Temperatures
Cognizance of anticipated climatic conditions prior to
application of the mixed components Is essential In the
formation and resultant efficiency of the polyurethane foam
Insulation. Ambient air and substrate temperatures, moisture,
and wind velocity are all critical factors in selecting the
appropriate reactivity formulation. Variations In ambient air and
substrate temperature will influence the chemical reaction of the
two components, directly affecting the expansion rate, amount
of rise yield, adhesion and the resultant physical properties of
the foam insulation To obtain optimum resuhs, polyurethane
foam systems should be spris"pplled to substrates when
ambient air and surface temperatures fall within a range of
sw to 12orF. All substrates to be sprayed must be dry at the
time of application. Moisture In the form of rain fog, frost,
dew, or high humidity (>85% R.HJ will react chemically with
the mixed components, adversely affecting the polyurethane
roam formation, dimensional stability and physical properties of
the finished product Wind velocities In excess of 12 miles per
hour may result in excessive loss of exotherm and interfere with
the mixing efficiency of the spray gun affecting foam surface
texture, cure, physical properties and will cause ovesprey.
Precautions must betaken to prevent damage to adjacent areas
from fugitive oversprey.

STIPULATION AND ORDER
WHEREAS, Richard McGrew ("Petitioner") is the owner of a parcel
of land in the City of Eagan with the Property Identification No. of
10-00400-020-56 )("Subject Property"); and
WHEREAS, on July 2, 1991, Respondent City of Eagan ("City")
assessed the Subject Property a total sum of $7,451.06 for street per
area and also front foot as part of Public Improvement Project No.
543R; and
WHEREAS, Petitioner brought an'action in District Court appealing
the sum of the assessments for Project 543R, known as Richard McGrew
v. City of Eagan; Court File No. 19-C3-91-7934; and
WHEREAS, this matter was set for court trial on June 17, 1992
before The Honorable Judge Gerald W. Kalina; and
WHEREAS, the parties have resolved all dispute over the
assessment against the Subject Property.
NOW, THEREFORE, the parties do hereby agree as follows:
1. The assessments levied against the Subject Property for
Project 543R shall be reassessed in the sum of $3,200.00 all for
street per front foot.
2. The parties waive any rights to request costs in the
above-captioned action.
3. The City shall direct the Dakota County Treasurer to
recompute Petitioner's real estate tax statement using the
reassessment figure of $3,200.00 for assessments related to Project
543R.
4. The Petitioner waives Notice of Hearing and Hearing on the
reassessment of the Subject Property.
5. Upon the execution of the Stipulation, the Petitioner shall
cause this action, Court File No. 19-C3-91-7934 to be dismissed with
prejudice.

hereby appeals to the above-named District Court from a special
assessment in the amount of $7,451.06, as and for Project Number
1OP543R (Sibley Hills Drive/Skyline Road - Streets and Utilities).
The nature of the Petitioner/Appellant's claim is and the
grounds of this appeal are: 1) that there was no benefit to the
assessed property as a result of Project 543R; 2) the special
assessment exceeds the special benefits to the property and is
therefore a taking of property without fair compensation in
violation of the 14th Amendment; and 3) that said assessed property
has been improperly, unfairly and unequally assessed, in violation
of Minn. Stat. 429 and the 14th Amendment.
WHEREFORE, Petitioner/Appellant prays for the judgment of
this Court as follows:
1. That the Special Assessment Role be reviewed and
corrected, and that the assessment of Petitioner's/Appellant's
property be stricken from the Roll, or be reduced to a proper amount
and properly equalized with the assessments of other real properties
on the same Roll;
2. That this Court take evidence, or cause evidence to be
taken, to enable Petitioner/Appellant to show the illegality,
over-valuation, inequality, and error of the special assessment of
the real property of Petitioner/Appellant; and
3. That the Court grant such other and further relief as may
be just and as the nature of the case requires, together with the
costs and disbursements of this proceeding.

SUBJECT: FINAL ASSESSMENT ROLL, PROJECT 543R
SIBLEY HILLS DRIVE AND SKYLINE ROAD
The City Council at the conclusion of the public hearing on January 17; 1989,
ordered Project 543R. A major revision was adopted by the Council on June 6,
1989. According to the feasibility report, the following improvements were to
be constructed and/or assessed. The improvements are sanitary sewer lateral,
water laterals, water and sanitary sewer services, storm sewer trunk and street
and storm sewer improvements. Construction was completed under Contract 89-05.
Final payment was made to the contractor in April, 1991. Overhead at the rate
of 59.09% has been added to the construction cost to arrive at the project cost
and/or the assessment rates that are determined in the report. The assessment
hearing is scheduled for July 2, 1991. The following information was used in the
preparation of the assessment roll.

II. ASSESSMENTS
A. Trunk Assessments
Water and storm sewer trunk assessments for utilities were proposed in the feasibility
report. Storm sewer trunk assessments are proposed at $.056/sq. ft. in the assessment roll.
The rate used was consistent with that quoted in the feasibility report. No water trunk
assessments are proposed in the assessment roll because no water trunk expenditures were
incurred as part of the improvements installed.

Lateral and Other Improvements
Sanitary Sewer lateral
The sanitary sewer improvements consisted of installation of sanitary sewer structures
at a construction cost of $68,697.01. Overhead in the amount of $40,593.98 was added

Trunk Storm Sewer Improvement
The trunk storm sewer improvements consist of construction of the outlet of Pond HP-1
at a cost of $32,507.77. Overhead in the amount of $19,209.27 and easement acquisition
costs incurred to date of $87,465.45 were added which results in an improvement cost of
$139,182.49. Included in the assessment roll is a net assessable area of 855,999 square
feet assessed at $.056 per square foot. The assessment rate used is the rate quoted in
the feasibility report. However, the assessable area was reduced by deleting the Post
1st & 2nd Additions, Parcels 011-77 & 012-77 of Section 4, and Lots 050, 051, 062 & 063
of Treffle Acres after a re-evaluation of the area served by the drainage improvements.
Street and Storm Sewer Improvements
Streets, street drainage and streetlight improvements were constructed at a cost of
$292,628.58. Overhead in the amount of $172,918.13 was added which results in an
improvement cost of $465,546.71. According to the amended feasibility report the City
is to reduce the improvement cost by the amount of the reimbursement received from the
State of Minnesota for the extension of Rustic Hills Drive. The reimbursement has been
computed at $70,127.08. 'The amount to be assessed is, therefore, computed to be
$395,419.63, i.e. ($465,546.71 less $70,127.08). According to the feasibility report
these improvements are to be financed by assessment to the benefitted parcels in the
following manner. Half of the assessable cost is to be assessed based an the assessable
area served by the improvement and half of the assessable cost is to be assessed using
a front foot rate for properties abutting the improvement. The assessment rates were
computed in the following manner:

WHEREAS, Richard McGrew ("Petitioner") is the owner of a parcel
of land in the City of Eagan with the Property Identification No. of
10-00400-020-56 ("Subject Property"); and
WHEREAS, on July 2, 1991, Respondent City of Eagan ("City")
assessed the Subject Property a total sum of $7,451.06 for street per
area and also front foot as part of Public Improvement Project No.
543R; and
WHEREAS, Petitioner brought an action in District Court appealing
the sum of the assessments for Project 543R, known as Richard McGrew
v. City of Eagan; Court File No. 19-C3-91-7934; and
WHEREAS, this matter was set for court trial on June 17, 1992
before The Honorable Judge Gerald W. Kalina; and
WHEREAS, the parties have resolved all dispute over the
assessment against the Subject Property.
NOW, THEREFORE, the parties do hereby agree as follows:

1. The assessments levied against the Subject Property for
Project 543R shall be reassessed in the sum of $3,200.00 all for
street per front foot.
2. The parties waive any rights to request costs in the
above-captioned action.
3. The City shall direct the Dakota County Treasurer to
recompute Petitioner's real estate tax statement using the
reassessment figure of $3,200.00 for assessments related to Project
543R
4. The Petitioner waives Notice of Hearing and Hearing on the
reassessment of the Subject Property.
5. Upon the execution of the Stipulation, the Petitioner shall
cause this action, Court File No. 19-C3-91-7934 to be dismissed with
prejudice.

Minn. Stat. §429.061 reads as follows:

assessment hearing or presented to the
presiding officer at the hearing."
