MARR h DAIiN SIMPSON - TEMPORARY PARRING - SPECIAL PERMIT
An application from Mark ana Dawn Simpson for temporary parking of four
trailer homes on their property east of Lexington Avenue, south of Northview
Park entrance, was brought to the Council for its consideration. The Simpsons
were present ana Dale Runkle explained the application'very briefly. There '
were no ob~ections. It was noted also that a similar application haa been
approved for 1985 at the regular council meeting on May 7, 1985. Egan moved,
Smith seconaed the motion to approve the applica[ion, sub,7ect to the following
conditions:

1. No more than fout trailers and/or campers may occupy [he si[e at any
one time.
2. The trailers sha11 be removed by DecemDer L, 1986.
3. The trailers ahall be located a minimum of 30 feet from any property
line.

LIVING WORD CHURCH - SPECIAL PERMIT - JERRY LEWIS THEATER
The application of Living Wora Lutheran Church for special permit for one
year temporary location for a church facility at the former Jerry Lewis
Theater in the Cedarvale area was submitted to the Council. Dale Runkle
statea that any proposed building structure changes will require approval from
the City Protection Inspections Department ana Fire Marshall. Representativea
of the applicant were present and there were no objections. Egan moved,
Ellison aeconaed the motion to approve the application sub,7ect [o conformance
with applicable City orainances. All voted yes.

the potential for moving the house around on the pad. Councilmembers statea
that it woula be important that ad~acent homes are not built out of

Dear Mr. Murray:
[ue would like to know if you can help us get some action from Bill
Diedrich, Diedrich Builders of Apple Valley, Minnesota.
In negotiations with Bill Diedrich on lot ~~6 Safari 2nd Addition
Eagan, :KN speciffically about soil compaction due to a pond at
the rear of the lot, Diedrich assured us several times that if
we bought the lot from him outright and izad a different builder `
construct the house, the price for the lot would be $25,900 as
stated an his plat map (attached). He also proposed that we have
his company construct the house for a$1900 cliscount on the price
of the lot, but $4D00.00 additional for excavating and cor.ipactioii
of the soil, He stressed the point that the soil ui'as bad and he
would only guarantee the house if his company compacted the Lot
and constructed the house, this brought the nrice of the lot to
$28,000 total. After considering the proposal we a reed and a
purchase agreenent was signed and earnest money of ~5000.00 was
paid 2/26/86. ,Our check was cashed iinme~diately,~~ lliedrich stated
that $5000.U0 was nee e in or er to start imme~ciately. A few
days later we,arranged the closing on the sale of our home.
Tumer Excavating of Savage, MN was to begin the ~ob, about one week
later Diedrich received the bicl fo.r excavating and compaction from
Turner._When IIiedrich recieved thesbid from Turner he called us
and stated he could not build us the home because it was going to
cost fiim more than he had figured on. (Note: Diedrich had soil tests
done by Subterranean May of ~34 and were in his file.) We consulted
an attorney and he advised us we had the xight to have the-home
built anyway. Our attorney also informed Diedrich. In try~ng`to
work with Diedrich we agreed at his request to move the house up on
the lot to save him money, then waited 3 weeks for the next Eagan
City council meeting to obtain a variance which was aranted 4-15-86.
Diedrich assured us ttiat he would begin the day after the variance
v~as granted, a few days before the variance was granted he told us
he could not af"ford Turner excavation but he liad Knutson Inc of Burnsville
lined up for the following Wednesday 4-'L3-86 after failing to start
4-23-86 we called Diedrich 4-24-$6 and he said Knutson would not
start because he was afraid of.damaging the road with his truck'
Steven Joyce called Knutson 4-24-86 and talked with Richard Knutson
the owner, he stated he did not know what Diedrich was talking about
and that he told Diedrich he.was not interested in compacting the
lot because he did not do much of that kind o£ work and this was a big
job. After that conversation we called Diedrich and he admitted that
Knutson would have done the job with payment in full on completion
of compaction, Diedrich said he declined the bid because they would not

give him 30 or 60 days to pay. He once again tried to back out of the
deal offering us our earnest money back which we again declined
because like we told Bi11 from the start that he was the one who
suggested the lot 6 which we 1ike, he changed our mind from building a'
split level to a walkout rambler because it would go better with
the lot due to the excavation and compaction and he assured us
many times during negotiations in February that t~re was no problem
with compacting the lot and doing the job right.. He then told us that
he was going to hire some friend of his to compact the.lot and
Fisher Aggregate of $avage to supply the backhoe and fi11 and
he would start 4-29-86, after failing to starC we again called
Diedrich and he told us he was not going to start until our loan was
approved. We then told Bill we would sue him to build and he said
he would make trouble for us and he suggested again we should
cancel the deal, which we feel is the most unprofessional,unethical,
negligent conduct a Realtor could pull.
Steven J.oyce went to Bill's office and insisted he begin building
immediately; Diedrich refused and said he had the right to cancel
the agreement because our loan had not yet been approved and that
he could keep our $5000.00 earnest money if we were not careful.,.
claiming costs incurred to him for staking out the lot.
Our verbal agreement was our $5000.00 to start, (NOTE: Old Stone
Mortgage said there'should be no problem with our loan due to 30%
down payment, minimal monthly commitments and good creuit rating.)
The mortgage'company was a recommendation from Dieflrich. 'rhe loan
was never a contingency:
