THIS EASEMENT, made this day of 1994 between HOME
AMERICA, INC., a Minnesota corporation, herein refs rred to as "Landowner" and THE
CITY OF EAGAN, a Municipal Corporation, organized under the laws of the State of
Minnesota, hereinafter referred to as "City".
WITNESSETH:
That the Landowners, in consideration of the 'sum of One Dollar and other good and
valuable consideration, the receipt and sufficiency of which is hereby acknowledged, do
hereby grant and convey unto the City, its successors and assigns, a permanent drainage
and utility easement, over, across and under the described premises, situated within
Dakota County, Minnesota, to-wit:
That part of Lot 16, Block 1, Prettyman Heights lying southwesterly of a line drawn from
a point on the north line of said lot distant 52.57 feet easterly along said north line from
the most westerly corner of said lot to a point on the southeasterly line of said lot distant
24.65 feet northeasterly along said southeasterly line from the most southerly corner of
said Lot 16.
All according to the recorded plat thereof and situated in Dakota County, Minnesota.
See also Exhibit "A" attached hereto and incorporated herein.
The grant of the foregoing permanent easement for drainage and utility purposes includes
the right of the City, its contractors, agents and servants to enter upon the premises at
all reasonable times to construct, reconstruct, inspect, repair and maintain pipes, conduits
and mains; and the further right to remove trees, brush, undergrowth and other
obstructions. After completion of such construction, maintenance, repair or removal, the
City shall restore the premises to the condition in which it was found prior to the
commencement of such actions, save only for the necessary removal of trees, brush,
undergrowth and other obstructions.
And the Landowner, for itself, and its successors and assigns, does covenant with the
City, its successors and assigns, that it is the Landowner of the premises aforesaid and
has good right to grant and convey the easements herein to the City.

Utilities)--Due to unstable wet materials discovered during the construction of Ivy Lane,
granular material had to be brought in to provide a stabilized subgrade prior to street
construction. (Add $5,500.) All costs associated with this Change Order will be assessed
to the development.
ACTION TO BE CONSIDERED ON THIS ITEM: To approved Change Order #1 to
Contract 93-08 (Woodlands N. 3rd Addition - Streets & Utilities) and authorize the Mayor
and City Clerk to execute all related documents.

G. Reduce Limits of Access Easement (Lot 16, Block 1, Prettyman Heights Addition)--
The City currently holds an access easement over all of Lot 16, Block 1, Prettyman Heights.
The owner of this property has requested the City to enter into a Modification and
Amendment of Easement Agreement to redefine this easement to the southwesterly 10' of
Lot 16, Block 1, Prettyman Heights. Enclosed on page is a sketch showing the extent
of the easement to be retained providing access to a storm sewer system. Said Agreement
has been reviewed by the City Attorney's Office and Public Works Department and found
to be in order for favorable Council action.
ACTION TO BE CONSIDERED ON THIS ITEM: To approve the Modification and
Amendment of Easement Agreement for Lot 16, Block 1, Prettyman Heights, and authorize
the Mayor and City Clerk to execute all related documents.

The terms "Developer" and "Owner" as used herein refer to
SKYLINE HEIGHTS PARTNERSHIP whose address is 1480 Skyline Drive,
Eagan, Minnesota 55121.
WHEREAS, the Developer has applied to the City for approval of
the plat or subdivision known as PRETTYMAN HEIGHTS, located within
the City; and
WHEREAS, the Owner and Developer agree to notify potential
buyers of the Lots 16 and 17, Block 1, PRETTYMAN HEIGHTS of an
existing access easement. The access easement is to permit City
personnel and equipment to use this easement for the purpose of
utility maintenance. No obstructions such as trees, shrubs, fences,
buildings, gardens, etc. will be permitted to occupy this easement.
Any costs incurred for removal of any obstructions for access usage
by the City will be the financial responsibility of the individual
lot owner.
NOW, THEREFORE, the City, Owner and Developer agree as follows:
1. Recording. This agreement shall be recorded with the Dakota
County Recorder so as to provide notice to the owners of lots within
Lots 16 and 17, Block 1, PRETTYMAN HEIGHTS. The owner shall provide
and execute any and all documents necessary to implement the
recording of this agreement.
2. Notice. The recording of this document shall constitute
notice to all owners and future owners of Lots 16 and 17, Block 1,
PRETTYMAN HEIGHTS, of an existing access easement. The access
easement is to permit City personnel and equipment to use this
easement for the purpose of utility maintenance. No obstructions such
as trees, shrubs, fences, buildings, gardens, etc. will be permitted

198, by and between the CITY OF EAGAN, a

Munici?ali of the State of Minnesota, (hereinafter called the CITY,
and the Owner and the Developer identified herein.
The terms "Developer" and "Owner" as used herein refer to
SKYLINE HEIGHTS PARTNERSHIP whose address is 1480 Skyline Drive,
Eagan, Minnesota 55121.
WHEREAS, the Developer has applied to the City for approval of
the plat or subdivision known as PRETTYMAN HEIGHTS, located within
the City; and
WHEREAS, the Owner and Developer agree to notify potential
buyers of all lots within PRETTYMAN HEIGHTS that all lots (Lots 1
through 18, Block 1, Lots 1 through 4, Block 2 and Lots 1 through 4,
Block 3) are in a high water pressure zone and a pressure reducing
valve shall be installed in each home below the elevation of 875
feet. All costs shall be the responsibility of the Owner and
Developer and shall be installed to prevent damage due to high water
pressure.
NOW, THEREFORE, the City, Owner and Developer agree as follows:
1. Recording. This agreement shall be recorded with the Dakota
County Recorder so as to provide notice to the owners of all lots
within PRETTYMAN HEIGHTS (Lots 1 through 18, Block 1, Lots 1 through
41 Block 21 and Lots 1 through 4, Block 3). The owner shall provide
and execute any and all documents necessary to implement the
recording of this agreement.
2. Notice. The recording of this document shall constitute
notice to all owners and future owners of property in PRETTYMAN
HEIGHTS that all lots (Lots 1 through 18, Block It Lots 1 through 4,
Block 2, and Lots 1 through 4, Block 3) are in a high water pressure
zone and that a pressure reducing valve shall be installed in each
home below the elevation of 875 feet. All costs shall be the
responsibility of the Owner and Developer and shall be installed to
prevent damage due to high water pressure.
3. Validity. If any portion, section, subsection, sentence,
clause, paragraph or phrase of this agreement is for any reason held
to be invalid, such decision shall not affect the validity of the
remaining portion of this contract.
4. Binding Agreement. The parties mutually recognize and agree
that all terms and conditions of this recordable agreement shall run
with the land herein described and shall be binding upon the heirs,
successors, administrators and assigns of the owners and developers
referenced in this Contract.
