable ordinance
requirements.
3. That the homeowner's association by-laws shall be subject to staff
review and approval.
All voted yes.
BRIARH3I1. TOWNHOUSE TEMPORARY ADVERTISING SIGN
R 81-23
The application of Carl Tollefson for temporary advertising sign to
advertise Briarhill Townhouses located on Silver Bell Road was next con-
sidered. The sign would be at the southwest quadrant of the new Trunk Highway
i13 and Silver Bell Road. Smith moved, Parranto seconded the motion, all
voted in favor, to approve the application subject to compliance with the
applicable ordinance.
WILLIAM MEADE WAIVER OF PLAT
The application of William Meade for waiver of plat to subdivide a five
acre parcel was next considered. Because of lack of appearance by the appli-
cant, Parranto moved, Wachter seconded the motion to continue the application
until the next regular meeting. All voted yes.
SALLY BEAUCHEKIN REZONING
The application of Sally Beauchemin for rezoning from R-1 to Agricul-
tural of a parcel in the Wilderness Retreat area on Cliff Road was next
considered. Ms. Beauchemin was present and indicated she preferred to rezone
to Agricultural rather than to acquire a special use permit as recommended by

1. The lots in question currently all contain one duplex upon a single lot.
The proposal is to split each lot to allow for separate ownership of
each duplex unit with lot.
2. Each of the newly-created lots would meet all ordinance requirements
applicable to the R-2 zoning designation.
3. The proposed lot splits would not negatively impact the character of
the neighborhoods and would encourage owner occupancy of the dwelling
units.
4. In the past, other similar waivers of plat have been granted in the
Ches Mar and Cedar Grove neighborhoods.
5. Separate utility lines are currently provided to each unit.
If approved, the waiver should be subject to the following conditions:
1. All property shall retain the existing drainage and utility easements.
2. Each of the newly-created lots must meet all applicable ordinance re-
quirements.
