(RAILROAD SPUR TRACK CLOSURE)

After a discussion with Mr. Joe Kennealy in late June, I made an
inspection of the spur track near Nicols Road. At that time
workmen were removing the track and Mr. Kennealy had never been
notified of the railroad's intent. He does own property adjacent
to the spur line and should have been notified prior to any
actual field work. The track is unusable in its current
condition.
I talked to Mr. Ray Gigear of the Chicago Northwestern
Engineering Department and he explained the potential safety
problems with the track, that it hadn't been used in years
(although there was a difference in years between the railroad
and Mr. Kennealy)and the cost of site inspections required for
all existing track whether in use or not.
Normally an application with the Transportation Regulation Board
is obtained before removal but in this case, where Chicago
Northwestern felt that safety was the issue, the removal began
first. I had a conversation with the attorney for Chicago
Northwestern and the removal was halted at that point until all
required permits could be obtained.
It appears that it was a case of placing the cart in front of the
horse - the intent was correct but the procedure and the legal
rights of all affected people were not correctly adhered to.
Enclosed is a copy of the letter from the railroad's attorney for
the project which was also copied to Mr. Kennealy. From the
City's standpoint we should not be involved any longer unless we
are notified as an adjacent land owner.

totally object to the removal of the spur track at Nicola
Station in the City of Eagan.
Thin spur track has been there and in use, since the rail-
road was built. I own property ajacent to this spur, acid
also used the epur for many years to ship molding sand over
your railroad to many foundries throughout the upper tdidwest.
Leo you recall, that back in the early 60's, your company
pulled up this same epur track) Chicago & roorthr;entern
Railroad was compelled b;r the State Railroad and Warehouse
Commission to re-install. It took a.f'ew weake, and it was
re-installeC,.
Now some 20 years later, for unknown reaRon, you pull the
pSl'rld spur agin. In my opinion, GN4v HR. should re-install
thie epur without further question. in 1986, and for good
reason, we still have a railroad. and,warehouee commission.

As I advised you, I represent the Chicago Northwestern Transportation
Company in connection with their Minnesota operations. This work
includes filing of petitions seeking authority from the Transportation
Regulation Board for retirement and removal of industry spur tracks
which are no longer needed in rail operations, and which cause a
burdensome and unnecessary expense to the railroad.
Every once in awhile the railroad undertakes to remove damaged or
defective switch points or frogs leading to industry spurs which
have not been utilized for some period of time. These sites
frequently cause train derailments, and removal is done primarily
for safety purposes. An application with the T.R.B.. is then filed
to obtain formal authority for the removal. While this reverses
the normal process, it is done in recognition of the fact that
the particular conditions cause a safety hazard which is normally
felt to override the procedural prerequisite.
I understand in the present case that the particular track is a
team track which has not been used for approximately 15 years.
Ray Gigear of the C&NW Engineering Department has told me that
the track and ties are in terrible shape, and it would cost a
prohibitive amount of money to rehabilitate the track to minimum
standards of the Federal Railroad Administration in order to
safely permit receipt of rail shipments over the track. Under the
circumstances, I think everyone can readily see that the expense
of rehabilitation and replacement of the switch and turnout is
not justified from any potential return the railroad could receive
on shipments on the line.

case, the railroad has had some difficulty identifying all of
those persons who might be considered to have an interest in
retention of the track, so the petition has not yet been filed.
I have requested that Ray Gigear expedite this so that we can
file a petition as soon as possible and notify all those persons
formally through the removal process. I will forward a copy of
the petition to you upon its filing with the T.R.B.

Dear Friends,
Wednesday evening August 6th, members of six homes gathered at out house
to ask the Andersons why they should build this huge garage. ( if any )
We feel that possibly the people granting them their permit are not
really aware of the manner in which it may be use and the extreme difficulty
in building on this steep hillside and its effect on neighbors now and in
future.
We are asking for permission to address the ciy council Tuesday evening
(or later) about canceling their permit to build.
CONCERNS
1. WHAT WILL THIS BUILDING REALLY BE USED FOR?
We feel, because of it's unusual size, that it will be used for commercial
purposes, even though it would be in a residential neighborhood. These
commerical purposes would include auto repairing, buying and selling auto
parts and selling for flea markets. They travel to many states now buying
the above while their place of business is closed nearly half the time.
2. THEY ALREADY HAVE A PLACE OF BUSINESS !
The Anderson own and operate Southside Auto which is only 10-15 minutes
away. It is located near the Vets Hospital at 4300 E. 54th Street. We asked
them why don't they add on or build there.
3• WE FEEL OUR PROPERTY VALUE WILL BE LOWERED.
The immense size of this building, the traffic in and out, its appearance
and the noise will alter the quietness and beautiful hillside natural setting
of the neighborhood.
4• A PROBLEM FOR YEARS TO COME.
We feel that as property changes hands this building will more than likely
be used in the wrong way in the future and will result in continous trouble the
neighbors, city council and Police.
5. EXTREMELY DIFFICULT BUILDING SITE.
Our backyards parallel.to.the creek are filled with "peat". This must be
removed to build. Several years ago two large bull-dozers were stuck in the
neighbors yard and needed much assistance to free them. Water springs up
all around the area. Our backyard has two 4" tile draining water all year.
They are asking to build in this setting! d.
Their contractor is a brother-in-law from Alaska. We questioned him
about the this building problem and we are not satisfied that he really knows
how to build in this type of earth and hillside.
6. DAMAGE TO OUR HUM.N:.
our home is below theirs on the hillside. We have a somewhat higher
basement ceiling ( 12 block ). We have been warned that our walls may be
cracked by the downward pressure and vibration from their nearby driveway.
It is still and unknown how many large trucks with tons of earth removal and
bringing in tons of concrete as well as bull-dozers) and cranes for the
spanning concrete members for the 3 floors and roof.
7. Building statistics on a 152 x 18U ioot lot.
