Such payments shall be made until the present mortgage against said property is paid off, at which time said remaining assessments together with interest shall be spread over five (5) years for Project #274 and fifteen (15) years for Project #285 and collected with the real estate taxes of said property, except that in any event said assessments shall be spread so as to be paid in full within thirty (30) years of the original levy of assessment. 2. The Owners, for themselves, their heirs, executors, administrators, successors, and assigns, agree to notify the City of the happening of any event which would allow the City to begin collecting said assessments pursuant to paragraph 1 above, and hereby authorizes any mortgage company to release to the City any information relating to any mortgage of the owners on the above property. 3. After review- ing the conditions of this agreement as it pertains to proper accounting and collection of the assessments, I have revised the agreement and am now forward- ing a copy of it to your attention for formal execution and subsequent return to my attention. The original agreement that you executed through the City Attorney's office in essence provided for a payment of $50.00 per month ($600.00 per year) to the City of Eagan to be credited towards interest until your present mortgage had been paid in full (estimated 1994). At such time, the assessment would then be certified to the County for collection through the property tax statements for a 5-year period for Project 274 (streets) and a 15-year period for Project 285 (utilities). This previous agreement provided for interest to accumulate at the rate of 11% per year on the original assessment principal until 1994 when they would then be spread for the appropriate years as referenced previ- ously. Your $50.00 per month payment would be allocated against this interest accrual until 1994. By deferring the levying of these assessments until 1994, the interest that you would be paying would amount to $7,880.00. This is in- terest that would acclunulate prior to arrv amount of the principal being paid off. While keeping in mind your desire and concern to limit your monthly payments to approximately $50.00 per month, I have prepared an alternative assessment procedure that the attached agreement was based upon. This agreement is bas- ed on the following considerations: 1) The special assessment installment made with your 1982 property tax state- ment would be credited against your principal and interest liability pro- portionately. Based on this revised agreement, Exhibit "A" is a sample of your annual and monthly installment payments that would result from approval of this agreement. `-As you can see, your first year monthly installments would start out at $61.27 per month and gradually decrease with each subsequent year. The reason we have selected a 30-year spread for this proposed agreement is that it is the maximum length that a special assessment can be spread by State statutes. The City cannot approve the original method proposed in the agreement prepared through the City Attorney's office due to accurate accounting and record keep- ing procedures. The City would have no control as to when this mortgage would be paid off, refinanced, assumed by a third party or title to the property sold to another individual. .In sunmary, because it will result in a long term net savings to you and provide a more accurate and better method of collection for the City of Eagan combined with the fact that the monthly payments approximate the $50.00 that you had de- sired, the attached agreement is the one that will be approved by the City sub- ject to your execution. Because it is necessary that this agreement be execu- ted and returned to my attention by December 1 so that it can be certified to Dakota County for inclusion in vour 1983 property tax statements, it is impera- tive that you execute the attached agreementr have it notarized and returned to ry attention as soon as possible. WHEREAS, the Owners have requested consideration pertaining to payment of spec- ial assessments for sanitary sewer, water, services (utilities) and street sur- facing with storm sewer (streets) improvements pursuant to Projects No. 285 and 274 respectively as it relates to the following described property: That part of Government Lot 7, Section 18, Township 27, Range 23, Dakota County, Minnesota, described as follows: Commencing at the Southwest corner of said Government Lot 7; thence East along the South line of said Lot 7 a distance of 104.29 feet; thence North at right angles a distance of 208.75 feet to a point that is 104.33 feet East of the West line of said Lot 7; thence West a distance of 104.33 feet to the West line of said Lot 7; thence South along the West line of said Lot 7 a distance of 208.75 feet to the point of beginning. The City shall accept the first year installments for special assessments as collected with the 1982 property tax statement and credit this installment towards principal and interest for each of Projects 274 and 285 proportionately. The City will then respread the remaining balance due for the principal assess- ment over a 30-year period with the first installment to be collected with the 1983 property tax statement. This special assessment spread shall allocate the resulting principal balance of $1,580.33 for Project 274 and $3,548.60 for Pro- ject 285 into 30 equal installments of $52.67 and $118.29 respectively. Inter- est will be levied at the rate of eleven per cent (11%) per annwm on any remain- ing unpaid balance commencing January 1, 1983. 2. The Owners, for themselves, their heirs, executors, administrators, suc- cessors, and assigns, agree to accept this reallocation of special assessment installment payments. 3. The City will accept am-7 prepa?mmts without penalty. Any and all pre- payments towards the assessments will be credited first towards the principal amount with the remaining interest calculated on any remaining unpaid balance.
